Abstract

  The result of this study is that there are differences in the process of applying for remission. The enactment of PP No. 99 of 2012 has tightened the granting of remission rights for all community members. In the previous regulation, namely Government Regulation Number 32 of 1999, it was stated that giving remissions was felt very easily by the government so that there was a very significant change and was felt by prisoners and criminal children who no longer had the right to remission. This is because prisoners affected by PP No. 32 of 1999, only need to be submitted to the Regional Office, while for prisoners affected by PP No. 99 of 2012, the application for remission is submitted to the Minister of Law and Human Rights. In addition, taking into account the government regulations above, it will become a polemic in the Correctional Center because the Correctional Law regulates the rights of every inmate regardless of the status and severity of the sentence imposed on the convict, including narcotics crime cases. Granting remissions must be obtained by every prisoner and criminal child without distinguishing each case imposed on the prisoner and criminal child. Terdapat perbedaan proses pengajuan remisi. Diberlakukannya PP No 99 Tahun 2012 telah memperketat pemberian hak remisi bagi para seluruh warga binaan pemasyarakat. Pada peraturan sebelumnya yakni Peraturan Pemerintah Nomor 32 Tahun 1999 bahwa Pemberian remisi dirasakan sangat mudah oleh pemerintah sehingga terjadi perubahan yang sangat signifikan dan dirasakan  oleh  narapidana dan anak pidana yang tidak mendapatkan lagi hak remisi tersebut. Hal ini dikarenakan narapidana yang terkena PP no 32 Tahun 1999, cukup di ajukan sampai di Kanwil saja, sedangkan untuk narapidana yang terkena PP no 99 tahun 2012, pengajuan remisi di ajukan sampai ke Menteri Hukum dan HAM. Pengetatan ini menyebabkan menyebabkan terjadinya overload kapasitas di hampir seluruh Lembaga Pemasyarakatan di Indonesia tak terkecuali di LP Lowokwaru Malang. Salah satu narapida yang terus mengalami lonjakan dari tahun ke tahun adalah narapida narkotika. Selain itu, dengan memperhatikan peraturan pemerintah di atas, maka akan menjadi polemik di Pemasyarakatan karena di dalam Undang- Undang Pemasyarakatan mengatur tentang hak setiap warga binaan tanpa melihat status dan beratnya hukuman yang dijatuhkan kepada terpidana termasuk kasus tindak pidana narkotika. Pemberian remisi harus didapatkan setiap narapidana dan anak pidana tanpa membedakan setiap kasus yang dikenakan pada narapidana dan anak pidana tersebut.Kata-kata kunci: Lembaga Pemasyarakatan, Remisi, Narapidana Narkotika

Abstract

 Peran notaris dalam kajian Undang-Undang Nomor 2 Tahun 2014 Tentang Perubahan Atas Undang-Undang Nomor 30 Tahun 2004 Tentang Jabatan Notaris sudah jelas, artinya kedudukan peran notaris dalam sistem hukum di Indonesia sudah diatur dalam peraturan perundang-undangan atau norma yuridis yang berlaku. Notaris yang menjadi penyelenggara profesi hukum terikat pada sistem yuridis yang mengaturnya. Dalam sistem hukum di Indonesia ini, notaris ditentukan hanya sebagai pihak yang menerapkan atau mengimplementasikan aturan tentang kewenangan, kewajiban, atau apa saja yang menjadi larangan bagi notaris untuk menjalankannya. Pemerintah (negara) mengangkat notaris sebagai professional hokum yang  memberikan jasa hukum  kepada pihak-pihak yang meminta atau memohon layanan yuridis kepadanya. Sebagai pihak yang diangkat oleh negara maka notaris dapat dikategorikan sebagai pejabat negara. Menyandang status sebagai pejabat negara berarti notaris menjadi wakil Negara di bidangnya.Peran notaris dalam memberikan jasa hukum pada masyarakat dalam kajian Undang-Undang Nomor 2 Tahun 2014 Tentang Perubahan Atas Undang-Undang Nomor 30 Tahun 2004 Tentang Jabatan Notaris, adalah bahwa  peran penting atau mendasar yang dijalankan notaris ini diikat oleh peraturan perundang-undangan untuk menjalankan norma-norma hukum yang berkaitan diantaranya dengan tugas, kewajiban, kewenangan, larangan, dan lainnya, sehingga diantara peran ini, notaris dituntut untuk mempertanggungjawabkannya, khususnya dalam kaitannya dengan penegakan hukum.  Peran menjalankan norma-norma yuridis dalam hal tugas, kewajiban, kewenangan, larangan, dan lain sebagainya adalah menentukan terhadap bekerjanya hokum dalam memberikan jasa layanan hokum pada masyarakat, sehingga yang dilakukannya ini mengandung konsekuensi yuridis dalam kaitannya dengan kepentingan penegakan hukum. Ada hak-hak masyarakat yang ikut dirugikan ketika norma hukum tidak dijalankan sebagaimana mestinya. Kedudukan notaris demikian ini merupakan tuntutan kepada notaris sebagai pengemban profesi hukum, bahwa peran yang dilakukannya tidak bisa dianggap main-main. Negara mendelegasikan kewenangan melalui norma (sistem) yuridis pada notaris untuk melakukan pencatatan dan penetapan serta penyadaran hukum kepada masyarakat, terutama menyangkut legalitas dokumen perjanjian atau kerja sama yang melibatkan peran notaris dengan para penghadap atau pihak-pihak yang membutuhkan jasa layanan hukum.

Hasil penelitianiniAsas-asas pada hukumperjanjian Islam yang bisadiimplementasikansecaranorma pada penyusunanaktaautetikantara lain asasikhtiyariataukerelaan, asasamanahatauketepatanjanji yang sejalandenganasas pacta sunt servanda, dan asastaswiyahataukesetaraan yang searasdenganasaskeseimbangandalam Kitab Undang-Undang Hukum Perdata. Akadsebagaimanamenjadiacuandalampenyusunanaktaautentiknotariilmengacu pada Surat Al Baqarah ‎ayat 282 yang intinyabahwasanyapenyusunanseluruhakadataupunaktaautentikwajibdisaksikansetidaknyaduasaksi. Notarissepatutnyamenguasaisecaramendetilterkaitdenganperbandinganantaraasas yang terdapatdalamperjanjianmenuruthukum Islam denganasas-asasperjanjianmenuruthukumpositif di Indonesia. Kesimpulannyapenyusunanaktaautentikdapatmengacu pada prinsip-prinsipsebagaimanadiajarkandalamajaran Islam dengantetapmematuhiamanathukumpositifdalampenyusunanaktaautentik.‎ Kata kunci : Asas-AsasPerjanjian, Hukum Islam, AktaNotariil The objectives of the current study are: 1) to find out what Islamic principles are used in drafting a notarial deed, 2) to find out the criteria for Islamic agreement that can be included in drafting an authentic notarial deed, 3) to determine the suitability between the Law on Notary Position No. 2 of 2014 and the principle of the contract contained in Islamic law concerning the drafting of a notarial deed. This is a normative juridical research which is descriptive and analytical. It examines information by referring to general legal theory and then applies it to describe various other related information. According to the results of the study, the principles of Islamic contract law that can be implemented normatively in drafting authentic deeds include the principle of ikhtiyari or willingness, the principle of trustworthiness or the accuracy of promises that are in line with the principle of pacta sunt servanda, and the principle of taswiyah or equality which is in line with the principle of balance in the Civil Code. The contract, as a reference in the preparation of an authentic notarial deed, refers to Surah Al Baqarah verse 282 which explains that the preparation of all authentic contracts or deeds must be witnessed by at least two witnesses. A notary should master in detail the comparison between the principles contained in the agreement according to Islamic law and the principles of the agreement according to positive law in Indonesia. In conclusion, the preparation of an authentic deed can refer to the principles as taught in Islamic teachings while still complying with the mandate of positive law in the preparation of an authentic deed.‎Keywords : principles of agreement, Islamic law, notarial deed

Abstract

Abstract : A valid agreement shall apply as law to the parties. The agreement is binding on the parties and cannot be revoked or cancelled unilaterally only. If you want to withdraw or cancel it, you must obtain the consent of the other party, so it is agreed again. However, if there are sufficient reasons according to the Law, the agreement may be withdrawn or canceled unilaterally. in Article 1338 paragraph (2) of the Civil Code. states that: "such agreements shall be irrevocable other than by agreement of both parties, or for reasons which the Act declares sufficient therefor". From Article 1338 paragraph (2) of the Civil Code, it is clear that the agreement cannot be canceled unilaterally, because if the agreement is canceled unilaterally, it means that the agreement is not binding between the people who made it. Article 1266  and  article 1267 of the Civil Code which reads  "the party against whom the engagement is not fulfilled, can choose whether he, if it can still be done, will  compel the other party to fulfill the agreement, or whether he will demand the cancellation of the agreement, accompanied by reimbursement of losses and interest." So it is clearly stipulated regarding the condition of void if one of the parties does not fulfill its obligations. The cancellation must be requested to the court through a lawsuit, this is intended so that later no party can cancel the unilateral agreement on the grounds that one of the other parties does not carry out its obligations (default). One of the considerations for the cancellation of a unilateral agreement can be sued with a lawsuit against the law, because it is considered that unilateral cancellation is not based on the reasons justified according to their agreement to be canceled, and can be said to have violated their legal obligations under the law, in this case violating Article 1338 paragraph (2) of the Civil Code.Keywords : Legal Consequences, Unilateral Termination of Contract, Distributor.

Abstract

Abstract : Execution of this credit could have obstacles. For example, a debtor commits a default that leads to credit clogging. However, banks or creditors have found a way to solve the credit crash. There are two (two) ways to solve a problem credit: saving credit and settling credit. One of the ways that banks are defeating credit blocks is through debt billing redirection, commonly called a cessie. A legal question arises regarding a cessation act made by a notary, namely that the guarantee applied to that act has expired. The question is: what are the legal consequences for the recipient of the cessie against the act of the cessie with the object of guaranteeing the right of possession of the certificate of right of use of the building that has expired its term, and how can legal action be taken by the reciprocator of the cessie against an act of cessie with the object of guaranteeing the right to possession of the building's right of usage that has expired its term. In writing this thesis, the researcher uses normative research methods. As for the results of the legal investigation of the cessioner against the cessie act with the object of the security of the right of use of the building that has expired its term, the act is still considered valid and the new creditor still acquires the right to the account but cannot be granted the right for the building to be secured by the new creditors and can not be registered such object of security to the land office due to the expiry of the time period of the rights of use such building as well as the legal effort that can be made by the recipient of the cessie against the act of cession with the objects of the guarantee of the Right of Use of the Building Certificate of Use which has exceeded its term is negotiated against the old creditor concerning the said act of cesie by asking the liability to the old creditors to renew or extend the time of the construction rights that have expended its term.

Abstract

This study aims to analyze the legal consequences of the abolition of mortgage rights released in the public interest, in addition to analyzing the protection of creditors if land rights are used as collateral for debts by debtors. Abstract

Abstract : A notary is a public official who is authorized by the state to make authentic deeds whose actions must comply with statutory regulations and Article 1868 of the Civil Code. In making the deed, it must be guided by article 38 UUJN and article 1868 of the Civil Code. The aim of this research is firstly, to analyze the existence of the signatures of the parties in the land sale and purchase binding agreement by notarial deed numbering, and secondly, to analyze the legal protection of the notary and the parties after signing the land sale and purchase binding agreement deed but the certificate has not been checked for the deed numbering.The research method used is normative juridical approach with concepts and laws and regulations. The results of the research and discussion show that: First, the existence of the signatures of the parties in the land sale and purchase binding agreement and the numbering of the notarial deed cannot be separated because after the deed of the sale and purchase binding agreement is made and the BPHTB is paid, it must be read by the notary to the applicant and immediately signed by the parties and the notary are simultaneously numbering the deed because it affects the authenticity of a deed, and if this is not done simultaneously then the authentic power of a deed will be degraded. Second, legal protection for the notary and the parties after signing the deed of the agreement binding the sale and purchase of land but the numbering of the certificate has not been checked, for the seller the form of protection is to ask for a down payment associated with the cancellation of the deed if the buyer defaults, while the form of protection for the buyer is the implementation of the achievement and levering if it has been paid off and has absolute power of attorney, this is feared by the seller for breaking his promise, while the form of notary protection is guided by article 66 UUJN.Keywords: Existence, Signature, Deed Numbering

Abstract

The more widespread and demanding times regarding social media are used by some people to market their businesses, including online loans. Now this is the problem that the population of Indonesia is Muslim and many are from the Nahdatul Ulama group, so the writer is interested in writing with the formulation of the problem How is the Legitimacy of Loans (Online Loans) Viewed from Islamic Law and the Views of Aswaja Ulama in Indonesia. And how is the law in the online lending and borrowing system not being paid by the debtor according to the perspective of Islamic law and the scholars'. This study uses a type of normative legal research. The results of this study indicate that: The Legitimacy of Loans (Online Loans) Is Reviewed from Islamic Law and the Views of Aswaja Scholars in Indonesia. The author is of the opinion that borrowing money that is not in accordance with Ahlu Sunnah waljemaah is generally unlawful or unlawful because it is not in accordance with Islamic law, because there are conditions and pillars that are not in accordance with the contract that do not fulfill face to face and there is an element of usury in it even though some of them justify it. various notes. The author also agrees with the fatwa of the Indonesian Ulema Council. He argues that borrowing money is not permissible under Islamic law. However, the law in question is not only illegal online loans; Similar laws also exist for offline or direct loans that contain elements of riba and are therefore not legal according to Islamic law. The law in Islamic Lending and Borrowing Online Systems is not paid by the debtor According to the Perspective of Islamic Law and the Ulama, the author concludes that it is clear in Islamic law that paying legal debt is obligatory even though it is online lending which has been banned through the MUI fatwa and the government has advised not to paying a legitimate loan because it causes a lot of misery to the community with high interest, but in syari' in Islamic law it is mandatory to return or pay off the debt. In Islamic law, debt repayment is not allowed to be added with the intention of benefiting the muqridh, but if the addition is given on the basis of the willingness or sincerity of the muqtaridh with the aim of remuneration, then this is permissible because it is not usury.Keywords: Loans, Online, Islamic Law

Abstract

Abstract : The Indonesian government continues to carry out development in various fields in line with the mandate of the opening of the 1945 Constitution of the Republic of Indonesia, namely to advance the welfare of all Indonesian people. Therefore, the Indonesian government is trying to achieve this goal by carrying out public development. Development for the public interest requires land as an important aspect that supports its successful implementation. However, the problem is that the land controlled by the state is limited. Based on these circumstances, the government carries out land acquisition using land of individuals or legal entities that have been controlled for public purposes. In this case, Betoambari Airport, Baubau city, is carrying out construction, namely expanding the runway area which requires land around the airport area. The problem formulation in this thesis is, What is the process of implementing compensation for land rights for the public interest in the development of Betoambari Airport in Baubau City, what obstacles occur in the implementation of providing compensation for the development of Betoambari Airport in Baubau City, and How to Overcome Obstacles in the Implementation of Compensation provided by Betoambari Airport Development in Baubau City. This research uses empirical juridical research methods with a conceptual approach and a statutory approach, both of which are interconnected by concepts and statutory regulations. The results of the research in the implementation of providing compensation for land rights along with land acquisition for the expansion of the Betoambari Airport area in Baubau City were carried out in 2 stages, totaling 23 plots of land with a total area of 34,177 M². bank, in an effort to overcome these obstacles, the city government provides time to complete the installments of the bank loan and encourages the community involved in the loan to complete the obligations of the certificate owner.

Abstract

Managing the establishment of a Limited Liability Company for some community groups is considered a hassle and a burden. Some people ask for help from other parties to arrange certificates of establishment, while others use it as a business opportunity by providing deed management representative services. This study aims to reveal the role of a notary in notarial duties, the status of the deed of establishment of a represented Limited Liability Company, and the execution of making authentic deeds through a second party. The research method used is juridical-empirical with primary, secondary, and tertiary data as well as qualitative analysis. The results of the study show that as long as the second party fulfills the requirements of a notary, obtaining the deed of establishment through them is not a problem. The signing of the deed by the business owner and the second party is an important moment in the process. The deed of establishment through a third party has legal status if it follows the procedure set by a notary. In conclusion, notaries in Kediri are familiar with the management of Limited Liability Companies through third parties with anticipatory steps to ensure compliance with applicable regulations. Keywords: Business Law; European Competition Law; Market; Predatory Pricing
