Jurnal Hukum & Pembangunan (JHP) is one of the oldest published law journals in Indonesia. Published in 1971 by the Faculty of Law, Universitas Indonesia originally titled "Hukum & Pembangunan". JHP adopts a double-blind peer review policy, and focused on various subdisciplines of the legal science, among others: Basic principle of jurisprudence Private law Criminal law Procedural law Economic and business law Constiutional law Administrative law International law Law and society In addition to these fields, JHP also accepts texts covering topics between law and other scientific fields such as legal sociology, legal anthropology, law and economics, and others. Published 4 (four) times a year in March, June, September and December. Each issue contains 15 articles, both conceptual articles and research articles. JHP is published in Indonesian, but an English text is also accepted.

Abstract

This project is a legal hermeneutics. The aim is to elaborate the paradigm of the law as integrity theory, Ronald Dworkin’s work, which has received recognition as one of the most influential philosophical systems in the world of law throughout the last century. The issues discussed are divided into three subjects: (1) the interpretation role in legitimizing “law” as a corpus that has a “soul”; (2) a concept of interpretation from the womb of the law as integrity theory; (3) the dual capacity of “constructive interpretation” in [a] “returning” law to its roots; and [b] housing “morals” within the body of positive law. The result: a kind of final picture for us: (1) The legal text (is a narrative that is) “living”. It is not just bones, flesh, and blood. This is the only component that is never finished in a text. It is always in statu interpretandi—like “a fruit that is never fully ripe.” The reason is its virtus flexibilitatis, which is unmatched by other components—its ability to evolve infinitely, to reincarnate, to adapt in mutatio temporum. At the heart of this pars invisibilis, resides the “soul” that has made every text of legal rules alive, functional, and truly working in its society; (2) Dworkin believes that the soul of every text can only be captured by using constructive interpretation—an interpretive technique that makes the theory of the law as integrity a “great teacher” for it. This theory indoctrinates every judge: the furthest goal of every interpretation is to find the “most sublime point of intersection” between the “three teleological factions”: [a] mens legislatoris; [b] contentio logica and [c] contentio moralis. There, resides the soul of every legal text; (3) This intersection actively drives the internalization and integration of moral values into the legal framework.

Abstract

Abstract Priority offering of Special Mining Business License Areas (WIUPK) to business entities owned by religious community organizations without going through an auction process has caused legal polemics in Indonesia, especially after the enactment of Government Regulation (PP) Number 25 of 2024 concerning Amendments to Government Regulation Number 96 of 2024 2021 concerning Implementation of Mineral and Coal Mining Business Activities. This research aims to examine whether the policy is in accordance with applicable laws and regulations, especially in the context of implementing mineral and coal mining business activities. Apart from that, this research will also analyze the legal consequences that could arise if disharmony occurs in the regulations related to Special Mining Permit Areas (WIUPK), especially related to potential conflicts between applicable laws and regulations. One potential disharmony is related to the law. No. 3 of 2020 concerning Amendments to UU. No. 4 of 2009 concerning Mineral and Coal Mining. Abstract

This article explores the shifting landscape of international arbitration, traditionally valued for its efficiency. Today, increased costs and prolonged dispute resolution processes change this perception. The article introduces the Calderbank offer, a strategic instrument from common law that promotes early settlement. By integrating civil law’s adversarial approach and practice to settle with settlement offer in common law, this concept aligns with peace theory and could enhance efficiency in BANI Arbitration Center. This instrument allows arbitral tribunals to impose cost penalties on parties who reject settlement offers and subsequently fail to achieve a more favorable award. In this research, the authors employ a normative juridical research method, utilizing literature review as the primary approach. This research indicates that adopting the Calderbank offer may encourage parties to objectively consider the settlement offer, potentially leading to a win-win solution. BANI Arbitration Center may adopt this instrument, as BANI Rules has included provisions on tribunal discretion in cost allocation.

Abstract

As one of the institutions that carries out quasi-judicial functions in the field of general elections, Bawaslu could issue a decision through an adjudication process. In 2017, Bawaslu was criticized for its several decisions in the Sipol case held by the KPU for the registration of participants in the 2019 general elections, mainly because it was considered that Bawaslu equated its position with the Supreme Court by assessing that Sipol in the KPU Regulation was not in line with the Election Law. In 2024, decisions on election administrative violations appear to be softer or seem to avoid the same potential criticism. This study aims to analyze two issues systematically, first, what is the position of Bawaslu in the Indonesian constitutional system, especially in its function as a quasi-judicial institution and its relation with the judicial power holder, and second, whether the Bawaslu decision model as regulated by the Election Law can exceed its authority and equal its position with the Supreme Court in terms of judicial review. Regarding the first issue, Bawaslu as a quasi-judicial institution has a constitutional basis with its status as a state auxiliary organ that is currently prevalent in Indonesia. Regarding the second issue, the constitutional design does not allow Bawaslu to exceed its authority by issuing decisions as the Supreme Court does in terms of judicial review. Abstract

Pembatasan akses aborsi di Indonesia menyebabkan banyak perempuan dengan kehamilan tidak diinginkan terpaksa berhadapan dengan hukum. Pembatasan aborsi yang mengakibatkan kriminalisasi ini dapat menyebabkan dilema moral bagi banyak perempuan yang mengalami kehamilan tidak diinginkan. Padahal aborsi berpotensi terjadi pada setiap perempuan berusia produktif di Indonesia. Aborsi di Indonesia merupakan tindakan ilegal dan aborsi hanya dapat dilakukan dalam dua kondisi saja, yakni kedaruratan medis dan kehamilan yang disebabkan perkosaan. Artikel ini menganalisa bagaimana sebenarnya substansi aborsi dapat dimasukkan pada kategori hak kesehatan reproduksi perempuan dan mengapa negara Indonesia perlu mengubah kebijakan dan hukum mengenai aborsi. Untuk melihat seberapa pentingnya negara harus melakukan rekonstruksi terhadap aturan ini, penulis menggunakan metode perbandingan hukum. Perkembangan Kebijakan dan hukum negara Perancis akan menjadi lesson learned bagi Indonesia. Hasil penelitian menunjukkan, dekriminalisasi aborsi dapat menjadi jalan keluar terbaik yang dapat diberikan untuk membebaskan perempuan untuk menentukan kehamilanya. Instrumen hukum internasional, seperti CEDAW, menyatakan bahwa pelarangan atau pembatasan akses layanan kesehatan (termasuk layanan untuk aborsi) di saat layanan tersebut sangat dibutuhkan, dapat menjadi bukti adanya diskriminasi bagi perempuan, karena kenyataannya, baik melanjutkan atau menyudahi suatu kehamilan tidak diinginkan, perempuan akan tetap berada pada pihak yang paling terpengaruh dari keputusan tersebut. Kajian dari perspekstif pro-choice dalam jurnal ilmiah, apalagi dalam konteks ke-Indonesia-an masih sangat sedikit ditemui. Sehingga dengan adanya penelitian ini diharapkan dapat memberikan perspektif baru bagi pihak-pihak terkait dalam memandang persoalan aborsi.

Abstract

The environment as a place for humans to live certainly needs to be preserved and protected for its existence. In the context of statehood, the Indonesian Constitution guarantees the constitutional right of citizens to a clean environment. Thus, regulations as the face of the Indonesian constitution must not contradict the constitution. Juridically, Indonesia regulates life protection in Law Number 32 of 2009 concerning the Protection of Environmental Management. However, in its implementation, there are many violations of environmental management which in fact are carried out by corporations to obtain economic benefits. This study aims to analyze the corporate criminal responsibility system as an actor of crime in the environmental sector, and try to formulate criminal norms for corporations that can meet the principles of justice for the community. By using the normatic method with a Critical Legal Studies approach, conceptual, and legislation will produce new norms related to an equitable corporate accountability system.

Abstract

Metode original intent lazimnya menghasilkan penafsiran yang bersifat rigid sesuai niat perumusnya. Selama konstitusi tidak diubah, maka tafsiran original intent pun tidak berubah. Namun penggunaan metode penafsiran original intent di Indonesia dapat menghasilkan pemaknaan yang berbeda/berubah meskipun ketentuan konstitusi dan perumusnya tidak berganti. Hal ini terjadi karena terdapat perkembangan pemikiran dalam penerapan metode penafsiran original intent. Penelitian ini membahas mengenai perkembangan pemikiran tersebut dan menganalisa pola penerapan metode original intent dalam penafsiran konstitusi yang dilakukan oleh Mahkamah Konstitusi di Indonesia. Ini merupakan penelitian doktriner dengan pendekatan konsep dan kasus. Hasil penelitian menunjukkan bahwa terdapat perkembangan pemikiran dalam penerapan metode penafsiran original intent dari yang berorientasi rigid hingga ke moderat. Mahkamah cenderung menerapkan penafsiran original intent pada: (1) mekanisme pengisian lembaga/pejabat negara; (2) kewenangan lembaga negara; dan (3) hak asasi manusia. Pola penerapan dapat dilihat dari perspektif cara penggunaan sumber yang berbeda dan tujuan penggunaan metode ini untuk mengungkap baik makna ‘tersurat’ maupun ‘tersirat’.

Abstract

The limited number of Sharia-compliant venture capital companies results in restricted access for Micro, Small, and Medium Enterprises (Usaha Mikro, Keci, dan Menengahl/UMKM) to alternative funding sources. This limitation may also stem from a lack of literacy regarding Islamic economics and finance among venture capital business players and the broader business community. Therefore, it is necessary to examine the implementation of Sharia Principles within the framework of Venture Capital Corporations (VCC) and Venture Debt Corporations (VDC), as well as the expected role of VCC and VDC in the development of UMK in Indonesia. The findings indicate that both VCC and VDC have applied Sharia principles through agreements that align with their respective characteristics. In addition to providing capital, VCC and VDC are also expected to play a role in offering management support and strategic guidance to UMKM.

Abstract

The phenomenon of single candidates in regional elections in Indonesia has created a dilemma in applying democratic principles, especially regarding ballot design that often confuses voters. The Constitutional Court’s Decision Number 100/PUU-XIII/2015 mandated a plebiscite design with “agree” or “disagree” options for single candidates. However, in practice, this design has been distorted with the presence of a blank box without adequate explanation. This study aims to evaluate the extent to which the discrepancy between the Constitutional Court's decision and actual ballot design practices affects voter understanding and the quality of democracy. This study employs a normative juridical method with a qualitative-descriptive approach, relying on literature reviews and secondary data analysis from legal documents and news reports. The theoretical framework uses the "ambiguity effect" and "picture superiority effect," explaining how visual ballot design can influence voter preferences cognitively. The study analyzes variables of compliance with the Constitutional Court's decision and voter understanding as parameters. Data collection procedures are conducted through a literature review. The results indicate that the inconsistency of ballot design with the Court’s decision leads to voter confusion, where the ambiguity of the blank box often directs voters toward choices that may not reflect their true preferences. This highlights the need for policy revisions to better align with democratic principles and support voter decision-making quality in regional elections in Indonesia. Abstract

Judges, as the main judicial actors in law enforcement, have an independent nature, both in terms of institutions and in terms of determining their decisions. However, in exercising their authority, judges are often faced with the risk of injury, both physical and psychological, by the public, who are not satisfied with the decisions made by the judges. With an empirical legal research method and using a conceptual approach, statute approach, and comparative approach, this study aims to find the best form in the design of an institutional model for judge and court security units. In this study, it was found that the judge and court security system has been normatively accommodated in several laws and regulations. However, in terms of implementation, there are still many obstacles, one of which is related to security human resources. So, an institutional design is needed for the security of judges and the courts. Several considerations in the formation of the institutional design of the judge's security unit are in terms of the constitutional importance of an institution and also the effectiveness of the institution. So, three institutional design models are offered. First, the idea of forming a new institution that has special authority in the security of judges and courts. The second institutional design is to cooperate between institutions in maintaining the security of judges and courts. The third design is to strengthen the authority of existing institutions. In addition, the security system of judges and the judiciary also requires guarantees, especially in terms of Human Resources, infrastructure, and budget.
