Southeast Asian Journal of Victimology adalah jurnal peer-review double-blind yang didedikasikan untuk eksplorasi dan kemajuan viktimologi dalam konteks Asia Tenggara yang beragam dan dinamis. Jurnal kami menyediakan platform bagi akademisi, peneliti, dan praktisi untuk terlibat dalam berbagai aspek viktimologi, dengan penekanan khusus pada kawasan Asia Tenggara. Southeast Asian Journal of Victimology berkomitmen untuk mempromosikan pemahaman yang lebih mendalam mengenai isu-isu viktimisasi di Asia Tenggara dan memfasilitasi kolaborasi di antara para akademisi, pembuat kebijakan, dan praktisi yang berdedikasi pada penelitian dan dukungan yang berpusat pada korban. Kami mengundang para peneliti untuk berkontribusi terhadap kemajuan pengetahuan dan hak-hak korban di wilayah yang beragam dan terus berkembang ini. Penulis diundang untuk mengirimkan artikel penelitian asli, tinjauan literatur, studi kasus, dan kontribusi teoretis yang selaras dengan fokus dan ruang lingkup jurnal. Abstract

Child victims of sexual intercourse are victims of criminal acts who experience losses that are not only material in nature, but also experience psychological suffering. Restitution is the payment of compensation that is charged to the perpetrators of a crime based on a court decision that has permanent legal force for material or immaterial losses. Restitution is also a form of protection for victims of sexual intercourse and is a form of law enforcement for perpetrators of sexual intercourse to pay restitution as a form of compensation for losses suffered by victims. The author takes a case study that occurred in Bandung, the case of intercourse by a teacher with female students. The judge sentenced the defendant to death and paid restitution to the victims as a form of compensation for the losses suffered by the female students. Providing restitution to victims of sexual intercourse is very important, because restitution will at least reduce the burden of losses experienced by victims of sexual intercourse.

Abstract

Victims and perpetrators of crime still experience different treatment in Indonesia. These differences are expressed in statutory regulations and national law enforcement practices. The same is true for victims of terrorism. Attention to suspects or perpetrators of terrorism is much greater than to victims. Moreover, in many cases of terrorism, the perpetrator and victim do not know each other. The rights of victims internationally are written down in various international legal products. There are two large groups of victims' rights: procedural and service rights. This article discusses the procedural rights of victims of terrorism, specifically in the aspect of fulfilling and protecting victims' impact statements. The research approach is qualitative, and data collection is carried out by reviewing literature and studying legislation by comparing the fulfillment and protection of the rights of victims' impact statements in other countries. The findings from this research are that the rights of victims of terrorism regarding victim impact statements have not been specifically regulated in Indonesian law. This is reflected in the trial process and in the words of surviving victims of terrorism. Then, the suggestion from these findings is that the need for justice for victims and their families related to procedural rights, specifically the right to victims' impact statements, needs to be regulated explicitly in Indonesian law and applied in everyday criminal justice practice.

Abstract

Tindak pidana pencabulan merupakan tindakan dengan kekerasan atau ancaman kekerasan dengan memaksa seorang untuk melakukan atau membiarkan dilakukan perbuatan cabul serta menyerang kehormatan kesusilaan, di mana pelaku pencabulan biasanya melakukan suatu perbuatan yang dilakukan dengan banyak cara untuk pemenuhan atau pencapaian hasrat seksualnya. Dewasa ini marak terjadi tindak pidana pencabulan terhadap anak yang dilakukan oleh tenaga kependidikan yang semestinya melindungi dan mendidik anak sehingga terhadap pelakunya dikenakan pemberatan pidana namun kenyataannya pemberatan pidana belum diterapkan.  Penelitian ini adalah penelitian yuridis normatif dengan pendekatan perundang-undangan dan pendekatan kasus. Hasil penelitian bahwa pertanggungjawaban pidana tenaga kependidikan dalam perkara Putusan Pengadilan Negeri Gunungsitoli Nomor 60/Pid.Sus/2018/PN Gst dan Putusan Pengadilan Negeri Tanjungpinang Nomor 45/Pid.Sus/2016/PN Tpg, hakim semestinya menjatuhkan putusan sesuai dengan perbuatan terdakwa sebagai prevensi umum agar masyarakat terlindungi dari perbuatan terdakwa, maupun sebagai prevensi khusus agar terdakwa tidak mengulangi lagi perbuatannya, dan bertujuan sebagai sarana pembinaan bagi terdakwa agar dapat memperbaiki sikap, tingkah laku dan perbuatannya dikemudian hari. Perlindungan hukum terhadap anak sebagai korban tindak pidana pencabulan oleh tenaga kependidikan harus mendapatkan perlindungan hukum menurut Pasal 69A Undang-Undang Nomor 35 Tahun 2014 tentang Perlindungan Anak berupa edukasi tentang kesehatan reproduksi, nilai agama, dan nilai kesusilaan, rehabilitasi sosial, pendampingan psikososial pada saat pengobatan sampai pemulihan, dan pemberian perlindungan dan pendampingan pada setiap tingkat pemeriksaan mulai dari penyidikan, penuntutan, sampai dengan pemeriksaan di sidang pengadilan.

Abstract

Pornografi balas dendam (revenge porn) merupakan tindakan pemaksaan, ancaman terhadap seseorang untuk menyebarluaskan materi pornografi tanpa adanya persetujuan dari pihak korban. Pelaku bisa pacarnya, mantan pasangan yang ingin kembali atau orang yang tidak dikenal. Akibat dari perbuatan tersebut korban mengalami kerugian fisik dan psikologis. Berdasarkan hal tersebut, tulisan ini bertujuan untuk menelaah korban revenge porn dengan meninjau dari perspektif viktimologi. Penelitian ini menggunakan penelitian hukum normatif, dengan teori kepustakaan dengan cara mengkaji karya tulis ilmiah beserta teori-teori yang relevan dan perundang-undangan. Penelitian ini menyimpulkan bahwa korban pornografi acapkali melakukan balas dendam. Proses viktimisasi dimulai dari korban itu sendiri. Banyak pasangan yang dulunya saling mencintai, tetapi setelah berpisah mereka menjadi saling membenci dan berakhir balas dendam dengan menyebarluaskan materi pornografi yang melibatkan keduanya saat masih bersama. Kasus ini didominasi oleh perempuan, namun ada juga beberapa kasus yang melibatkan laki-laki, revenge porn dianggap sebagai kekerasan seksual. Revenge porn merupakan tindak pidana karena melanggar privasi korban. Perlindungan terhadap korban revenge porn diatur dalam UU 13 Tahun 2006 jo UU RI No.31 Tahun 2014 tentang Perlindungan Saksi dan Korban, UU Pornografi, UU ITE dan UU RI No.12 Tahun 2002 tentang Tindak Pidana Kekerasan Seksual. Adapun aksi dari revenge porn based on consent memenuhi unsur dalam UU RI No.12 Tahun 2022 Pasal 14 tentang Tindak Pidana Kekerasan Seksual.

Abstract

The implementation of restorative justice in the prosecutor's office has been carried out, one of which is in cases of domestic violence. The purpose of this research is to examine the application of restorative justice by the prosecutor's office in realizing protection for victims of domestic violence. The research method uses normative legal research with a case approach and qualitative descriptive analysis. The results of the study found that the application of restorative justice in the prosecutor's office in handling cases of domestic violence can protect victims because the process is carried out with mediation between the victim and the perpetrator, so that the victim can convey his wishes and needs facilitated by the prosecutor. Victims benefit from the law enforcement process and reduce the accumulation of cases in court.

Abstract

Viktimisasi sekunder terjadi ketika korban pelecehan seksual mengalami tekanan dan intimidasi dari pihak lain, termasuk masyarakat, media, atau bahkan aparat penegak hukum, setelah kejadian Pelecehan seksual. Dalam konteks media sosial, viktimisasi sekunder dapat terjadi berupa penghinaan dan intimidasi melalui komentar, postingan, atau pesan di media sosial, yang dapat memperparah trauma dan stres yang mereka alami. Penggunaan identitas korban yang disebarluaskan secara tidak sah di media sosial, sehingga korban mengalami ancaman terhadap keamanan dan privasi. Penggunaan gambar atau video yang disebarluaskan tanpa izin, yang dapat memperparah trauma dan stres korban. Penggunaan media sosial untuk memperluas Pelecehan seperti dengan cara membagikan konten yang menghina korban atau mempromosikan perilaku pelecehan seksual. Penggunaan media sosial untuk memperluas stigma seperti dengan cara membagikan konten yang menghina korban atau mempromosikan perilaku pelecehan seksual. Penelitian ini mengkaji bagaimana pemenuhan hak-hak korban Pelecehan Seksual dan mekanisme pemenuhan hak-hak korban Pelecehan Seksual menurut Undang-Undang Nomor 12 Tahun 2022 Tentang Tindak Pidana Pelecehan Seksual. Penelitian ini menggunakan metode penelitian yuridis normatif dengan pendekatan undang-undang dan pendekatan kasus, serta menggunakan sumber data sekunder, yang kemudian dianalisis secara deskriptif analitis. Penelitian ini mencapai pada kesimpulan bahwa terdapat kendala dalam memberikan perlindungan hukum bagi korban pelecehan seksual di media sosial diantaranya, tidak ada aturan khusus mengatur perlindungan tentang pelecehan seksual di media sosial, budaya hukum yang masih menerapkan budaya patriarki, aparat penegak hukum tidak berperspektif korban, dan rendahnya kesadaran korban pelecehan seksual di media sosial.

Abstract

The development of electronic media and information technology is increasingly rapid in contemporary globalisation. Cybercrime is a word used to describe the misuse and adverse effects of the development of information technology through computerised systems and internet networks. Sextortion is a type of gender-based cybercrime in which the victim is blackmailed using sexually suggestive images or videos, as happened to Rebecca Klopper, whose case recently went viral. This research is designed using the normative juridical method, or the approach used is the statute approach, data sourced from laws and regulations which are qualitatively analysed and presented with descriptive analysis. Based on the results of the study, victims of extortion are recognised as receiving legal protection in the Criminal Code, specifically Article 368 paragraph (1) related to extortion and Article 369 paragraph (1) related to threatening acts. If the elements of the criminal offence of extortion and threatening are proven and convincing in accordance with the provisions of the legislation, then the elements of extortion and threatening in Article 27 paragraph 4 of the Electronic Transaction Information Law immediately apply. In addition, Article 14 paragraphs (1) and (2) of the Sexual Violence Law provides for six years of imprisonment for similar offences. To identify cybercrimes in the form of extortion that can be considered as international crimes, this research is also equipped with several countermeasures that can be implemented by victims of cybersexual violence.

Abstract

The advancement of artificial intelligence has undeniably fostered progress and expedited human development. Artificial intelligence's capacity to emulate human thinking enables computers to exhibit human-like responsiveness through cognitive processes. Conversely, the advancement of artificial intelligence consumes significant energy and produces heat. A more substantial number of computers is necessary to achieve artificial intelligence that is on par with human thinking. A considerable quantity of computers produce thermal energy, resulting in an adverse impact on the surrounding environment. Under these circumstances, the concept of green victimology should be created. A literature review explored the convergence of AI technology with green victimology. The data selection is derived from secondary sources, such as articles, books, papers, and other written references, including legislation. The data collected will be analysed qualitatively, meaning that only data sources that are relevant and consistent with the situation will be used. The research concludes that the extensive utilisation of computers in advancing AI technology if left unregulated, will result in environmental harm through the emission of excessive heat and the generation of computer trash. Indonesia is fully prepared to implement green policies, supported by appropriate regulations, to demonstrate the importance of protecting the environment. This is based on the understanding that the environment can suffer due to human actions, as shown by the concept of green victimology. Perkembangan artificial intelligence memang membawa kemajuan dan percepatan tumbuh manusia. Kemampuan artificial intelligence untuk berpikir layaknya manusia membuat komputer menjadi responsif bagaikan manusia menggunakan akalnya. Di sisi lain, pengembangan artificial intelligence menyerap banyak energi dan menghasilkan panas. Untuk membuat artificial intelligence berkembang menyamai cara pikir manusia membutuhkan lebih banyak lagi komputer. Banyaknya komputer ini menghasilkan panas dan membuat lingkungan sekitarnya menjadi terkorban. Maka, keadaan demikianlah green victimology harus diperkenalkan. Untuk mencari jawaban atas bersinggungnya teknologi AI dengan green victimology, kajian pustaka dilakukan. Pemilihan data berasal dari data sekunder yaitu seperti artikel, buku, laporan, dan referensi tertulis lainnya termasuk perundang-undangan. Hasil akhir dari pengumpulan data akan dianalisis secara kualitatif, yaitu hanya sumber data yang isinya berkorespondensi dan koheren dengan permasalahan akan diambil. Kesimpulan dari penelitian ini yaitu, penggunaan komputer yang masif untuk pengembangan teknologi AI jika tidak dipantau akan merusak lingkungan dengan pencemaran berupa panas yang berlebihan dan munculnya limbah dari komputer. Walau demikian, Indonesia dengan segala peraturan yang mendukung telah siap untuk menegakkan green policy untuk menunjukkan bahwa lingkungan perlu dilindungi karena dalam pandangan green victimology, lingkungan dapat menjadi korban.

Abstract

A This study discusses legal protection for victims of physical violence from the perspective of victimology. This study aims to analyze the effectiveness of existing legal protections for victims of physical violence, as well as provide recommendations for improving the protection of victims of such crimes. The research method used is a normative legal research method, the approach method used is a qualitative approach that is descriptive and analytical, the type and source of data used is secondary data. Victims of physical violence often face challenges in obtaining adequate legal protection. This shows the importance of deepening the perspective of victimology in an effort to provide effective protection for victims of physical violence. Victimology as a science that studies victims of crime provides deep insight into the conditions, rights, and needs of victims of physical violence. By understanding the perspective of victimology, the legal system can be developed to be more responsive to the protection of victims of physical violence. This study aims to explore the extent to which existing legal protections have been able to protect victims of physical violence and assess whether these protections are in line with the principles of victimology. Through an in-depth analysis of existing aspects of legal protection, this study is expected to provide concrete recommendations for related parties to improve the effectiveness of protection for victims of physical violence. By paying attention to the perspective of victimology, it is hoped that legal protection efforts for victims of physical violence can be more focused on the needs of victims, provide easier access to justice, and prevent the recurrence of violence in the future. Alignment between the principles of victimology and the legal protection system is an important step in building a safer and more caring society for victims of physical violence.

There are no regulations regarding advocates in terms of accompanying victims, but so far there have been regulations regarding victims' rights, but the role of advocates is not regulated in detail and is not complete in assisting victims' rights because the role of advocates so far does not function fully for victims but only for suspects. This research aims to determine the role of Advocates in fulfilling victims' rights in the current criminal justice system and the role of Advocates in fulfilling victims' rights in the criminal justice system in the future from the perspective of criminal law reform. This research is a type of normative juridical research with a statutory approach. The role of advocates in fulfilling victims' rights in the criminal justice system. Currently, advocates never participate even though advocates are included in the criminal justice system because in Pasal 54 Undang-Undang No. 8 Tahun 1981 tentang Hukum Acara Pidana (“KUHAP”) It does not regulate the assistance of victims by advocates and also cannot provide legal assistance to victims because the victim has been accompanied by the Public Prosecutor during the trial process, but what the Public Prosecutor does is never demands that the defendant provide restitution or material or immaterial compensation. to the victim and the discovery of the victim's rights, currently represented by the prosecutor so that the advocate has not played a role in fulfilling the victim's rights, so the advocate has not been able to uphold the victim's rights in the criminal justice process in this case the victim is represented by the prosecutor while the advocate represents the defendant and the Role of the Advocate in fulfilling the rights of victims in the criminal justice system in the future from the perspective of criminal law reform, namely criminal law reform including legal substance, legal structure and legal culture as in Law Number 18 of 2003 concerning Advocates, it is expressly stated that Advocates are law enforcers who have the same position as other law enforcers, such as Judges, Prosecutors and Police as well as future criminal law reforms, advocates can play a role in fulfilling the rights of victims represented by advocates in the criminal justice process starting from the reporting stage to providing restitution or compensation. material and immaterial losses to the victim.
