Jurnal Hukum & Pembangunan (JHP) is one of the oldest published law journals in Indonesia. Published in 1971 by the Faculty of Law, Universitas Indonesia originally titled "Hukum & Pembangunan". JHP adopts a double-blind peer review policy, and focused on various subdisciplines of the legal science, among others: Basic principle of jurisprudence Private law Criminal law Procedural law Economic and business law Constiutional law Administrative law International law Law and society In addition to these fields, JHP also accepts texts covering topics between law and other scientific fields such as legal sociology, legal anthropology, law and economics, and others. Published 4 (four) times a year in March, June, September and December. Each issue contains 15 articles, both conceptual articles and research articles. JHP is published in Indonesian, but an English text is also accepted.

Abstract

This research critically evaluates the constitutionality of Indonesia's Presidential Threshold as regulated by Article 222 of Law No. 7/2017, requiring political parties or coalitions to secure 20% of DPR seats or 25% of national valid votes for presidential nominations. The term “Presidential Threshold” follows Constitutional Court jurisprudence, distinguishing it from the election threshold in Article 6A(3) requiring 50%+1 votes to win the presidency and the parliamentary threshold in Article 414 requiring 4% of votes for legislative seat allocation. Through normative legal analysis of Constitutional Court decisions No. 51-52-59/PUU-VI/2008, 53/PUU-XV/2017, and 62/PUU-XXII/2024, this study examines 33 judicial reviews from 2017 to 2025. Findings reveal that the Presidential Threshold restricts political participation by marginalizing small parties and independent candidates, fostering elite-driven coalitions, and undermining electoral justice. This contravenes the 1945 Constitution's principles of people's sovereignty in Article 1(2) and equal nomination rights in Article 6A. Comparative analysis with Brazil's runoff election system, which avoids nomination thresholds, highlights Indonesia's exclusionary framework that exacerbates polarization and weakens democratic legitimacy. The study concludes the Presidential Threshold perpetuates oligarchic dominance and recommends its abolition alongside reforming Constitutional Court standing rules to enhance inclusivity, strengthen judicial accountability, and align Indonesia's electoral system with substantive democratic principles.

Studi ini meneliti perbedaan interpretasi dan penerapan hukuman tambahan berupa restitusi (uang pengganti) dalam kasus korupsi melalui analisis komparatif keputusan Angelina Sondakh di pengadilan tingkat pertama, pengadilan banding, pengadilan kasasi, dan pengadilan peninjauan yudisial. Muncul interpretasi ganda antara memandang restitusi sebagai kompensasi atas kerugian keuangan negara dan sebagai mekanisme untuk menyita keuntungan ilegal. Judex facti menolak penerapan restitusi dengan alasan bahwa tidak terjadi kerugian negara dalam kasus suap dan gratifikasi, sementara judex juris di tingkat kasasi menafsirkan restitusi sebagai instrumen pemulihan aset yang ditujukan untuk keuntungan yang diperoleh secara ilegal. Orientasi konseptual yang bertentangan ini menghasilkan perbedaan signifikan dalam penjatuhan hukuman dan mengungkapkan inkonsistensi dalam kerangka normatif Undang-Undang Anti Korupsi dan Peraturan Mahkamah Agung No. 5/2014. Studi ini menemukan bahwa kurangnya tujuan normatif yang jelas untuk restitusi secara langsung berkontribusi pada penalaran yudisial yang tidak konsisten, sehingga merusak kepastian hukum dan efektivitas pemulihan aset. Diperlukan rumusan normatif yang lebih jelas yang menegaskan restitusi sebagai instrumen untuk menjamin hasil korupsi guna mencapai konsistensi dalam penjatuhan hukuman dan memperkuat penegakan hukum anti-korupsi.

Abstract

As an effort to concretize ethics, there is a process of formalizing ethics into a set of rules through a code of ethics. The code of ethics needs institutional enforcement instruments so that it can be effectively applied through ethical trials. Ethical courts, as institutions that adjudicate violations of the code of ethics, have the authority to issue decisions as a follow-up to cases of violations of the code of ethics that they handle. In carrying out its duties, ethical courts use ethical and moral analysis to assess the appropriateness of an action. This analytical approach differs from legal decisions based solely on regulations. This condition makes the positivization of ethics through legal adjudication dangerous to the substance of code of ethics violations that are problematic, as occurred in the case of Constitutional Court Judge Anwar Usman's code of ethics violation, which was adjudicated by the Jakarta Administrative Court. Through a doctrinal research method with a comparative approach, this paper aims to describe the position of ethical court decisions as objects of dispute in the Administrative Court. Based on the analysis conducted in this paper, ethical courts, in principle, have a different approach to handling cases than legal courts, a condition that creates a distortion in the decisions rendered.

Abstract

This study departs from the paradox of the failure to achieve world peace despite the existence of an established international legal regime. It addresses three main objectives: (1) identifying the key factors that undermine world peace; (2) analyzing the failure factors of international law to realize global peace; and (3) formulating a responsive international legal architecture to future peace agendas. The study employs a critical descriptive method with a socio-legal (non-doctrinal) approach, drawing on the analytical frameworks of neorealism, great powers oligarchy, and Third World Approaches to International Law (TWAIL). The qualitative analysis is conducted by examining power relations, the distribution of natural resources, and the configuration of global military capabilities. The findings reveal that the anarchic structure of the international system constitutes the primary driver of global conflicts as reflected in World War I and II. Furthermore, the dominance of the Permanent Five (P-5) has produced a great powers oligarchy that distorts the principles of international law and obstructs world peace. This study argues that reforming the distribution of military capabilities and access to natural resources is a crucial prerequisite for non-P-5 states to reconstruct international law. Accordingly, a redesign of the architecture of international law is needed to make it more just, inclusive, and balanced global distribution of power orientation as a foundation for sustainable world peace.
