Al-Qadlaya : Jurnal Hukum Keluarga Islam, diterbitkan oleh Lembaga Penelitian, Pengembangan dan Pengabdian Kepada Masyarakat (LP3M) Program Studi Hukum Keluarga Islam, Sekolah Tinggi Ilmu Syariah Miftahul Ulum Lumajang sejak tahun 2021. Artikel disni mencakup studi tekstual dan studi lapangan dengan berbagai perspektif Islam. Hukum Keluarga, Wacana Islam dan Gender, dan Penyusunan Hukum Perdata Islam. Pada awalnya jurnal hanya berfungsi sebagai wadah ilmiah bagi dosen, profesor, dan mahasiswa Sekolah Tinggi Ilmu Syariah Miftahul Ulum Lumajang. Namun, karena perkembangan selanjutnya, jurnal tersebut berinisiatif mengundang para sarjana dan peneliti di luar Institut untuk berkontribusi. Hingga saat ini, dengan prosedur double peer-review yang adil, Al-Qadlaya terus mempublikasikan penelitian dan kajian terkait Hukum Keluarga Islam, Wacana Gender, dan Legal Drafting KUHPerdata Islam dengan berbagai dimensi dan pendekatan. Al-Qadlaya, terbit dua kali setahun, selalu menempatkan Hukum Keluarga Islam, Wacana Gender, dan Hukum Perdata Islam dalam fokus utama penyelidikan akademis dan mengajak setiap pengamatan komprehensif Hukum Keluarga Islam sebagai Islam normatif dan sistem masyarakat Muslim sebagai mereka yang menjalankan agama dengan banyak segi.

Abstract

Marriage certificate is the determination of a marriage. Juridically, isbat marriage is regulated in laws and regulations such as Law Number 1 of 1974 concerning Marriage, Law Number 7 of 1989 concerning Religious Courts, and Law Number 3 of 2006 and Law Number 50 of 2009 concerning Changes to the Law on Religious Courts. The regulation confirms that marriage certificates are permitted in marriages prior to Law Number 1 of 1974. In practice, marriage certificates submitted to the Religious Courts are carried out after the enactment of Law Number 1 of 1974. The application for marriage certificates is granted by the Religious Court in marriages held after the 1974 Marriage Law was based on the Compilation of Islamic Law (KHI), even though the legal position of KHI was not included in the statutory order. The essence of isbat marriage is stipulation. This means that the marriage that is isbat is still valid because the marriage that is isbat is administrative. The position of the marriage certificate is part of legal protection and legal certainty. The position of the KHI, which regulates in more detail regarding marriage certificates, has a regulatory function in the midst of a void in the material law of the religious courts. In addition, judges can determine whether an application for marriage registration is granted or rejected. Thus, it can be concluded that the essence of marriage confirmation is part of legal discretion.

Abstract

This study aims to reveal how the judge's considerations in rejecting the marriage dispensation, and how the judge's decision in rejecting the marriage dispensation from the perspective of John Rawls' theory of justice. This research is an empirical legal research using a qualitative descriptive approach. Data collection techniques are interviews and documentation. Data analysis techniques are carried out by codifying data, presenting data, drawing conclusions. The analysis in this study uses John Rawls' theory of justice. The results of this study indicate that: First, the judge's consideration is the condition of the prospective bride and groom including age, economics and knowledge, readiness of both parents, the arguments for the application and statutory regulations. Second, the judge's consideration in the two determinations lies in the readiness of the prospective bride and groom in terms of age, occupation and knowledge. Third, in the perspective of John Rawls' Justice theory: First, based on the concept of original position and the veil of ignorance, the applicant as a citizen agrees that the religious court with all its regulations is an institution established to protect and provide the rights of every citizen. Second, based on the principle of freedom of basic rights, the judge's decision has two sides, on the one hand the decision has granted the applicant's rights, and on the other hand it has also prevented the applicant's rights. In the principle of difference, the difference in the results of the determination given by the judge will still provide advantages and benefits to the applicant.

Abstract

This study aims to find out what is the legal consideration of the Panel of Judges in the case of validating the origins of children from illegal polyandry marriages, in which it is decided that the child is assigned to his biological father. This study uses a type of normative legal research which is analyzed qualitatively with the case approach research method, conceptual approach and comparative approach. The sources and types of materials in this study are primary legal materials, namely the judge's determination No. 321/Pdt.G/2022/PA. Bkt. Secondary legal materials include legal science books, legal journals, legal reports and print and electronic media. The results of the research show that the judge granted the request for legalization of the origin of children from wild polyandry marriages assigned to their biological father based on their considerations on legal facts at trial and the views of the clergy as a symbol of living values ​​in society as stated in Article 5 paragraph (1) of the Law Number 48 of 2009 concerning Judicial Power, in addition to that the judges have also carried out studies of various viewpoints from philosophical, juridical to sociological, very appropriate in the context of achieving maqâshid al-syarî'ah in terms of offspring maintenance (hifzh al-nasl) and concerning children's rights and protection of children besides that according to social law children are also entitled to get guardianship rights, affection, maintenance and inheritance rights from their father.

Abstract

Legal principles are the main source of laws in the implementation of penal code (criminal law) and other legislation. However, there is a source of living law and a growing development in the life of a tribal law society. Living citizens' laws can also be viewed asa legal source with certain restrictions, as set forth in the 1951 emergency act no. 1 The study aims to analyze how the legal relevance of the legal laws to the enforcing of legal sanctions on the society of tribal law. In the study, the author used the normatif juridical approach with data collection techniques through library studies. Research indicates that the establishment of a legal principle asa source of law in the establishment of criminal sanctions is not the only principle that can be taken asa basis for penalties. However, aside from legality there is also a common principle that lives and flourishes in society, that is, the laws of custom.

Abstract

The role of the advokat in assisting clients in divorce cases still raises many pros and cons in society. This causes the good name of the profession to be tarnished, therefore with the existence of an advokat law and an advokat code of ethics, the profession can maintain the good name of the profession. The existence of these arguments led to a loss of enthusiasm from legal scholars to become advokats. This research examines how positive legal views are on the role of advokats in assisting clients in divorce cases which still cause many incompatibilities with existing legal rules. This research is a qualitative research using a normative approach. The results of this research indicate that an advokat in assisting his client must comply with the advokat law and the advokat's code of ethics and if the advokat violates the legal umbrella, legal action will still apply. In the view of positive law, namely referring to written law according to the provisions of the law.

Abstract

Tradition is a form of traditional ceremony carried out by the community and has become a culture that is difficult to eliminate, especially for Javanese people, as well as preserving the heritage of ancestors collectively. In the form of traditional events including the Tingkeban ritual, which is a ritual held in the seventh month of pregnancy. Tingkeban rituals that occur in each region and group can be different, this is because the intensity of external cultural influences between one region and another is different. The implementation of tingkeban rituals in an area or community group, some are based on Islamic teaching values but the custom of holding tingkeban rituals is not based on the provisions of Islamic teachings, although in Islam there is no prohibition against the tradition. Therefore, the focus of writing this article is how the process and meaning of the community about the tradition of tingkeban and how the tradition of tingkeban in society perspective maqashid al-shari'ah. The discussion of this article concludes that the community's view of the implementation of the tingkeban ritual tradition can be carried out, which is important that the community does not believe in the symbols related to the tingkeban. Tingkeban is also a manifestation of gratitude to Allah SWT so that with this tingkeban the community does one of the manifestations of gratitude and gives alms to people. The tradition of tingkeban in maqashid al-shari'ah, namely in maqashid tahsiniyyat, while what is meant by maqashid tahsiniyyat is to take a proper benefit from things that are virtues or are virtues according to custom, by avoiding circumstances that are desecrating and that are disliked by common sense. The implementation of maqashid al-shari'ah which is tahsiniyyah is intended so that humans can do something best for the improvement of the maintenance of the five principles that must be maintained, namely; religion, soul, reason, heredity, and possessions.

Abstract

This research aims to analyze the concept of inheritance division based on the bilateral system found in customary law and the opinions of contemporary ulama'. This research method uses a normative juridical approach. Most of the primary data is collected from library materials which contain the latest and most up-to-date scientific knowledge or new understandings about known facts, as well as ideas (ideas) so studies include the Al-Qur'an, Contemporary Ulama's Opinions, and Journals that discuss regarding inheritance based on the bilateral system. The stages of data analysis are Editing, Classifying, Verifying, Analyzing, and Concluding. So that the research data can be accounted for as scientific research, the types of validity of the data in the research include credibility and dependability tests. The results of the research can be concluded that the distribution of inheritance based on a bilateral system is an inheritance system that places more emphasis on equal distribution of inheritance between men and women, also In the distribution of bilateral inheritance, the concept of 1:1 is prioritized, which in its distribution can eliminate injustice compared to the 2:1 concept. The opinion of Contemporary Ulama', as long as the heirs agree, considering that in this modern era there is a change in the position of women, then the concept of 1:1 (bilateral) which is fairer to use can be justified because many women in this modern era have a role like a men became the backbone of the family, in contrast to women in classical times.
