Abstract

Narcotics crimes have various kinds of sanctions that can be imposed on the perpetrator, one of which is the crime of abusing narcotics for oneself. In this case, the most appropriate sanction for perpetrators of narcotics abuse for themselves is action sanctions in the form of rehabilitation sanctions. However, often perpetrators of criminal acts of narcotics abuse for themselves are considered to be narcotics dealers because there are still no clear boundaries regarding the boundaries between the actions committed by narcotics abusers for themselves and narcotics dealers. For example, in the case where the defendant Hendra bin Zainuri committed a class 1 narcotics abuse crime for himself in Decision No. 522/Pid.Sus/2021/PN Mgl, it was decided under Article.

Abstract

This research aims to evaluate the land acquisition process carried out by the Depok City Government for the development of Alun-Alun Kota Depok. The main question under investigation is the extent to which this land acquisition complies with the provisions stipulated in Law Number 2 of 2012 concerning Land Acquisition for Development for Public Purposes and National Land Law. The research methodology employed is normative legal research with a qualitative and descriptive approach, utilizing secondary data, and applying deductive methods to draw conclusions. The research results indicate that the land acquisition for the development of Alun-Alun Kota Depok has adhered to the applicable regulations, including Law Number 2 of 2012 concerning Land Acquisition for Development for Public Purposes and other National Land Law regulations. Therefore, it can be concluded that the development of Alun-Alun Kota Depok is in accordance with the prevailing legal provisions and does not face significant legal obstacles in its implementation

Abstract

The position of extra-marital children on the inheritance of parents who recognize them is essentially equivalent to legal children based on Article 280 of the Civil Code. The process of recognizing extra-marital children can be divided into 2 (two) groups: First, Voluntary Recognition and Forced Recognition. How is the position of extra-marital children in the distribution of inheritance based on Western Civil Inheritance Law? 2. Will the contents of the verdict of the judge of the Central Jakarta District Court Number 302/Pdt.G/2020/Jkt.Pst, parts Number 1 and 5 regarding the distribution of the estate of (alm) Juniko to the heirs be in line or not by Western Civil Inheritance Law? This research is normative research and descriptive research. The data utilized is secondary data through a literature study. Data management is carried out qualitatively. Concluding is done in a deductive way. Conclusion: the position of extra-marital children in the distribution of inheritance according to Western Civil Inheritance Law will later obtain inheritance if there is recognition as contained in Article 280 of the Civil Code. The Central Jakarta District Court Decision Number 302/Pdt.G/2020/Jkt.Pst is not by Western Civil Inheritance Law.

Abstract

In a presidential system of government, the President is the head of state with extensive powers, and their term in office is fixed until the end of their government's term. To balance the President's authority, a system of oversight leading to the process of presidential removal is necessary. The issue addressed here is how the removal of the President during their term in office is carried out in Indonesia, South Korea, and the United States, and what role Congress/National Assembly plays in the process of presidential removal. This research employs a normative juridical approach, descriptive in nature, drawing from secondary and primary data sources, and arriving at conclusions through deductive logic. The findings of this study are as follows: the procedure for the removal of the President in Indonesia, before the amendment of the 1945 Constitution, was regulated under Article 8, while after the amendment, it is regulated under Articles 7A and 7B. In South Korea, the procedure is governed by Article 111 of the 1987 Constitution of the Republic of Korea, and in the United States, it is regulated by Article 1, Section 5, of The Constitution of the United States. The reasons for presidential removal in each country are based on the commission of criminal acts by the President, with the Indonesian People's Consultative Assembly (MPR), the U.S. Congress serving as determinants of whether the President should be removed or not, while in South Korea, it is the Constitutional Court of Korea that makes the determination

Abstract

Layoffs are the termination of employment relations due to certain circumstances that result in the end of rights and obligations between workers and the company. In decision number 274/Pdt.Sus-PHI/2019/PN Bdg, the judge accepted the defendant's exception stating that the plaintiff's actions exceeded the time limit. From the decision, the problem arises is whether the judge's consideration in the PHI decision stating that Lasman Tampubolon's lawsuit has exceeded the period of time is in accordance with applicable laws and regulations and whether the rights given by the Tri Bhakti Langlangbuana Education Foundation to Lasman Tampubolon are in accordance with Law No. 13 of 2003 concerning Manpower. To answer the problem, normative research is carried out which is analytical descriptive research and the type of data used is secondary data. It can be concluded that the judge's consideration that Lasman Tampubolon's lawsuit has exceeded the period in accordance with laws and regulations and the rights granted by the Tri Bhakti Langlangbuana Education Foundation are not in accordance with Law No. 13 of 2003 concerning Manpower.

Abstract

The marketing of apartments with the pre-project selling system, widely used by developers, is always preceded by a purchase order letter that the signing of a PPJB will follow. In practice, the status of the purchase order letter becomes a matter of concern, whether its position is merely a memorandum of understanding (MoU) or a binding agreement that can be used as a basis for prospective buyers to demand the handover of apartment units and the implementation of AJB. One case related to the purchase order letter is the lawsuit by prospective buyers of Casa Grande Residence Apartments, who are demanding the handover of units, the issuance of SHMSRS, and the signing of AJB because they have already paid the purchase price. To determine whether the prospective buyers can assert their rights, attention must be paid to the content of the purchase order letter, whether its position is only an MoU to be followed by the signing of PPJB, or whether the purchase order letter simultaneously serves as the PPJB. It is also important to consider the customary practices in the marketing of apartments with the pre-project selling system, where the purchase order letter is simply a document containing the buyer's statement of the desired unit along with the terms and conditions set by the developer, to be followed by the signing of PPJB.

Abstract

Involuntary defense (noodweer) justifies an action if it is involuntary, undertaken to defend oneself or others from an imminent threat that violates the law. Individuals who use duress defense have the right to be free from prosecution. The case study occurred in Liya Togo Village, South Wangi-Wangi, Wakatobi Regency, starting from an argument between the victim and the perpetrator. The victim thrust a badik, threatening the perpetrator's life, which was parried. The perpetrator, faced with an urgent attack from the victim, resorted to forced defense by drawing his badik, causing the death of the victim. The research problem involves the judge's consideration of the elements of Article 338 of the Criminal Code and whether the perpetrator's actions meet the elements of Forced Defense in accordance with Article 49 of the Criminal Code. The research method uses a normative legal approach with secondary data from primary, secondary, and tertiary legal materials. The research concluded that the judge's consideration of the elements of Article 338 of the Criminal Code was not fully fulfilled and the actions of the perpetrator fulfilled the elements of forced defense (noodweer) in accordance with Article 49 of the Criminal Code.

Abstract

Undang-undang pemilihan umum di Indonesia, seperti UU No. 7 Tahun 2017, mewajibkan kehadiran minimal 30% perempuan dalam komposisi anggota KPU dan Bawaslu. Fokus pada pemilu 2024 menjadi penting untuk menjamin keterlibatan perempuan dalam proses demokrasi yang lebih merata. Penelitian ini mengevaluasi proses pemilihan komisioner KPU tahun 2022 sesuai dengan UU Pemilu. Metode penelitian yang digunakan adalah penelitian hukum normatif, berfokus pada bahan pustaka sebagai sumber informasi utama, termasuk bahan hukum sekunder dalam penelitian hukum kepustakaan. Hasil penelitian menunjukkan bahwa proses pemilihan tersebut sesuai dengan ketentuan Pasal 22- 26 UU Pemilu. Namun, terdapat ketidaksesuaian dalam keterwakilan perempuan di KPU, melanggar Pasal 10 ayat (1) UU Pemilu yang mengatur 30% perempuan dari total 7 anggota, tetapi hanya satu perempuan yang terpilih. Selain itu, kurangnya keterbukaan informasi terkait hasil pemilihan tersebut. Diperlukan upaya untuk memastikan keterlibatan perempuan yang lebih signifikan dalam proses pemilihan umum ke depan.

Abstract

The study aims to discuss the comparison of death penalty regulations in Indonesia and Egypt. Based on this, researchers use the main problem of how to regulate the death penalty according to law in Indonesia and Egypt and what are the disadvantages and advantages of the death penalty in Indonesia and Egypt. To answer these problems, normative research is carried out with the nature of analytical descriptive research and the type of data used is secondary data. In conclusion, the application of the death penalty in Indonesia is contained in the Criminal Code and other criminal laws. The implementation refers to Law No. 2 / PNPS / Year 1964 and the procedures in the Decree of the Chief of the National Police of the Republic of Indonesia No. 12 of 2010 and the advantages of the implementation of the death penalty in Indonesia the implementation process is carried out by shooting to death and has complete regulations in material and formal law, weaknesses in Indonesia there are clear regulations governing but not implemented in the application of the law. The state of Egypt, the death penalty is contained in the Criminal Code and other laws but in its implementation it is exclusive to the Criminal Procedure Code and Egypt has advantages over the procedural process where the imposition of the death penalty needs the approval of various parties until finally approved by the president, Egypt really implements the existing punishment, the weakness of the death penalty in Egypt lies in the implementation process which uses the method of hanging to death.

Abstract

This study discusses the direct appointment of the Nusantara Capital Region Authority Chief by the President, bypassing general elections, raising questions about consistency with the underlying democraticprinciples of the Indonesian State. Although the 1945 Constitution grants the public the right to elect local leaders through general elections, the direct appointment of the Nusantara Capital Region Authority Chief creates tension with these principles, prompting inquiries about leadership legitimacy and the role between central and regional governance. Employing normative legal research methods and descriptive-analytical analysis of secondary data from literature, this study highlights the inconsistency between the appointment of regional heads and the fundamental democratic principles of the state. The implications of this appointment raise concerns regarding accountability, public representation, and alignment with democratic principles. The findings underscore the importance of maintaining consistency in the application of legal regulations in regional head elections, particularly in the Nusantara Capital, as a robust foundation for a transparent, accountable, and people-respecting democratic process.
