Abstract

The purpose of this study is to determine and analyze the criminal liability of business actors for illegal mining crimes. To determine and analyze the weaknesses of criminal liability of business actors for illegal mining crimes. To overcome and analyze the criminal liability of business actors for illegal mining crimes in the future. The method used by the researcher is a normative legal approach and the specifications in this study are descriptive-analytical. The data sources in this study are secondary data obtained from literature studies. Data are analyzed qualitatively. Based on the results of the study that Based on the descriptions that the author has put forward in the discussion chapter, the author concludes that the criminal liability of business actors for illegal mining crimes is with civil sanctions and also administrative sanctions by revoking business licenses. The weakness of criminal liability of business actors for illegal mining crimes is the difficulty of proving the element of error. This is because the subject of corporate law is different from humans who have reason and thoughts. Criminal liability of business actors for illegal mining crimes in the future is regulated in Article 158 of Law Number 3 of 2020, mining business actors without IUP can be sentenced to a maximum of 10 years in prison and a maximum fine of IDR 10 billion. The application of strict and appropriate criminal sanctions can be an effort to prevent illegal mining in the future.

Abstract

The background of this research is Law number 30 of 2014 Section 20 states that if the result of Supervision of Government Internal Apparatus (APIP) in the form of administrative error, follow up in the form of administrative improvement, if there are administrative errors that cause loss of state finance done financial loss state and state losses are imposed on the Governing Body, if an administrative error occurs not due to an element of abuse of Authority. This is certainly contrary to the law of corruption. The issues raised in this study are how the role of the Police and the obstacles in handling reports of alleged abuse of authority in corruption after the enactment of Law No. 30 of 2014 on Government Administration, as well as what steps are needed for the handling of corruption can effectively prevent loss of state finances. This research uses qualitative method with empirical juridical approach. The results of the research indicate that the role of the Police in handling the report of alleged misuse of authority in corruption crime after the enactment of Law No.30 of 2014 is in handling the report of alleged abuse of authority, it is first the Police consult with experts, general experts, social experts and politics whether abuse of authority is included in the criminal realm or administrative error domain. In addition it is suggested to put forward on the results of supervision of APIP. Polri's obstacles in handling reports of alleged abuse of authority are: a) investigation of alleged misuse of authority done by APIP, b). No involuntary summons c) If there are administrative errors that incur losses of state finances, subsequent reversals are made to the state's financial loss so it can not be criminalized. Measures necessary for the handling of criminal acts of corruption can effectively prevent financial losses of the state a) Police cooperate and / or coordinate with BPK, KPK, PPATK, and other government agencies in law enforcement efforts and state financial loss returns; b) corruption prevention and prevention is actualized in the form of strategies to minimize the four aspects of the causes of corruption. Abstract

The problem studied in this research is about the implementation of law enforcement of POLRI discipline based on Good Goverment and Clean Goverment to the members in POLDA Central Java and the weakness and solution to the implementation of law enforcement of POLRI discipline to the POLDA members of Central Java in order to realize Good Goverment and Clean Goverment.The method used in this research is with socio-legal research approach that comes from collecting data obtained from primary data and secondary data, then analyzed by qualitative analysis method.The results of this study ultimately provide an answer that the implementation of POLRI discipline based on Good Governance and Clean Goverment against members in POLDA Central Java is as the process of law enforcement in general in the process of law enforcement of police members against Central Java Police members are inseparable from the five factors comprise from legal factors, law enforcement factors, facilities and infrastructure, society and culture other than that weaknesses and solutions to the implementation of law enforcement discipline POLRI to the members of POLDA Central Java for the realization of Good Governance and Clean Goverment, related to the weakness is the legal awareness of members of the Police is still less and the environment / association is also a weak factor of enforcement of discipline, the solution is the conceptual law enforcement and law enforcement as a process must be realized by 1) Increasing the quality of Provost Police Investigators 2) Increasing awareness and kepa Polri's staff against discipline and 3) Procurement and management of supporting facilities for enforcement of Discipline Law.Suggestions from this research are to the police institution is expected to create more programs related to coaching members to minimize violations of police discipline and create members in accordance with the ideals of the police in order to realize the image of good and clean police.Keywords: Law Enforcement, Police Discipline, Good Governance and Clean Goverment.

Abstract

Agricultural land has a role and function as a basic resource in land-based agriculture. The erosion of agricultural lands by human activities causes the conversion of agricultural land into non-farms is increasing. The Birth of Batang Regency Regulation Number 7 Year 2011 About Spatial Planning of Batang Regency Year 2011-2031 has led to the potential of land conversion to non-agriculture. finally the Office of Agriculture Crops and Animal Husbandry draft proposes and develops a policy of Regent Regulation to prevent the transfer of land functions. Through the analysis of David Easton System Theory obtained a scheme of policy models that occurred in Batang District related to the protection of agricultural land. Abstract

ABSTRAKTulisan ini bertujuan untuk mengetahui pengaturan tindak pidana perasuransian dalam Hukum Pidana dan Undang-Undang Asuransi, dan pertimbangan hukum oleh Hakim dalam tindak pidana perasuransian. Berdasarkan hasil penelitian dapat disimpulkan bahwa tindak pidana perasuransian diatur dalam Undang-Undang Nomor 40 Tahun 2014 tentang Perasuransian dan Pasal 381-382 KUHP. Perbuatan yang termasuk dalam kategori kejahatan asuransi adalah menjalankan kegiatan usaha tanpa izin usaha; dengan sengaja memberikan laporan, informasi, data, dan/atau dokumen yang tidak benar, palsu, dan/atau menyesatkan; penggelapan premi dan kekayaan perusahaan asuransi; melakukan pemalsuan atas dokumen; menandatangani polis baru dari perusahaan asuransi yang sedang dalam pengenaan sanksi pembatasan kegiatan usaha; menggunakan atau mengungkapkan informasi apapun yang bersifat rahasia kepada pihak lain; kejahatan korporasi. Kemudian, sebab-sebab terjadinya kejahatan dalam kegiatan asuransi adalah karena adanya kebutuhan, kesempatan, dan keserakahan.Kata Kunci : Kejahatan Asuransi, Penggelapan, Pertimbangan Hukum. ABSTRACTThis research aims to find regulation of insurance crimes in the criminal law and Insurance act as well as legal consideration by Judges in insurance crimes. Based on the results of this research concluded that the crime of insurance regulated by Insurance Act No. 40 of 2014 and Article 381-382 of the Code of CriminalLaw. Actions of insurance crime are running business activities without a business license; deliberately providing false reports, information, data, and / or documents;embezzlement of premium and the insurance company's assets; forgery of documents; signed a new policy from an insurance company that is on the imposition of sanctions restrictions on business activities; using or revealing any confidential information to other parties; corporate crimes. Abstract

ABSTRAKPeran dan tanggung jawab Polri sebagai Penegak Hukum dalam melaksanaan restorative justice untuk keadilan dan kemanfaatan masyarakat sangat diharapkan implementasinya, karena Polri menjadi ujung tombak dalam penegakan hukum, sehingga dituntut optimal dalam penanganannya. Hasil penelitian menunjukkan dengan menggunakan metode yuridis normatif dapat disimpulkan bahwa dengan menjadikan restorative justice sebagai pendekatan maka ada beberapa keuntungan yang didapatkan. Pertama, masyarakat diberikan ruang untuk menangani sendiri permasalahan hukumnya yang dirasakan lebih adil. Kedua, beban negara dalam beberapa hal menjadi berkurang. Penyidik Satreskrim Polres Rembang dapat melaksanakan mekanisme restorative justice melalui diskresi yang dimilikinya karena hal itu merupakan kelengkapan sistem, hukum nasional dapat diterima apabila dilaksanakan berdasarkan falsafah negara Pancasila, menjamin keadilan serta perlindungan hukum terhadap Hak Asasi Manusia. Untuk menjamin keseragaman dalam implementasinya, diperlukan suatu norma dan payung hukum untuk memberikan legitimasi agar tindakan yang dilakukan Penyidik Satreskrim Polres Rembang dalam implementasi restorative justice tidak dianggap ilegal.Kata Kunci : Keadilan, kemanfaatan , musyawarah. ABSTRACTThe role and responsibility of the Police as Law Enforcement in the implementation of restorative justice for justice and the benefit of society is expected to be implemented, because the Police become the spearhead in law enforcement, so it is demanded optimal in handling it.The result of this research is by using normative juridical method can be concluded that by making restorative justice as approach then there are some advantages obtained. First, the community is given space to handle its own legal problems that are felt more just. Second, the burden of the state is in some cases reduced. Police criminal detective Rembang can implement restorative justice mechanism through its discretion because it is a complete system, national law can be accepted if implemented based on Pancasila state philosophy, guarantee justice and legal protection to human rights. To ensure uniformity in its implementation, a legal norm and umbrella is required to provide legitimacy to ensure that actions carried out by the Police criminal detective Rembang in the implementation of restorative justice are not considered ellegal.Keywords: Justice, benefit, discussion.

Abstract

The application of hermeneutics as a method of interpretation was still debatable among Muslim scholars. Some of them accepted the presence of hermeneutics as one of the relevant methods to understand the interpretation of al-Qur’an, even though this method came from outside the treasures of Islamic world. Hermeneutics was needed to understand the alQur’an, especially to address contemporary issues which mostly laid no settlement in the classical interpretations. Others to be a priori and utterly rejected the use of hermeneutics as a methodology of interpretation for various reasons. The main reason put forward this group was because this method emerged in the West and was used to understand the bible which some extents provided different characteristics from the interpretation of al-Qur’an. This study brought out controversies of hermeneutics surrounding the reasons of Muslim scholars in which certain group put on descriptive-analytic and looked for compromises on such differences. Therefore, a wise outlook on approaching various disciplines that enter and thrive the discourse of Islamic scholarship which is especially used to understand the alQur’an as a book of guidance should be wisely approached to enrich the scientific insights of Muslims in general.Keywords: Hermeneutics, Controversy, Compromise, Manhaj, Commentary

AbstrakPemerintah memberlakukan Undang-undang Nomor 8 Tahun 1999 tentang Undang-undang Perlindungan Konsumen (UUPK) guna mewujudkan kegiatan perdagangan yang lebih baik, melindungi, dan meningkatka harkat serta martabat konsumen.Sekarang ini UUPK tidak dapat diwujudkan optimal ketika kewenangan Pemerintah Kabupaten/Kota di bidang perlindungan konsumen, dicabut setelah diberlakukannya Undang-undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah. Kewenangan itu sekarang hanya ada di Pemerintah Provinsi. Padahal Pemerintah Kabupaten/Kota memiliki tanggung jawab untuk menghormati dan memberi perlindungan pada konsumen serta mewujudkan perdagangan yang baik di daerahnya.Seperti di Kota Semarang, kegiatan perlindungan konsumennya sekarang ini sangat tidak efektif. Perlindungan konsumen yang ada semata-mata karena kebijakan. Sangat tepat bila Pemerintah Kabupaten/ Kota harus diberi lagi kewenangan di bidang perlindungan konsumen. Perlindungan itu penting karena menyangkut kebutuhan masyarakat dan harus dioptimalkan.Kata Kunci : Efektifitas, Perlindungan Konsumen, otonomi daerah AbstractIt is right if the government enacts Law No. 8 Year 1999 on Consumer Protection Law (UUPK) in order to realize better trade activities. Trading has to ensure the improvement of the public welfare and certainty of the quality, quantity, security of goods and/or services obtained by consumers. Consumers’ pride and dignity must always be improved.It is inappropriate if the good objectives of UUPK cannot be realized optimally when the authority of government(City/District) in the field of consumer protection is revocated after the enactment of Law Number 23 Year 2014 on Regional Government. Now, the authority exists only in the Provincial Government. Whereas the District orCity Government has the responsibility to respect and provide protection to consumers and to realize a good and right trade in the region.As happens as in Semarang, theconsumer protection activity is ineffective, passive and only active if it is invited by Provincial Government. Infact, the activities by the Provincial Government itself are very limited and must be given to 34 districts or other cities in Central Java.With the principle of the enforcement of UUPK is muchmore important than the authority revocation, Semarang City Government keeps trying to provide the best service for consumerprotection even with all kinds of its limitations. That is why it is very proper if once more, Semarang(District/City Government is given the authority in the field of consumer protection. Abstract

Increased criminal narcotics with the mode of illicit traffic, illegal transactions and misuse. The impact is 78% of deaths aged between 19-21 years. Government policy to overcome the dangers of narcotics through the guidance of correctional clients aimed at, restoring clients and productive life in the community. The purpose of this research is to know and explain the prevention system of narcotic narcotics, the implementation of post-rehabilitation guidance to correctional clients, constraints and solutions to improve guidance implementation in Class I Correctional Center of Semarang Central Java. This research uses empirical juridical approach through purposive sampling method. The results of the study, the prevention system of narcotic drug crime contains four stages of integrated therapy intervention for correctional clients namely initial acceptance, rehabilitation, post-rehabilitation and termination. Output system, client recover from narcotic dependence. Post-rehabilitation guidance prioritizes governance in procedural aspects of administration, fulfillment of facilities, planning, organizing, implementation, monitoring and monitoring and evaluation. Constraints of implementation of post-rehabilitation guidance due to internal and external factors of correctional clients. Abstract

The objectives of this study: 1). to find out how legal protection for child victims of sexual violence is based on positive law in Indonesia today; 2). to find out what are the weaknesses of legal protection for child victims of sexual violence based on positive law in Indonesia today. This study uses a normative legal approach, with a descriptive analytical research method. The data used are primary and secondary data which will be analyzed qualitatively. The research problems are analyzed using the theory of legal objectives and the theory of punishment. The results of the study conclude that: 1) Legal protection for child victims of sexual violence based on positive law in Indonesia today that the context of protection for victims of crime, the existence of preventive and repressive efforts carried out, both by society and the government (through law enforcement officers), such as providing protection/supervision from various threats that can endanger the lives of victims, providing adequate medical and legal assistance, a fair examination and trial process for perpetrators of crimes, is basically one manifestation of human rights protection and a balancing instrument; 2). The weakness of legal protection for child victims of sexual violence based on positive law in Indonesia is that law enforcement officers (police, prosecutors, judges) still treat child victims of sexual violence as objects, not subjects whose legal rights must be listened to and respected. They mostly still make child victims of sexual violence a second victim (revictimization) of the case they experienced. Victims are still often blamed and not given the protection they need. The officers (police, judges, prosecutors) do not have a perspective on child victims of sexual violence.
