Abstract

This study examines illegal gold mining (PETI) activities in West Kalimantan Province from a normative legal perspective and its socio-economic impacts on the community. The prevalence of illegal gold mining is influenced by limited employment opportunities, low levels of public education, high gold prices, and the difficulty of accessing official mining permits. This study uses a normative legal method with an approach based on legislation, legal doctrine, and relevant literature. The results show that illegal gold mining constitutes an unlawful act as regulated in Article 158 of Law Number 3 of 2020 concerning Mineral and Coal Mining, which regulates criminal sanctions for perpetrators of illegal mining. Law enforcement is carried out through preventive and repressive efforts, but its implementation still faces obstacles such as the vastness of the mining area, limited apparatus, and the involvement of certain parties who profit from this illegal activity. On the other hand, illegal gold mining has a positive economic impact in the form of increased income and employment, but it also has negative impacts in the form of environmental damage, river pollution, social conflict, and the loss of potential state revenue. Therefore, a comprehensive policy is needed through strengthening supervision, simplifying licensing, and empowering the community economy.

Abstract

The Strait of Hormuz plays a vital role in global energy security. This article aims to analyze the impact of the closure of the Strait of Hormuz on geoeconomics and geopolitical security. This study employs a qualitative research method based on a literature review approach. The research examines how the closure of the Strait of Hormuz affects both geoeconomic stability and geopolitical security. The findings indicate that disputes in the Strait of Hormuz are driven by differing interpretations of international maritime law under the 1982 United Nations Convention on the Law of the Sea (UNCLOS), particularly regarding the Transit Passage and Innocent Passage regimes, as well as Iran’s domestic legislation, namely the Marine Areas Act of 1993.From a geoeconomic perspective, the closure of the Strait of Hormuz could generate instability in global energy markets, leading to inflation, reduced purchasing power, and increased fiscal burdens on governments seeking to maintain domestic economic stability. Both oil- and natural gas-exporting and importing countries would be affected, resulting in disruptions across various sectors and dimensions of national development. From a geopolitical perspective, the closure of the Strait of Hormuz has the potential to escalate tensions among Middle Eastern countries and major global powers with strategic interests in the security of international energy routes. Such conditions may lead to an increased military presence, intensified competition for political influence, and a greater risk of broader regional or international conflict. Ultimately, the stability of the Strait of Hormuz remains a crucial factor in maintaining the balance of global geoeconomics and geopolitical security amid the increasingly complex dynamics of international relations.

Abstract

This study examines the concept of women’s emancipation in the thought of RadenAjeng (R.A.) Kartini and its implications for the development of contemporary Islamic education. Although Kartini’s ideas have been widely recognized as a foundation for women’s empowerment and educational reform in Indonesia, their relevance to contemporary Islamic educational philosophy has received limited scholarly attention. This study investigates the philosophical foundations of Kartini’s emancipatory thought, its compatibility with Islamic educational principles, and its contribution to gender-responsive Islamic education. A qualitative library research approach was employed. Primary data were obtained from Kartini’s Habis Gelap Terbitlah Terang (Out of Darkness Comes Light), while secondary sources included scholarly works on Kartini, Islamic education, gender studies, and contemporary educational theory. Data were analyzed using qualitative content analysis and a critical hermeneutic approach. The findings demonstrate that Kartini viewed women’s emancipation as a holistic process that extends beyond equal educational access to include character formation, intellectual autonomy, human dignity, and social responsibility. These values align closely with the fundamental principles of Islamic education, including justice, equality, and the obligation to pursue knowledge without gender discrimination. Based on these findings, this study proposes an Emancipation- and Maslahah-Based Integrative Islamic Education Model that integrates intellectual empowerment, moral development, family leadership, social transformation, and civilizational advancement.The study contributes to the literature by offering a novel conceptual framework that reinterprets Kartini’s thought within a contemporary Islamic educational paradigm, providing theoretical and pedagogical guidance for developing inclusive, gender-responsive, and maslahah-oriented Islamic education.

Abstract

This study aims to analyze the level of compliance of BPJS Kesehatan with the Fatwa of the National Sharia Council-Indonesian Council of Ulama (DSN-MUI) No. 98/DSN-MUI/XII/2015 concerning the Guidelines for the Implementation of Sharia-Based National Health Insurance, particularly in the aspects of fund management and institutional operations. This research employed a qualitative case study approach at the Lubuk Pakam Branch of BPJS Kesehatan. Data were collected through observation, in-depth interviews, document analysis, and literature review, and were analyzed using descriptive qualitative techniques with the DSN-MUI Fatwa as the analytical framework. The findings indicate that BPJS Kesehatan has implemented several Sharia principles, including ta‘āwun (mutual assistance), the separation of Social Security Fund assets from operational assets, financial transparency, and participant-oriented fund management. Nevertheless, compliance with the DSN-MUI Fatwa remains partial. The institution has not established a Sharia Supervisory Board, the Fatwa functions merely as a policy consideration rather than an operational guideline, and several aspects of the National Health Insurance scheme continue to raise concerns from the perspective of Islamic law, particularly regarding the potential presence of gharar (uncertainty), maysir (gambling), and riba (usury). The study concludes that although BPJS Kesehatan substantively reflects several Islamic values in its governance, full compliance with the DSN-MUI Fatwa has not yet been achieved. Therefore, greater regulatory harmonization, strengthened Sharia governance, and enhanced supervisory mechanisms are required to develop a national health insurance system that is more consistent with the principles of Islamic law.
