Abstract

Cesare Lombroso mengembangkan Born Criminal Theory yang menyatakan penjahat memiliki sifat biologis yang meningkatkan kemungkinan mereka melakukan tindakan kriminal. Teori ini telah banyak dikritik dan diperdebatkan. Namun, beberapa aspeknya masih relevan dengan hukum pidana modern, terutama dalam memahami faktor-faktor perilaku kriminal. Tujuan penelitian ini adalah untuk merekonstruksi teori Born Criminal dalam perkembangan hukum kontemporer. Penelitian ini menggunakan penelitian hukum normatif dengan pendekatan historis dan konseptual. Studi menunjukkan bahwa faktor genetik dan biologis tidak selalu mempengaruhi perilaku kriminal manusia; faktor biologis dan lingkungan juga berpengaruh. Metode teorinya sangat penting dalam mengatasi kejahatan dalam kehidupan masyarakat. Metode ini melibatkan pemahaman tentang kejahatan secara keseluruhan, pembuatan kebijakan hukum pidana yang sesuai dengan kemajuan saat ini, dan melibatkan semua pihak dalam upaya untuk meminimalkan dan mencegah kejahatan.

Abstract

The increasing complexity of environmental crimes, often perpetrated by corporate actors and facilitated through systemic negligence, has challenged traditional models of criminal responsibility. While conventional criminal law relies on the assessment of mens rea the subjective mental element of guilt this approach often proves inadequate in addressing the nuanced realities of environmentally harmful behavior, which may arise from collective decision-making, cognitive impairments, or moral disengagement. In response, the emerging field of neurolaw introduces neuroscientific insights into legal reasoning, offering an interdisciplinary perspective on how neurological conditions and cognitive processes influence criminal culpability. This research explores the potential of integrating neurolaw into the adjudication of environmental crimes, particularly in evaluating criminal liability in cases involving indirect or diffuse intent. Through normative legal analysis, statutory and conceptual approaches, and comparative reflection on practices in jurisdictions such as the United States, Italy, Germany, and Brazil, the study investigates how neurocognitive evidence such as functional brain imaging and neuropsychological evaluations may complement existing doctrines in Indonesian criminal and environmental law. The analysis includes a critical examination of Indonesia’s Criminal Code (KUHP), Law No. 32/2009 on Environmental Protection and Management, and the principle of strict liability, assessing their compatibility with a neurolaw-informed framework. Importantly, this research also emphasizes the need to strengthen victim protection in the discourse of environmental criminal liability. While neurolaw has been primarily applied to analyze the cognitive condition of offenders, it must not obscure the rights of victims both human and ecological. The study argues for a balanced approach that incorporates neuroscientific considerations without undermining justice for affected communities, future generations, or non-human victims of ecological harm. By aligning neurolaw with victim-centered environmental justice principles, the research proposes a more holistic model of criminal accountability that advances fairness, scientific integrity, and ecological restoration.

Abstract

Currently, there are still a lot of and rampant dissemination of pornographic content through social media, especially through whatsapp as happened in decision number 200/Pid.Sus/2022/Pn.Jmb which befell a female victim against the dissemination of the victim's personal video carried out by her own boyfriend which resulted in the victim feeling ashamed of it, there are 2 (two) rules specifically regulating cyberporn crimes, namely the Pornography Law and the ITE Law. The formulation of the problem of this study is How is the proof in the case of the decision Number 200/Pid.Sus/2022/PN.Jmb? Based on the results of the research, there are 2 (two) laws that are specific in regulating the spread of pornography in electronic media or cyberporn, the principle of systematic lex specialist is needed in its application. In the context of dissemination through electronic media, such as in Decision Number 200/Pid.Sus/2022/PN.Jmb, the ITE Law is more relevant to ensnare perpetrators in terms of the use of electronic media in the distribution of content that violates morality. In addition, there is also evidence in the form of 6 (six) sheets of pornographic photo screenshoots and 1 flash disk containing pornographic videos as valid evidence according to Article 5 Paragraph (1) of the ITE Law. Decision Number 200/Pid.Sus/2022/Pn.Jmb the judge used the Pornography Law because it meets the elements of Article 4 Paragraph (1) of the Pornography Law. According to the author, the application of the Pornography Law is not appropriate because dissemination through social media and electronic evidence is more specifically regulated in the ITE.

Abstract

Minister of Education, Culture, Research and Technology Regulation Number 30 of 2021 is a regulation formed by the government and regulates the prevention and handling of sexual violence in higher education. The mandate of this regulation is to prevent sexual violence in the university environment and also strengthen the handling of sexual violence through assistance, victim recovery, administrative sanctions and victim protection. Andalas University in September 2022 established the Sexual Violence Prevention and Handling Task Force (PPKS). From the beginning of the establishment of the PPKS Task Force of Andalas University until now there have been 21 (twenty-one) cases of sexual violence, 20 (twenty) cases only reached the PPKS Task Force level and 1 (one) case has reached the court stage. This study aims to answer questions related to 1) How is the provision of legal protection by the PPKS Task Force for student victims of sexual violence at Andalas University. This research is written with a juridical sociological (empirical) method and sought data directly in the field, which is descriptive in nature using primary and secondary data sources. Data that has been collected, processed and analyzed qualitatively. The results of the study found that the legal protection provided by the PPKS Task Force of Andalas University is preventive and repressive legal protection, preventive legal protection is socialization and education about the prevention and handling of sexual violence in the Andalas University environment, for repressive legal protection including confidentiality of the reporter's identity, protection of physical and non-physical threats, guarantee of continuing education for the reporter, guarantee of continued employment for educators.

Abstract

Fenomena judi online yang dapat dimainkan dimana saja dan kapan saja merupakan salah satu bentuk dari kemajuan teknologi yang menjadi permasalahan sosial di masyarakat saat ini. Dampak dari judi online seperti kerugian ekonomi dan psikologis dapat merusak keutuhan dalam rumah tangga sehingga dapat memicu terjadinya tindak pidana Kekerasan Dalam Rumah Tangga seperti Kasus Polwan membakar Polisi di Mojokerto. Terdapat dua identifikasi masalah. Pertama, bagaimana tinjauan kriminologi terhadap judi online yang mengakibatkan tindak pidana Kekerasan Dalam Rumah Tangga. Kedua, bagaimana upaya penanggulangan terhadap masyarakat yang terlibat dalam judi online. Metode penelitian yang digunakan yaitu yuridis normatif dengan pendekatan studi kasus. Teori yang digunakan yaitu teori psikoanalisa dan teori penanggulangan kejahatan. Hasil dari penelitian ini menampilkan faktor-faktor penyebab polwan melakukan Kekerasan Dalam Rumah Tangga dengan cara membakar terhadap polisi dikarenakan faktor ekonomi dan aspek ego polwan yang lemah dan dipengaruhi oleh aspek id, sehingga aspek superego yang lemah karena tidak dapat menahan dan menyeimbangkan pikiran, polwan mengarah kepada perilaku menyimpang dari masyarakat dan hukum. Upaya penanggulangan terkait judi online secara penal dan non penal perlu dilakukan secara maksimal agar masyarakat tidak terjerumus pada judi online. Pemerintah dan kepolisian perlu menindak tegas terhadap pelaku judi online dan memperbanyak program sosialisasi terkait bahaya, dampak, dan akibat hukum dari judi online.

Abstract

The expansion of digital technology has not only reshaped communication patterns but also facilitated the emergence of new forms of violence, particularly those conducted remotely through identity misuse on online platforms. This study seeks to examine the patterns of such violence and evaluate the extent to which legal frameworks in Indonesia provide adequate protection for victims from a victimological standpoint. This research applies a qualitative method with an empirical juridical approach, utilizing primary data obtained from in-depth interviews with a victim of identity misuse, supported by secondary sources including legislation and scholarly literature. The findings reveal that perpetrators frequently exploit personal relationships and access to victims’ private data to conduct harmful actions, such as creating fraudulent accounts that damage victims’ reputation and safety. The consequences experienced by victims are not only material but also extend to psychological distress, social marginalization, and ongoing insecurity. Additionally, a significant number of cases remain unreported due to procedural difficulties, lack of trust in law enforcement, prolonged legal processes, and the risk of further victimization. Although regulatory instruments such as cyber law and sexual violence legislation provide a legal basis, their practical implementation is often inadequate in addressing the urgency and complexity of digital-based crimes. Therefore, this study highlights the necessity of strengthening victim-centered legal protection, enhancing institutional responsiveness, and establishing rapid intervention mechanisms to ensure effective victim protection in the digital environment.

Abstract

The rapid growth of the digital marketplace in Indonesia creates changes in the business competition structure and at the same time increase the risk of predatory pricing which can harm the existence of MSMEs. This article analyzes the forms of economic victimization which experienced by MSMEs as a result of predatory pricing from big players in digital marketplace and discuss the role of competition law to protect small business players as a victim of the competition practice from the victimology aspect. The rapid growth of the digital marketplace generates the concentration of market powers due to the emergence of new business forms through price subsidies, high discounts and large-scale promotions, causing distortions in the structure of the digital marketplace and decreasing the competitiveness of small businesses. This research uses a normative legal method. The legal materials used in this study were collected through library research and qualitative analysis on the competition practice in the Indonesian digital marketplace as well as price war and massive promotion that conducted by big e-commerce and digital business companies, which resulted in economic loss for Indonesian small business players. The results showed that predatory pricing does not only cause economic loss but also create a structure of dependence of MSMEs to the digital marketplace system. Also, the current Indonesian competition law still more focus on proving monopoly practices and have yet accommodate the regulation to protect victim of unfair business competition. The findings suggest that victimology as a modern model in competition law plays a important role to improving the legal protection for MSMEs as vulnerable victims in the digital marketplace ecosystem.

Abstract

This study analyzes the limitation of Restorative justice in sexual violence cases at the preliminary investigation and criminal investigation stages from a victimology perspective based on the new Criminal Procedure Code and the TPKS Law. The issue is important because the new Criminal Procedure Code provides space for Restorative justice, while sexual violence cases have a special character related to trauma, power relations, social pressure, and the risk of revictimization. This study uses normative legal methods with analytical-prescriptive properties through statutory, conceptual, victimological, and secondary-document-based case approaches. The results show that Restorative justice in sexual violence cases cannot be used as a mechanism to stop cases against adult perpetrators. Article 23 of the TPKS Law and Article 82 letter d of the new Criminal Procedure Code restrict the settlement of sexual violence cases outside the judicial process. The revocation of the victim's report also does not automatically remove the adequacy of evidence, because investigators remain obliged to assess the victim's voluntariness and trace other relevant evidence. This research confirms that the police have a responsibility to prevent the abuse of Restorative justice through victim-oriented examinations, risk assessments, mentoring, identity protection, and cross-agency coordination. Thus, Restorative justice in sexual violence cases must be placed as a victim-recovery paradigm, not as a shortcut to stop the case.

Abstract

The practice of online scams in Cambodia has evolved into cyber slavery, involving human trafficking and forced labor. This study aims to analyze this phenomenon through a victimological perspective and examine state responsibility under international law. Employing a normative juridical method with statutory, conceptual, case study, comparative law, and victimological approaches, this research evaluates relevant international instruments. Findings indicate that scam compound operations fulfill the elements of trafficking and forced labor, causing primary, secondary, and moral injury to victims due to the weak application of the non-punishment principle. Legally, the state has failed to fulfill its due diligence obligations and the 4P framework. This study recommends strengthening regional legal harmonization, establishing an ASEAN rapid response mechanism, and adopting a victim-centered justice approach, as implemented in the UK's Modern Slavery Act, to enforce state responsibility in eradicating cyber slavery in Southeast Asia.

Abstract

Environmental crimes not only result in human victims but also non-human victims. However, the reality of law enforcement against environmental crimes in Indonesia shows that protection for non-human victims remains inadequate. This research is based on such concerns. This research aims to analyze the theoretical and practical perspectives on the recognition of the intrinsic value of non-human entities and the justification for recognizing and protecting non-human victims in environmental crimes in Indonesia. This research is doctrinal legal research. The results of the study indicate that, first, recognition of the intrinsic value of non-human entities can be found in both theoretical and practical perspectives. Second, the condition of protection for non-human victims in environmental crimes in Indonesia indicates the current need to provide better recognition and protection for non-human victims. The root of this problem is the lack of normative recognition of non-human victims. There are at least four justifications why non-human victims in environmental crimes must be protected: ethical considerations, considerations of creating justice, considerations from the perspective of ecological function, and considerations of the legal function to protect the balance of the ecological system. These findings also emphasize the urgency of strengthening the recognition and protection of non-human victims in environmental crimes in Indonesia.
