Abstract

Authoritarianism stems from an imbalance between text, author, and reader. The relationship between those three elements must occur dialectically-dynamically. Khaled M. Abou El Fadl scrutinized religious fatwas of fatwa institutions in Saudi Arabia that tend to discriminate against women to prove the existence of authoritarianism in Islamic legal thought. Abou El Fadl stressed the importance of referring to authoritative sources as an embodiment of authoritative law. For him, the Qur’an is the main authoritative source that is no doubt. In contrast, the traditions (Hadith) need further proof, considering the codification of the hadith took place two centuries after the death of the Prophet. Abou El Fadl built his concept of authority based on Friedman’s thinking which distinguishes coercive authority from persuasive authority. He also distinguished between holding authority and assuming authority. The difference between the two will lead to different legal consequences. Based on this, Abou El Fadl offered authoritative hermeneutics as a methodological framework.

Abstract

In the last three decades, Islamic economics and finance have experienced significant developments. At the same time, several problems arise, not only technical but also epistemological. On that basis, the author is interested in studying Abbas Mirakhor’s epistemological thought, in the hope of providing answers to these problems while providing direction for the next steps. As a qualitative study, the primary data source of this research is the work of Abbas Mirakhor. This study uses philosophical, sociological and historical approaches in addition to the literature review approach. The results of the study show that in the view of Abbas Mirakhor, the source of the formulation of the Islamic economic concept is the Qur’an, Sunnah, and Islamic jurisprudence. The reading of the Qur’an and Sunnah is done through the perspective of the NIE (New Institutional Economics). Through this approach, where Islam is placed as a rule-based system, the Islamic economic scaffolding formulation consists of rules about property, markets, distribution and redistribution, risk sharing, contracts, and trusts. Adherence to institutional scaffolding correlates with economic growth. This institutional scaffolding is supported by an incentive structure through the concept of barakah.

Abstract

One areas of conflict between international human rights law and traditional Islamic law is the question of religious freedom. The classical Islamic law provision on the capital punishment for riddah (apostasy) is particularly considered as contradictory with international human rights norms. Some contemporary Muslim scholars, however, have proposed a fresh thinking in dealing with this tension. This paper seeks to examine the thinking of Abdullah Saeed as one of leading Muslim scholars in the contemporary debate on this issue. It argues that Abdullah Saeed is one of the modern thinkers positioning Human Rights as global ethics that must be admitted in the modern era. With his contextual methodology, he put forward an argument that Islam should be open to the idea of religious freedom as stipulated in the Universal Declaration of Human Rights and that the right to have religion and belief has become a vertical matter between humans and God.

Abstract

Soedjatmoko was one of the prominent Indonesian intellectuals who offered important ideas concerning humanism, freedom, and human welfare in facing the future of Indonesian society. This research aims to (1) study the humanistic education values in the thoughts of Soedjatmoko and (2) analyze the implication of his humanistic educational thoughts on the development of Islamic higher education. This is a library research using the historical- philosophical approach. The data were collected through the documentation method and then analyzed using the content analysis technique. The result of the research showed that humanistic education values in the thoughts of Soedjatmoko include freedom, religiosity, creativity, independence, and self-actualization. The implication of the humanistic educational thought of Soedjatmoko on the development of Islamic higher education includes the urgency of reorienting Islamic higher education by concerning more with its essence, foundation, vision and mission, orientation, goal, materials, curriculum, method, teachers, students, and evaluation.

Abstract

This study is aimed to understand and analyze the imp lementation of the Islamic law of inheritance in four eth nic groups, namely Lampungnese, Javanese, Padangnese and Sundanese, in Metro City, Lampung. It examined the implementation of the Islamic law of inheritance by these four eth nic groups concerning the understanding of the division of inheritance upon death. This is an empirical study using primary data obtained from interviewing 300 respondents and 30 informants, consisting of 10 judges, 5 heads of villages, 5 kiai/ Islamic leaders, and 10 Islamic/village figures. The secondary dat a were divided into three parts: primary legal materials, sec ondary legal materials, and tertiary legal materials. The data analysis was carried out in stages: collection, inventory, classification, construction, and descriptive analysis based on content analysis. The study found that the majority of people--those who are lacking religious understanding with various bac kgrounds-- carried out inheritance based on customary inheritance law. While those who have better understandings of religion --which is a minority-- carried out inheritance based on The Islamic inheritance law. This study also found that 93% of the people agreed that the Islamic inheritance law should be applied to inheritance law for Indonesian Muslim communities in the form of legislation products.

Abstract

Moh Yasir Alimi’s book, entitled Mediatisasi Agama, Post-Truth dan Ketahanan Nasional: Sosiologi Agama di Era Digital (Mediation of Religion, Post-Truth, and National Resilience: The Sociology of Religion in the Digital Age) contains critical and solutive reasoning regarding the fact that online media today has mastered the wider community, apart from all kinds of contents that mix between truth and hoaxes. This is because online media/social media have become the commander of where the information comes from. The implication is that the issue of religion, as one of the various problems of community life, is very dependent on and highly influenced by existing online/social media.
