Jurnal Hukum & Pembangunan (JHP) is one of the oldest published law journals in Indonesia. Published in 1971 by the Faculty of Law, Universitas Indonesia originally titled "Hukum & Pembangunan". JHP adopts a double-blind peer review policy, and focused on various subdisciplines of the legal science, among others: Basic principle of jurisprudence Private law Criminal law Procedural law Economic and business law Constiutional law Administrative law International law Law and society In addition to these fields, JHP also accepts texts covering topics between law and other scientific fields such as legal sociology, legal anthropology, law and economics, and others. Published 4 (four) times a year in March, June, September and December. Each issue contains 15 articles, both conceptual articles and research articles. JHP is published in Indonesian, but an English text is also accepted.

Abstract

Setiap Warga Negara Indonesia memiliki hak konstitusional sebagaimana amanat konstitusi. Hak Konstitusional menurut Pasal 51 ayat (1) jo penjelasan Pasal 51 ayat (1) UU No.24/2003 diubah dalam menjadi Undang-undang Nomor 7 Tahun 2020 UU No.7/2020, hak konstitusional adalah “hak-hak yang diatur dalam Undang-undang Dasar Negara Republik Indonesia Tahun 1945”. Membahas hak konstituional ini dimiliki oleh semua Warga Negara Indonesia baik itu yang berada dalam wilayah teritorial Indonesia maupun yang berada di luar wilayah teritorial Indonesia, dalam hal ini adalah Pekerja Migran Indonesia (PMI) yang bekerja menjadi Anak Kapal Perikanan (AKP) migran. Tahun 2024 menjadi tahun untuk peralihan kepemimpinan pemerintahan, utamanya peralihan kekuasaan presiden dan wakil presiden, maka dari itu setiap warga negara memiliki hak untuk memilih presiden dan wakil presiden, tidak terkecuali AKP migran. Berdasarkan data dari hasil pemantauan Migrant Care dengan organisasi PMI di luar negeri, terdapat indikasi-indikasi permasalahan dalam penyelenggaraan pemilihan umum 2024 bagi PMI disejumlah penempatan, antara lain Hong Kong, Taiwan, Singapura dan Malaysia. PMI yang bekerja di daratan saja dalam pemenuhan hak untuk ikut serta pemilihan umum saja terdapat sejumlah permasalahan, lantas PMI yang bekerja AKP migran juga perlu dikaji terkait pemenuhan hak untuk ikut serta pemilihan umum 2024. Metode penelitian yang digunakan adalah metode penelitian kualitatif, dengan jenis penelitian yuridis normatif. Penelitian ini menggunakan analisis secara kualitatif yang dimana setelah memperoleh data kemudian dianalisis untuk menemukan titik terang dari masalah yang diteliti. Penarikan kesimpulan dari penelitian ini adalah menggunakan metode deduktif. Hasil belum ada standar perjanjian kerja yang mengatur mengenai pemenuhan hak politik AKP migran untuk ikut serta pemilihan umum, kendala pemenuhan hak AKP migran tempat kerja yang sulit dijangkau oleh perwakilan Indonesia atau tempat kerja AKP migran yang tidak tetap dan tidak ada data pasti dari KPU mengenai data jenis pekerjaan dari daftar pemilih pada pemilihan umum 2024, sehingga sulit dideteksi apakah AKP migran terdaftar atau tidak sebagai bagian dari daftar pemilih pada pemilihan umum 2024.

Abstract

The settler communities on the water are like the Bajo tribe, they have had a tradition of living on the water and in coastal areas for generations even before Indonesia became independent. The settler communities on the water have faced various problems such as legal certainty for settlements, threats of eviction, difficulty in accessing clean water and acts of discrimination. In this research, there are 2 (two) things to be studied, firstly what is the position of the settler community on the water in terms of the principle of common property resources in marine management and secondly what is the state's responsibility in protecting the existence of the Bajo Tribe Community in Samabahari Village, Wakatobi Regency. Using sociological juridical methods, the author concludes: Firstly, the principle of common property resources in marine space management does not mean prohibiting settler communities on the water from carrying out life on the waters/coasts. These principles must be defined contextually and take into account the socio-cultural conditions of society. Second, the state has the responsibility to provide protection for the settler community on water through legal certainty of land rights, ease of use of marine space and guaranteed provision of clean water. Abstract

The comparative analysis of the structural and characteristic aspects of State-Owned Enterprises (BUMN) in Indonesia and Malaysia highlights differences in their approaches to managing these state-owned companies. In Indonesia, BUMN are regulated by Law No. 19 of 2003, which divides BUMN into Persero and Perum. However, bureaucratic structures with strict hierarchies and political intervention often hinder market efficiency and responsiveness. Meanwhile, Government-Linked Companies (GLCs) in Malaysia, under the supervision of Khazanah Nasional Berhad, demonstrate a more streamlined and flexible structure. They operate with higher autonomy and tight supervision, enabling quicker responses to market changes. In terms of governance, Indonesia applies the principles of good corporate governance, but political intervention remains a significant challenge. On the other hand, GLCs in Malaysia emphasize transparency and accountability, supported by the Government-Linked Company Transformation Program (GLCT) aimed at enhancing performance and competitiveness. These differences result in contrasting performances; BUMN in Indonesia are often hampered by bureaucracy and political intervention, while GLCs in Malaysia are more efficient and competitive due to their centralized structure and strict supervision. Recommendations to enhance BUMN performance include adopting a centralized management model in Indonesia and promoting innovation and adaptation in Malaysia.

Abstract

Natural resources is one of the essential aspects of life and human existence. Indonesia is known as a country with abundant natural resources. Therefore, their management must be conducted transparently to prevent corruption and ensure that natural resources are managed in the most efficient and beneficial way fore the community. If natural resources controlled by the state are not managed based on principles reflecting justice, there is a potential that the benefits will only be enjoyed by a small group of people. The mechanism of granting Special Mining Business Permits (WIUPK) through auction is one way to embody the principles of transparency, prevent corruption, and ensure that natural resources are managed in the most efficient and fair manner. However, recently, president jokowi’s government issued Government Regulation No. 25 of 2024, amending Government Regulation No. 96 of 2021 on the implementation of Mineral and Coal Mining Business Activities, which grants special treatment to business entities owned by religious community organizations to obtain WIUPK trough a priority offer mechanism without an auction process. This study uses a normative juridicial method with a legislative approach. The results of the study show that there is a conflict of norms in granting WIUPK to business entities owned by religious community organizations without an auction mechanism, as well as several issues arising from the enforcement of these norms.

Abstract

The mediation techniques commonly used by mediators are facilitative, evaluative, or hybrid models. The choice of mediation model generally depends on the complexity of the dispute, the nature of the relationship, and the expectations for further cooperation. This research examines the application and disclosure of mediation models in the banking sector. The methodology used is normative, analyzing regulations related to the application and disclosure of mediation models in the banking sector. Data collection was obtained from primary legal materials in the form of legislation, secondary legal materials such as professional codes of ethics, books, articles, and scientific journals, and tertiary legal materials such as dictionaries and encyclopedias. The researcher also used questionnaires and interview techniques to obtain data on the application of mediation models in the banking sector. The research results indicate that, from a conceptual aspect, the disclosure of mediation models to disputing parties by the mediator constitutes the implementation of the principle of informed consent. From a practical aspect, the disclosure of mediation models is important for disputing parties in the banking sector as it can help them prepare strategies to be taken, assess the suitability with their needs and objectives, manage expectations about what can be achieved, and choose the appropriate mediator. Based on banking mediation regulations and standards, the mediation model that should be applied is facilitative. However, in practice, banking mediators use a combination of facilitative and evaluative models. The recommendations include the obligation to disclose the mediation model used, which can be incorporated into legislation and/or mediator codes of ethics.

Abstract

Since its establishment under Law Number 2 of 2009 concerning The Indonesian Export Financing Institution (LPEI), the Indonesian Export Financing Institution has gained additional capital participation nine times between 2010 and 2021 by the passage of government regulations. The rules for extra capital in the legislation on its establishment only take the form of regulations in the event that the capital of the Indonesian Export Financing Institution is decreased by a particular amount, but the additional capital that has been carried out thus far is not meant to replace the capital deficiency. As a result, this research was undertaken to investigate the legal ratio of extra state capital to the Indonesian Export Financing Institution. Therefore, the purpose of this study was to investigate the legal ratio between the Indonesian Export Financing Institution and additional state capital. By examining secondary data in the form of statutory regulations and relevant literature, this study applies normative juridical methods. The study's findings present the legal ratio and the position of the Indonesian Export Financing Institution. The State Finance Law and State Treasury Law's authority can be used to track the government's addition of state capital participation to the Indonesian Export Financing Institution.

Abstract

Medical disputes in the civil field are disputes that can occur between patients and doctor as a medical-professionals and are related to the full fillment of the rights and obligations of the binding relationship as a legal result in the provision of medical services. Medical disputes can lead to losses suffered by patients which can be in the form of limb disability, even death. The emergence of law and health provides a beneficial collaboration, where the health field can be used to face public health challenges and the law can be used to maintain peace and order in society. The regulation of health law in Indonesia contained in Law No. 36 of 2009 which has now been amended by Law No. 17 of 2023 provides differences in efforts to resolve medical disputes which are important to examine and are the focus of this research. The author's research was conducted using a juridical-normative legal methodology with a conceptual approach and a statutory approach. The civil aspect in the settlement of medical disputes is that there are losses suffered by patients due to negligence committed by medical personnel. Patients have the right to claim compensation which can be done by litigation or non-litigation. The parties involved in medical dispute resolution want a dispute resolution that is closed and provides a sense of security, especially on the part of medical personnel so that their reputation is not tainted, so they prefer to conduct non-litigation dispute resolution. Law No. 17 of 2023 provides several options for dispute resolution using Alternative Dispute Resolution which in Law No. 36 of 2009 medical dispute resolution can only be done by mediation.

Abstract

State-owned enterprises (BUMN) are legal entities which the government has more than 51% ownership. The purpose of BUMN being established is to carry out national development by seeking profits that can become income for the government as well as carrying out public activities through carrying out public services such as providing telecommunications, electricity, water, and construction of public facilities which cannot be fully fulfilled by the government. Therefore, the government hands over the completion of public services to BUMN to carry them out because of their expertise in their respective fields. In every business process carried out by a legal entity, regardless of its ownership status by the state, there are tax aspects that must be fulfilled. In explanation from the government, there are several BUMN that have defense in the field of taxation. Some of them are regarding tax input on costs incurred in connection with the implementation of state duties, income received from the state and differences in value due to mergers mandated by the state. Therefore, research was carried out on how BUMN defended themselves in the dispute and what the judge's opinion was regarding the dispute that occurred.

Abstract

The existence of the Constitutional Court as stated in the provisions of Article 24C of the 1945 Constitution has established the dignity of the Constitutional Court's position as a Guardian of the Constitution which is understood as a judicial institution that protects the constitutional rights of Indonesia citizens. This research is aimed at solving the problem of the constitutional rights of Indonesia citizens who are often injured through legal products in the form of laws. Therefore, this study focuses on studying, analyzing and comparing how the context of judicial preview or can be understood as a test of a draft law both formally and materially as a form of preventive protection of citizen’s constitutional rights. The writing of this journal is a normative juridical research based on a literature study by examining and understanding the basic mechanism regarding the provisions for testing laws in positive law in Indonesia accompanied by the act of analyzing the process of implementing judicial preview (testing of draft laws) carried out by the Chilli Constitutional Court. The final result of writing this journal is in the form of a prospective study of the expansion of the authority of the Constitutional Court of Indonesia in conducting a judicial preview (testing of draft laws) which can later be expected to be adopted in positive legal provisions.

Abstract

This article discusses the use of social media among arbitration actors. Social media have evolved since its inception. In the beginning, social networks were used to stay in touch with friends and family. Now the trend is to follow influencers. The boundaries between personal and professional use have become blurry. Social media are more regulated and supervised now, especially due to privacy and national security concerns. The social media adoption landscape has matured with increasing adoption by all generations. The use of social media can give rise to questions about ethical conduct or even the integrity of the arbitration proceedings. An arbitrator’s old post established evidence of bias; deleting old posts is tampering evidence; failing to use online resources such as social media can constitute professional incompetence or ineffective counsel. Regardless, social media also offers opportunities such as spreading awareness, networking, marketing, and improving the legitimacy of arbitration. The article describes the current state of the guidelines on social media use in arbitration and suggests its best practice.
