Abstract

indak pidana pemerkosaan, serta pembunuhan ialah termasuk kedalam tindak pidana kejahatan pada tubuh dan nyawa, sedangkan tindak pidana pencurian termasuk kedalam tindak pidana kejahatan pada harta benda.Tindak pidana tersebut terjadi di Kabupaten/Kota Rokan Hilir dalam Putusan No.209/Pid.B/2020/PN.Rhl, dengan terdakwa Haris Fadillah Rangkuti bersama dengan saksi (yang dilakukan penuntutan secara terpisah) Handika Yuda Pratama secara bersamaan telah lakukan rangkaian tindak pidana yaitu pemerkosaan, pembunuhan, disertai dengan pencurian. Hakim memutus dengan menggunakan Pasal 340 KUHP Jo. Pasal 55 ayat (1) ke-1 KUHP. Mengenai delik pembunuhan berencana yang diatur dalam Pasal 340 Kitab Undang-Undang Hukum Pidana (KUHP) yang dimana terdapat unsur ‘direncanakan terlebih dahulu’ yang memiliki arti antara timbulnya maksud guna membunuh dengan pelaksanaannya itu masih ada tempo untuk si pembuat dengan tenang memikirkan seperti bagaimana pembunuhan itu akan dijalankan. Abstract

"Pentecost" is a common term originating from the Bible centuries ago and marks a significant religious holiday for Christians, commemorating the day the Holy Spirit was bestowed upon Jesus' disciples in Jerusalem, occurring fifty days since the resurrection of Jesus Christ. While Christians celebrate the resurrection of Jesus Christ with Easter, Pastor J. Sihombing sought to register the term "Pentecost" as a trademark under class 45, a registration unknown to Pastor Ev. Diane Evapora Siburian and Pastor K. Siburian, leaders of the Pentecostal Church. The court decision resulted in the trademark "Pentecost" being revoked. This article discusses the legal aspects of registering "Pentecost" as a trademark. The research conducted is normative, descriptive, utilizing secondary data processed qualitatively to draw deductive conclusions. The conclusion drawn is that "Pentecost" cannot be registered as a trademark. It does not denote a product or service but rather references a Christian religious day and is part of a movement/branch within Christianity.

Abstract

There was a jump in the budget allocation sourced from the 2021 Bekasi City APBD based on the 2021 Fiscal Year LKPD issued by the Bekasi City Regional Financial and Asset Management Agency. Encouraging this research to answer problems regarding the authority of the Bekasi City and the responsibilities of the Bekasi City in regional financial accountability for 2020-2021. This research uses a normative method, this method aims to describe the research object, then secondary data is processed qualitatively and conclusions are drawn deductively. Based on this problem, the BPK issued the BPK's LHP, the BPK issued an opinion, namely that originally Reasonable Without Exceptions transitioned to Reasonable With Exceptions. The Corruption Eradication Committee discovered gratification in cases of corruption in goods and services as well as auctions for positions carried out by the Mayor of Bekasi.

Abstract

Based on the MOT Regulation No. 40 of 2022 on Export-Prohibited Goods and Import- Prohibited Goods, used clothing is one of the goods that are prohibited from being imported. In fact, there are still many imports of used clothing being carried out, evidenced by the existence of a second-hand clothing market in Senen Market. This means that the import of used clothing is still being carried out. The formulation of the problem is how the supervision carried out by the Directorate General of Customs andExcise on the implementation of regulations prohibiting the import of used clothing and how the implementation of the ban on the import of used clothing based on regulations in the field of trade against used clothing trading in Senen Market. The research method uses normative research type, empirical analysis, secondary data supported by interviews, and qualitative analysis. The result is the implementation of the ban on the import of used clothing has not been carried out optimally because there are still many domestic used clothing trades, especially Senen Market. Supervision still has many weaknesses due to the absence of domestic provisions prohibiting the trade in imported used clothing, inadequate human resources and infrastructure in its implementation.

Abstract

Regional governments have the right to determine regional policies in order to realize the implementation of government affairs which fall under regional authority and are obliged to be guided by the norms, standards, procedures and criteria established by the central government. The issues discussed in this journal are what are the basis and conditions for consideration in determining South Papua as a new province in Indonesia and whether the determination of South Papua as a new province in Indonesia is in accordance with Law Number 23 of 2014 concerning Regional Government. This journal is descriptive normative legal research, with literature studies and interviews as well as deductive conclusion drawing. The secondary data obtained was processed qualitatively. Based on the results of research that: The formation of a new province in Indonesia must meet regional administrative, technical and physical requirements as regulated in Law Number 23 of 2014 concerning Regional Government, however, South Papua Province has special autonomous authority in determining to become a new province in Indonesia . The formation of the Papua Province contained inconsistencies in the regulations contained in Law Number 23 of 2014 concerning Regional Government and Law Number 14 of 2022 concerning the Establishment of the South Papua Province.

Abstract

Corruption is an ongoing issue in Indonesia, with hundreds of cases occurring every year. The Corruption Eradication Commission (KPK) has special authority to conduct wiretapping as part of the investigation efforts into corruption cases. One of the frequently used pieces of evidence in wiretapping is voice recordings. In this research, a normative legal approach with a descriptive-analytical method is employed. The research aims to understand and analyze the evidential strength of voice recordings in  cases of corruption. Data is gathered through a literature review, utilizing primary sources like the 1945 Constitution of the Republic of Indonesia, the Criminal Procedure Code (KUHAP), and the Law on the Eradication of Criminal Acts of Corruption, as well as secondary sources such as legal books, legal journals, papers, and relevant articles. Qualitative analysis is the chosen data analysis method. The research findings affirm that the KPK has legitimate authority to conduct wiretapping and use voice recordings as evidence in the prosecution of corruption cases. Voice recordings are recognized as valid evidence with strong probative value, supported by decisions from the Constitutional Court and the expansion of evidentiary provisions in the KUHAP. The research's conclusion reinforces that the KPK can lawfully conduct wiretapping and employ voice recordings as evidence in accordance with applicable laws, playing a crucial role in the fight against corruption in Indonesia. Abstract

Fishery products are one of the main livelihoods of the Indonesian people which can be traded internationally. To facilitate international trade, sending products to international shipping areas from Republic of Indonesia (export) can be done by appointing a transportation management service company. This is done to avoid monopolistic practices carried out by each business actor to benefit themselves. However, implementing these regulations is certainly not easy. One of the cases is the alleged violation of Article 17 of Law 5/1999 committed by PT Aero Citra Kargo (PT ACK). In this case, the author conducts a discussion related to monopoly practices in BBL delivery (export) transportation services by PT ACK according to Article 17 and the accuracy of KPPU decision No. 4/KPPU-I/2021 regarding monopolistic practices for BBL delivery (export) transportation services against PT ACK. Next, the author analyzes the fulfillment of the legal elements and approaches to Article 17 of Law 5/1999. On the other hand, the author also discusses the active role of the government, the period of substitution, and the absence of sanctions against violators in this decision to see the accuracy of the decision. So the conclusion of this research shows that PT ACK has violated Article 17, however in the decision there are still many things that are not explained further, especially regarding the absence of sanctions against violators.

Abstract

Work Relations aren’t always good, disputes often arise which known as Industrial Relations Disputes. Best Effort to resolve this dispute is both parties carry out negotiations, Law Number 2 of 2004 concerning Settlement of Industrial Relations Disputes (“UUPPHI”) requires that industrial relations disputes first step to resolve is through Bipartite Negotiation. This research was conducted to discuss whether the procedures to resolve employment termination disputes between parties are in accordance to UUPPHI and whether the decision of Manado Industrial Relations Court Number 2/Pdt.Sus-PHI/2020/PN.Mnd is in accordance to UUPPHI. In answering these problems, this research was carried out using Normative Law research method, which is analytically descriptive, and base on primary, secondary and tertiary data which is analyzed qualitatively so that conclusions can be drawn deductively. Based on the research results, conclusion that can be drawn was this dispute resolution process between partied aren’t through bipartite negotiation, so the dispute resolution process weren’t in accordance to applicable laws and regulations. Panel of judges in handling down decision was also not in accordance to UUPPHI, where the panel of judges should not have accepted the registered lawsuit or at least handed down the Niet Onvankelijke Verklaard decision.

Abstract

Efforts to mitigate the disruptive effects of foreign visitors' admission and leave into Indonesia are governed by the country's immigration laws. Controlling the behavior of aliens is a part of the immigration process. In this piece, we discuss the challenges encountered by the Soekarno-Hatta Special Class I Immigration Office (TPI) and how they affect their ability to provide immigration supervision to foreign nationals seeking entry into Indonesia. Foreigners are strongly discouraged from entering Indonesia. This study is an example of the normative, descriptive research type. Qualitative in-depth interviews supplement secondary sources of information for this study. According to the findings, the TPI Soekarno-Hatta Special Class I Immigration Office is responsible for monitoring the activities of foreigners entering Indonesian territory through both administrative supervision (verifying immigration documents, conducting interviews, and checking the deterrence list) and field supervision (monitoring against the activities of foreigners). A lack of human resources, a lack of facilities and infrastructure at the TPI Soekarno-Hatta Special Class I Immigration Office, and an inadequate budget all work against the TPI Soekarno-Hatta Special Class I Immigration Office's ability to carry out immigration supervision of foreigners. visitors from outside Indonesia.

Abstract

A redemption failure has been committed by PT Emco Asset Management, especially in four equity mutual fund products that were issued and managed by the company. The supervision of investment manager companies is performed by the Indonesian Financial Services Authority (OJK) with the purpose of protecting investors. The issue to be researched is the role of supervision both preventive and repressive by OJK toward PT Emco Asset Management for the redemption failure. The type of legal research is normative, descriptive, uses secondary data that is supported by primary data, analyzes data qualitatively, and concludes with deductive logic. OJK has implemented preventive supervision by granting written instructions, but the repressive supervision is not implemented by OJK. The repressive supervision in this research is to impose administrative sanctions on PT Emco Asset Management. Therefore, OJK shall not discontinue its supervisory function towards PT Emco Asset Management.
