Abstract

This issue comes from the Syariah Cooperation, which relies on the various legislation rule. It is only in the level of the Minister Regulation and Policy, that raises uncertainty in law practice that influences the empowering syariah cooperation departments. Therefore, the constructing of Syariah Cooperation Laws is important for planning National Cooperation Law. Actually, constructing Syariah Cooperation Law can be conducted using some approaches, such as: formal and materialistic islamic approach. It means that Islamic law can be National Law Regulation materially and formally. Second, law material approach. In taqnin process, Islamic law can be implemented as the sources of the material of law, that the principals are appropriate with the product of regulation and lgislation. Third, persuasive and authority source approach. Formally and materially, Islamic law is transformed through persuasive and authority source. Those three approaches must be used integrally and become a system in the planning of National cooperation law, in order to realize legal and prosperous society.

Abstract

The performance of Bank Muamalat Indonesia (BMI) in 2011 increases its value continually for the stakeholders and contributes in national syariah banking development. Therefore, it is very important to analyze the financial performance in order to get the real description of the company. General financial analysis can be conducted by analyzing the financial ratio and Economic Value Added (EVA) approach. The result of the research shows that the best performance of BMI was in 2010 based on CAR and NPM values. According to ROA, ROE, and BOPO indicators, the best performance was in 2011. The EVA analysis shows that EVA value in the period of 2009-2011 was less than zero, which means that the best performance was not in the year. After getting the result of the financial ratio and EVA analysis, there is comparison between the interpretations of those financial performance results. The result of the comparison is significant. By using financial ratio approach, it shows that the bank has good remunerativeness. However, based on EVA analysis, the EVA value is less than zero, which means that BMI performance is not good. It can be concluded that the good performance based on financial ratio may become not good performance if we analyze it using EVA analysis.

Abstract

This research examines the effect of budget participation on managerial performance by using regression analysis. The research also reviews contingency theory to view the fit between budget participation, leaderhip style of Islamic and managerial performance using residual approach. The application of residual analysis is used to examine the interaction of fit between budget participation and Islamic leadership style an its impact on managerial performance. The application of this approach is expected to encourage the potency of “fit: and informative omdel forming in the contingency theory of management accounting in the future.Based on respon 38 manager of BMT in Pekalongan, the results of research shows that budgetary participation has no direct effect on managerial performance. As well as the leadership style of Islamic (sharia-based leader interpersonal skills) does not affect the relationship between budgetary participation and managerial performance.

Abstract

Trade liberalization influences small industries in Indonesia. This happens because of the high overheadcost, minimum technology, limited financial capital, and competitive and efficient marketing network. In order to overcome this problem, there must be tangible steps to reinforce the financial capital and other sectors for the small industries in Indonesia. One of the steps is reinforcing the social capital as the network and marketing reinforcement. Some researches stated that social capital is the efficient and effective means in reinforcing the existence of UMKM in Indonesia to face global trading.

Abstract

There are no discussion about banking usury in classic Fikh books, because there were no banks, which nowadays they are needed by society to save their worth. As the research of classic Fiqh, there are differences in ulamas’ instructions, based on their understanding. However, they agree to state that bank interest is a usury or forbidden in Islam. Qardul Hasan is another term of qard, that is interpreted by the most of Indonesian people as social engagement, or bequest. Financial department must be careful in understanding the instructions, related to the implementation in the real life. Banks and financial departments claim that money saving is as akad wadi’ah yad dhamanah, whereas the meaning of dhomanah is responsibility. Fiqh ulamas decide that actually, wadi’ah is responsible. Yad dhamanah is irresponsible.

Abstract

Marketing has undergone rapid development since the 1990s. Until now, marketing is not only known as a practical element but marketing is also known as one of the disciplines. In other words, marketing has elements of the scientific method that can produce marketing theories. However, marketing does not have a general theory that can explain all aspects related to marketing itself. The fact that marketing continues to play an important role in corporate strategy in several companies indicate that there is an opportunity and take a real approach to build marketing competence as a source of competitive advantage. Business practices and marketing today is experiencing a shift or a transformation from an intellectual level (rational), to the emotional, spiritual, and finally to. On the intellectual level (rational), marketers will address the functional-technical marketing by using a number of marketing variables that exist, such as the marketing mix (marketing mix), market segmentation, targeting, branding, positioning.

Abstract

Anggaran Responsif Gender (ARG) adalah salah satu alat kebijakan publik yang dapat mendorong perubahan sosial secara massif yaitu terwujudnya berkeadilan gender, dan perempuan memiliki potensi untuk mewarnainya, tetapi realitasnya tidak demikian. Tujuan paper ini adalah mengungkapkan fakta tentang nilai-nilai serta faktor-faktor yang menyebabkan partisipasi perempuan dalam perencanaan anggaran responsif gender di Kelurahan Bumirejo yang masih rendah, padahal jumlah perempuannya lebih banyak dibanding laki-laki. Fakta ini menarik dalam prespektif teori budaya hukum dan teori pertukaran sosial. Analisis memperlihatkan bahwa budaya hukum bernuansa negatif, karena ada nilai-nilai budaya serta pertimbangan individu berbasis pada dimensi rasionalisasi untung rugi perempuan itu sendiri. Adanya konflik serta pertarungan ideologi maupun nilai-nilai praxis tertentu yang dikukuhi. Mereka memandang keikutsertaan dalam musrenbang adalah kegiatan yang mubazir (sia-sia), mereka bukan siapa-siapa dan aspirasinya sudah terwakili oleh PKK. Sedangkan faktor-faktor yang mempengaruhi adalah kuatnya budaya patriarkhi dan rasionalitas pertimbangan untung rugi dari aspek finansial (ekonomi). Riset ini bertradisi penelitian kualitatif dengan pendekatan socio legal. Riset ini mengunakan sumber data primer maupun skunder yang diperoleh melalui obvervasi, wawancara mendalam serta studi dokumentasi. Untuk mengecek keabsahan data digunakan triangulasi sumber data dan metode dan analisisnya dengan mengunakan model interaktif.
