Abstract

Pemberantasan tindak pidana korupsi masih menjadi agenda utama dalam penegakan hukum di Indonesia. Lahirnya Komisi Pemberantasan Korupsi (KPK) sebagai ujung tombak pemberantasan korupsi di Indonesia, melalui amanat Undang-undang Nomor 30 Tahun 2002. KPK diberikan kewenangan lebih dibandingkan dengan lembaga penegak hukum lainnya yakni kepolisian dan kejaksaan dalam penanganan kasus korupsi. Setelah lebih kurang 17 tahun berdiri, adanya perubahan undang-undang KPK oleh DPR baru-baru ini mendapatkan perhatian yang cukup besar di tengah masyarakat. Terdapat golongan pro dan kontra atas revisi undang-undang KPK tersebut yang telah disahkan pada tanggal 17 September 2019 yang lalu. Paper ini akan membahas bagaimana arah kebijakan pemberantasan tindak pidana korupsi di Indonesia pasca perubahan terhadap undang-undang KPK. Menarik untuk dibahas lebih lanjut mengenai perubahan-perubahan yang terdapat dalam undang-undang KPK yang baru dikaitkan dengan pemberantasan tindak pidana korupsi ke depannya. Ini berkaitan dengan kewenangan lembaga tersebut dalam mendukung kinerjanya untuk pemberantasan korupsi. Data statistik penindakan menunjukkan bahwa sejak dibentuknya KPK, penanganan perkara sejak tahun 2004 hingga sampai dengan rilis pada akhir Desember 2018, terdapat sebanyak 1.135 kasus korupsi yang telah ditangani oleh KPK. Fokus tulisan ini adalah untuk melihat arah kebijakan pemberantasan korupsi oleh KPK. Semangat tujuan terbentuknya KPK pada awal dahulu dan evaluasi kinerja saat sekarang ini tentunya akan erat kaitannya dengan semangat pemberantasan tindak pidana korupsi yang ada. Isu yang diangkat hanya terbatas pada arah pemberantasan tindak pidana korupsi oleh KPK. Oleh karena itu, perlu untuk adanya pembahasan mengenai fokus pemberantasan tindak pidana korupsi ke depan pasca lahirnya revisi undang-undang KPK

Abstract

Corruption has penetrated into all aspects of people’s life in Indonesia as nation and state, as well as to the communities in rural areas. Corruption occurs in all fields, such as politics, education, religion, and social affairs, including in the distribution of earthquake relief fund in West Sumatra. One of the Corruption Court’s decisions in Padang, has sentenced several chairmans of Community Group, which has been formed to coordinate the distribution of the fund, due to corruption. Corruption by the low level people in the countryside is very different from the the corruption’s shape by state officials. They often happened due to lack of information that it is a form of corruption rather than habbits in community practices. This fact is precisely found in the distribution of reliefs fund in Kenagarian Pakandangan, the province of Padang Pariaman. Debriefing Program conducted by the lecturers from the faculty of law, Andalas University, brings substantial benefits to citizens in Pakandangan, in understanding the shape and behaviors of corruption. In general, people want this program to be continued in the following years, and given not only to adult but also to students, ranging from elementary to higher education.

Abstract

Assistance for empowerment by increasing production and marketing capacity through establishing a community-based business ecosystem is carried out to develop Kedai Gumarang. It has been operating on Sungai Balang, Cupak Tangah Village, Pauh District, Padang City, and West Sumatra Province. Kedai Gumarang is a coffee-based beverage shop that serves the needs of urban youth as a place to interact in various activities while enjoying brewing coffee. The problem experienced by the manager of Kedai Gumarang so far is the production and marketing capacity that must be increased. The solution offered was to increase production and marketing capacity with an improved management approach through business planning based on a business model canvas (BMC) and focusing on establishing a community-based business ecosystem. The entrepreneur ecosystem was formed by bringing together creative entrepreneurs in the city of Padang based on art, books, and cafes as a space for learning and working together. The methods included brainstorming, upgrading entrepreneurial mindsets, formulating BMC, licensing assistance, and periodic monitoring and evaluation.

Abstract

The business potential for brewed coffee by Baristas is very large, especially coffee beans from Indonesian volcanic soil because they have a prime taste. The Gumarang coffee shop started amid the Covid-19 pandemic, this business can grow and survive, but has not yet developed optimally according to its existing potential. Gumarang operated with production equipment that has a small capacity for dispensing coffee, so it has not been able to meet all consumer demands. Gumarang had the opportunity to develop the business under the guidance of the Mandiri and Merdeka Cooperative (KMDM) so that it could apply the elements of the Business Model Canvas (BMC) concept already had. The value proposition element for Gumarang is the existence of an original type of coffee, namely original Minangkabau coffee cultivated by local West Sumatra farmers. Then there is the Gumarang Signature, which is a formula or recipe owned by the Barista. In addition, Gumarang also provides space and organizing services for community events in the city of Padang with friendly service and a traditional minimalist cafe concept, branded as Harmonis Space. The Gumarang coffee shop which was developed into Harmonis Space requires assistance from academics to stay on the path of the business concept. The method used was training, consultation, and evaluation, by the community engagement team and partners. The ultimate goal of a series of activities is to increase partner income as well as community empowerment to strengthen the family economy.

Abstract

Sexual abuse is an act of violence and treatment that degrades human dignity, which is contrary to the values of God and humanity, and disturbs the security and tranquility of the social community. Handling victims of sexual abuse is very important, because the violence has caused various injuries to victims, such as fear, prolonged trauma, feelings of shame, evidentiary problems, repetitive questions by investigators, and the police investigations report process was not carried out properly so that it was difficult for the victim to recount the sexual abuse they experienced. If we look at many cases of violence against women and children, there are still no clear legal solutions. The promulgation of Law Number 12 of 2022 about sexual violence (UU TPKS), it is an effort to reform the law and overcome problems in legal protection of women and children from sexual abuse, namely as follows: preventing all forms of sexual violence, handling, protecting, and recovering victims, carry out law enforcement and rehabilitate perpetrators, create an environment where there is no sexual violence, and ensure non-repetition of sexual violence. Therefore, the problems statement in this research are: First, how are the regulation for the victims management of sexual violence based on Law Number 12 of 2022 about sexual violence (UU TPKS) and the Penal Code. Second, what are the juridical implications of the Law Number 12 of 2022 about sexual violence (UU TPKS) on victims in an Integrated Criminal Justice System that is gender-equitable. The problem approach in this study is a normative juridical, with data sources being the Criminal Procedure Code, the Penal Code, the Law Number 12 of 2022 about sexual violence (UU TPKS), Academic Papers on the Draft Law on the Elimination of Sexual Violence and other relevant sources. The results of the research show that the regulation of the Integrated Criminal Justice System in the UU TPKS regulated in Articles 20-64 is an effort to complement and strengthen the provisions on the rights of victims as regulated in existing laws and regulations. Meanwhile, the juridical implications of the UUTPKS for the Integrated Criminal Justice System are a guarantee of legal certainty, justice and the benefit of law in law enforcement of the Crime of Sexual Violence. A gender-just criminal justice system is one of the breakthroughs to change a non-gender-oriented legal system into a gender-oriented legal system. The system is expected to be able to respond to situations that are always experienced by women and children who are victims of gender-based sexual violence.

Abstract

The practice of the crime of human smuggling (TPPM) is closely related to the practice of the crime of trafficking in persons (TPPO) which crosses national borders in jurisdiction. The practice of human smuggling allows for opportunities for the purpose of trafficking and exploitation of people who are smuggled across a country's borders. Handling is regulated in special criminal acts, namely the crime of human smuggling in Law Number 6 of 2011 with Immigration Civil Servant Investigators (PPNS) as law enforcement officers, while the crime of trafficking in persons is regulated in Law Number 21 of 2007 which only states said the investigator who could carry out the investigation. But the problem is, there is a practice of criminal acts of trafficking in persons originating from criminal acts of people smuggling, will Immigration Civil Servants have authority over this. However, Therefore, this research aims to analyze the authority of the Immigration Civil Servants in handling the criminal act of trafficking in persons originating from the criminal act of people smuggling. The results of the research show that the authority of the Immigration Civil Servants in handling the criminal act of trafficking in persons originating from the criminal act of people smuggling is to carry out joint investigations with Polri investigators. Based on the principle of lex specialis systematic, the crime of human smuggling is a more specific crime than the crime of trafficking in persons.

Abstract

Sextortion as part of Cyber Gender-Based Violence (KBGS) is a cybercrime that often occurs today. Sextortion is carried out by extorting or exploiting the victim materially or sexually by utilizing the victim's pornographic content. Prior to the promulgation of Law Number 12 of 2022 concerning Crimes of Sexual Violence (TPKS Law) on May 9 2022, the crime of sextortion was regulated separately and spread across several laws and regulations, where these regulations still had juridical weaknesses which led to overcoming sextortion crimes in Indonesia are not sufficient. This study discusses the form of sextortion arrangements in Indonesian criminal law. This research uses normative research methods with statutory and case approaches, with secondary data sources. The results of this study concluded that the forms of regulation of sextortion in Indonesian criminal law consist of criminal acts of decency, criminal acts of extortion, criminal acts of threats, criminal acts against the independence of others, criminal acts of pornography, and criminal acts of electronic-based sexual violence (KSBE). The existence of the TPKS Law has regulated formulations of sextortion crimes that are better and more comprehensive than formulations in the Criminal Code, the Pornography Law, and the ITE Law. The implementation of the TPKS Law is expected to be able to realize the prevention of sextortion crimes that reflect the values of justice and legal certainty.

Abstract

Perlindungan hukum terhadap perempuan dari tindak pidana kekerasan dan bebas dari penyiksaan atau perlakuan yang merendahkan martabat manusia merupakan hak semua warga negara yang merupakan hak kontitusional yang dijamin dalam Undang-Undang Dasar 1945. Kekerasan seksual adalah isu penting dan rumit dari seluruh peta kekerasan terhadap perempuan karena adanya dimensi yang sangat khas dari perempuan, ketimpangan relasi kuasa antara pelaku dan korban adalah akar kekerasan seksual terhadap perempuan Dalam kurun waktu 5 tahun terakhir ini (2017-2022) berdasarkan data dari Sistim Informasi Online Perlindungan Perempuan dan Anak (SIMFONI PPPA) Kementerian PPPA terungkap bahwa sepanjang tahun 2022 terjadi sejumlah 25.050 kasus kekerasan terhadap perempuan yang menjadi korban kekerasan di Indonesia. Sedangkan di Sumatera Barat pada tahun 2020 sebanyak 94 kasus, tahun 2021 ada sebanyak 104 kasus dan tahun 2022 sebanyak 300 kasus. Dengan diundangkan Undang-Undang Nomor 12 Tahun 2022 tentang Tindak Pidana Kekerasan Seksual ini merupakan upaya pembaharuan hukum serta mengatasi permasalahan dalam perlindungan hukum terhadap perempuan dari Tindak  Kekerasan Seksual  yaitu  sebagai  beriku: mencegah segala bentuk kekerasan seksual, menangani, melindungi, dan memulihkan korban, melaksanakan penegakan hukum dan merehabilitasi pelaku, mewujudkan lingkungan tanpa kekerasaan seksual, dan menjamin ketidak berulangan kekerasan seksual. Hasil Penelitian menunjukan kebijakan yang telah dilakukan Pemerintah Daerah (DP3AP2KB) Propinsi Sumatera Barat dalam rangka perlindungan hukum terhadap perempuan pasca keluarnya UUTPKS adalah pembentukan Unit Pelaksana Teknis Perlindungan Perempuan dan Anak (UPTD PPA) yang merupakan amanah dari UU TPKS, di Sumatera Barat baru terbentuk di 7 (tujuh) Kabupaten /Kota, 3 ( tiga) masih dalam proses akademis dan 7 (tujuh) masih belum terbentuk sama sekali, mengadakan sosialisasi UUTPKS dan aparat penegak hukum di Sumatera Barat belum mengimplementasikan UUTPKS dalam rangka perlindungan hukum terhadap perempuan dalam kasus kekerasan seksual dengan alasan ragu karena belum adanya aturan pelaksanaan dan tetap memakai aturan yang ada.

Abstract

The legal challenges within Indonesia's justice system revolve around the absence of a unified implementation of the one-roof prosecution policy for military crimes. Despite the apparent coordination authority vested in the Attorney General, as highlighted in Article 57 of the Military Justice Law and Article 18 of the Amendments to the Prosecutor's Office Law, practical enforcement reveals a lack of reporting by Auditors to the Attorney General regarding the prosecution of military criminal cases. Furthermore, issues arise in handling connection cases, where the Criminal Procedure Code stipulates joint trials for handling perpetrators from both general and military justice systems. However, in practice, many connectivity cases are tried separately, leading to dualism and disparities of prosecution. In response, a suggested solution was to establish the Deputy Attorney General for Military Affairs (DAGMA) as the new structure within the Attorney General's Office. This paper aims to obtain a comprehensive explanation regarding the legal policy behind establishing DAGMA as the assistant of the Attorney General in handling military affairs and connectivity cases. The method used in this research is juridical-normative, which mainly focuses on examining the law as norms or rules that apply in society and serve as guidelines for individual behavior. The findings proved that establishing DAGMA is the Government's effort to implement legal reform, especially regarding optimizing the performance of the Indonesian Prosecutor's Office as the implementer of state prosecutorial power to realize prosecutorial unity in Indonesia.
