Abstract

Abstract

This study presents an in-depth, comprehensive, and critical analysis of the effectiveness of the implementation of Sambas Regency Regional Regulation Number 11 of 2015 concerning the Provision of Legal Aid in Pangkalan Kongsi Village, Tebas District. This research is motivated by the paradox between the normative guarantee of access to justice contained in regional regulations and the sociological reality of rural communities alienated from formal legal services due to structural, cultural, and geographical barriers. Using an empirical juridical approach (socio-legal research), this report dissects the interaction between legal substance, law enforcement structures, and the legal culture of the local community. The research findings reveal that although Sambas Regency has progressive legal instruments, their effectiveness in Pangkalan Kongsi Village is still low. This is caused by five main factors according to Soerjono Soekanto's theory of legal effectiveness: (1) The absence of technical regulations for the general public which contrasts with detailed regulations for ASN; (2) The limited reach of accredited Legal Aid Organizations (OBH) such as LBH Tridharma Indonesia due to operational constraints; (3) Severe physical infrastructure deficiencies, marked by damage to the main road in Muara Dungun Hamlet and the collapse of a vital suspension bridge, creating an unbearable cost barrier; (4) Low legal literacy among the poor, exacerbated by the stigma of legal fees; and (5) Strong cultural preferences for non-litigation dispute resolution through customary and deliberative mechanisms (Besaprah), which have not been optimally integrated with the state legal aid system. This report recommends budget policy reform, accelerated development of access infrastructure, and strengthening village-based paralegal schemes to bridge the justice gap.

Abstract

This research is motivated by the importance of implementing the principles of Good Governance in the provision of public services at the sub-district level, as mandated in Sambas Regency Regional Regulation Number 4 of 2020. The Pemangkat Sub-district Office as the implementer of public services has the responsibility to implement the principles of good governance such as transparency, accountability, responsiveness, effectiveness, efficiency, and the rule of law. The purpose of this study is to determine how the implementation of Regional Regulation Number 4 of 2020 at the Pemangkat Sub-district Office, identify obstacles encountered in its implementation, and describe strategies undertaken to improve the quality of public services. This study uses a qualitative method with an empirical normative approach, and data collection through observation, interviews, and documentation. The results of the study indicate that the implementation of the Regional Regulation has begun to run with several indicators such as the installation of service flows, the preparation of SOPs, and increasing employee professionalism. However, there are still shortcomings such as the lack of available service information, limited facilities, and the absence of a formal complaint system. The obstacles faced include structural barriers, such as a lack of infrastructure and limited budgets, as well as cultural barriers such as a lack of public understanding of the contents of regional regulations and minimal public participation. Strategies implemented include utilizing information technology through websites and social media, increasing employee capacity, and service innovations such as the outreach program in collaboration with the Population and Civil Registration Office (Disdukcapil). Future efforts are directed at developing digital applications and public complaint forums to make services more inclusive, efficient, and equitable.

Abstract

The refugee problem has become one of the most pressing global challenges in contemporary international relations. Armed conflict, persecution, insecurity, and humanitarian crises have compelled millions to flee their countries of origin in search of safety and survival. In response, the international community, under the auspices of the United Nations, has established a legal framework for refugee protection, most notably through the 1951 Refugee Convention, its 1967 Protocol, and the institutional role of the United Nations High Commissioner for Refugees (UNHCR). Despite widespread ratification of international refugee law, implementation varies significantly among states. Many Western countries, while formally committed to international instruments, increasingly adopt restrictive asylum policies and practices such as narrow interpretations of refugee status, procedural barriers, externalization of responsibilities, and securitized approaches to protection. This study uses a qualitative doctrinal and analytical legal approach. It relies on secondary sources including international legal instruments, UNHCR documents, and peer-reviewed literature. The analysis reveals a growing gap between legal commitments and state behavior. Western asylum governance demonstrates selective and minimalist compliance with international refugee law, reflecting restrictive interpretations and practices that undermine the spirit of asylum protection. Contemporary refugee governance in the West does not represent a wholesale rejection of international law but rather a pattern of limited compliance that weakens the normative foundations of asylum rights.

Abstract

This study aims to analyze Indonesian migrant workers from an international economic and legal perspective. This study uses a normative legal research method with a statute approach and a conceptual approach. The data used are secondary data obtained through literature studies, including laws and regulations and scientific journals relevant to migrant workers. The results of the study indicate that Indonesian migrant workers have an impact on the economic and international legal fields. In the economic field, the presence of Indonesian migrant workers can improve the economy, reduce unemployment rates in their countries of origin, and provide skills for Indonesian migrant workers. However, on the other hand, the negative impacts create dependence on work as Indonesian migrant workers. Meanwhile, from an international legal perspective, Indonesian migrant workers are objects of international law. There are several conventions that regulate Indonesian migrant workers. The aim is to provide protection to Indonesian migrant workers working abroad.

Abstract

The spread of Islam in Indonesia took place through peaceful cultural and spiritual adaptation rather than through political domination. This process was deeply influenced by the role of ulama, tarekat (Sufi orders), and Islamic organizations that contributed significantly to the formation of Indonesia’s religious identity. This study aims to analyze how these three elements interact in shaping and maintaining Islamic traditions while promoting a moderate and inclusive understanding of Islam. The research uses a qualitative descriptive method with a library research approach by analyzing academic journals, books, and historical records related to Islamic education, spirituality, and institutional development. The results show that the collaboration among ulama, tarekat, and Islamic organizations forms a strong and synergistic relationship that strengthens Indonesia’s Islamic identity. Ulama act as moral and spiritual guides, tarekat serve as centers of inner purification and religious practice, while Islamic organizations institutionalize these values through education, preaching, and social empowerment. Together, they succeed in preserving Islamic traditions that are contextual, tolerant, and relevant to the dynamics of modern Indonesian society.

Abstract

The discourse on religious diplomacy and the governance of Islamic law in the Southeast Asian region cannot be separated from the institutional role played by the forum of Religious Ministers of Brunei Darussalam, Indonesia, Malaysia, and Singapore (MABIMS). Since its establishment in 1989, MABIMS has evolved from a mere informal consultative forum into a strategic platform facilitating the harmonization of regional Islamic policies amidst the dynamics of globalization and geopolitical challenges. This research report aims to comprehensively identify, analyze, and evaluate the strategic role of MABIMS in responding to the contemporary problems of Muslims in Southeast Asia. This research is structured adhering to strict academic guidelines, focusing the analysis on three main pillars: the unification of the Hijri calendar, the standardization of the halal industry ecosystem, and the mainstreaming of religious moderation (Islam Wasathiyah). This study uses a qualitative literature-based research method (library research) with a normative-juridical and historical approach. Data were collected through critical reading of official MABIMS resolution documents, Islamic journals, and public policy literature from member countries. The identification results indicate that MABIMS plays a central role in: (a) ratifying the New Criteria for hilal visibility (minimum altitude of 3 and elongation of 6.4) to reduce disparities in Islamic holiday celebrations and unify the regional Islamic astronomy (Ilmu Falak) paradigm; (b) harmonizing cross-border halal certification standards to strengthen the ASEAN region's position as the epicenter of the global sharia economy; and (c) strengthening soft power diplomacy through integrated Hajj management and the promotion of Islam Wasathiyah as an antithesis to transnational extremism and puritanism. The main conclusion of this study emphasizes that although MABIMS resolutions are conceptually and normatively very ideal, their implementation at the grassroots level still collides with sociological obstacles, methodological pluralism, local traditional heritage, and the political sovereignty of each country. Therefore, social engineering strategies and the transformation of resolutions into more binding legal instruments are needed to ensure a real and measurable impact on the unity and welfare of Muslims in the Nusantara region.

Abstract

The fundamental discourse concerning the architectural relationship between Islam, state entities, and power mechanisms constitutes an academic subject that consistently occupies a central position within political historiography and the sociology of the state. This comprehensive research aims to dissect and profoundly reconstruct the evolution of the political dynamics of Islamic governance. The study traces the historical timeline from the formative phase of the prophetic era, shifting towards the monarchical forms of major dynasties, traversing the power acculturation of the Malay-Nusantara Sultanates, until finally crystallizing into a structural transformation towards the modern nation-state. The analytical approach is focused on the epicenter of the Nusantara region, where the convergence of orthodox Islamic doctrines and local wisdom engendered a distinct variant of governance, prioritizing the principles of social harmony and cultural accommodation. The findings indicate that the relationship between religion and the state has never operated within a static vacuum; conversely, these entities continually undergo a historical dialectical process profoundly influenced by the determinants of social structure, political-economic rationality, and disruptions stemming from colonial intervention. In the contemporary era, the political articulation of Islam demonstrates a high degree of resilience, manifested through the emergence of Civil Islam in Indonesia and the polarization of ethno-religious identity-based political structures in Malaysia, representing two divergent pathways in state governance. In conclusion, the Islamic political paradigm in this region has successfully achieved a hybridization between adherence to transcendental divine values and the implementation of democratic, inclusive, and pluralistic governance principles.

Abstract

This study traces the historical and sociological processes of acculturation between Islamic teachings and local cultures in Southeast Asia, which has produced an adaptive, moderate, and inclusive civilization known as Islam Nusantara. Employing a descriptive-analytical qualitative method with a historical-sociological approach, this research relies on library research analyzing academic literature and historical records. The findings indicate that the spread of Islam in this region occurred peacefully through trade and Sufi cultural approaches, subsequently giving rise to a distinct typology of cultural integration within Malay and Javanese societies. This acculturation manifests physically in the architectural aesthetics of ancient mosques with odd-numbered tiered roofs, and socially through the preservation of indigenous traditions. Various traditions—such as the Buang-buang ritual to ward off misfortune, the oral art of Dzikir Nazam, and the Saprahan banquet tradition—have retained their functions, yet their core essence has been sublimated with the values of Tawhid (monotheism) and egalitarian equality. Through the adept application of ushul al-fiqh (Islamic jurisprudence) approaches based on 'urf (local customs) and maslahah (public interest), Nusantara scholars were able to harmoniously weave sharia doctrines with customary traditions. In conclusion, Islam Nusantara proves itself to be not merely a religious entity, but a civilizational force that promotes the values of moderation (wasathiyyah) while simultaneously serving as a soft power in cultural diplomacy to mitigate the threat of global extremism.
