Abstract

Collecting donations for natural disaster victims is a form of social solidarity widely practiced by the community, including students. However, in practice, these fundraising activities must be carried out in accordance with applicable legal provisions, specifically Regulation of the Minister of Social Affairs of the Republic of Indonesia Number 8 of 2021 concerning the Implementation of the Collection of Money or Goods (PUB). This study aims to analyze the implementation of Ministerial Regulation Number 8 of 2021 in the practice of collecting donations for natural disasters by students. The research method used is a normative empirical research method with a legislative and sociological approach. Data were obtained through literature review and interviews with the Social Services Agency and student organizations. The results show that the implementation of Ministerial Regulation Number 8 of 2021 in student fundraising activities has actually taken place, but is not yet fully optimal. This is evident in the continued discovery of donation collections carried out without official permits from authorized agencies and the lack of accountability reporting for collected funds. This condition indicates that the level of compliance with administrative provisions in the implementation of fundraising is still relatively low. Therefore, increased regulatory dissemination, more effective oversight, and increased legal awareness among students are needed to ensure that fundraising activities are carried out transparently, accountably, and in accordance with applicable laws.

Abstract

Phishing is a form of cybercrime that has experienced a significant increase in frequency within Indonesia. This fraudulent practice aims to deceive victims into surrendering personal data or sensitive financial information by impersonating trusted institutions. Such crimes result in substantial losses for both individuals and the business sector, particularly concerning personal data protection and digital transaction security. This research aims to analyze the legal regulations and the role of supervisory institutions in addressing phishing threats in Indonesia using a normative legal research method. The legal analysis encompasses the implementation of the Electronic Information and Transactions Law (UU ITE), specifically Article 28, paragraph (1), and the Personal Data Protection Law (UU No. 27 of 2022), which serves as the primary foundation for privacy rights. Furthermore, this study examines the Consumer Protection Law and the Indonesian Criminal Code (KUHP) as enforcement instruments. The strategic roles of the Financial Services Authority (OJK) and Bank Indonesia (BI) are also discussed in the context of risk mitigation within the financial sector. The findings indicate that law enforcement effectiveness is still hindered by low digital literacy, limited forensic technology infrastructure, and jurisdictional challenges in tracking cross-border perpetrators. Consequently, a synergy between regulatory strengthening, international collaboration, and massive public education is required to comprehensively suppress these cybercriminal activities.

Abstract

Protection of rape victims’ rights within the Indonesian criminal justice system continues to face significant challenges, particularly regarding the role of advocates, who have traditionally focused more on assisting suspects or defendants. This study aims to analyze and describe the role of advocates in protecting the rights of rape victims, including the rights to legal assistance, restitution, and physical as well as psychological recovery. The research employs a normative juridical approach through the analysis of statutory regulations and relevant legal literature. The findings reveal that the role of advocates in assisting rape victims remains limited due to the absence of explicit provisions in the Indonesian Criminal Procedure Code (KUHAP) granting advocates full authority to represent victims throughout all stages of criminal proceedings. Consequently, victims frequently encounter obstacles in accessing justice and obtaining adequate legal protection. This condition demonstrates the need for legal reform to strengthen the position and authority of advocates in representing victims within the criminal justice process. Strengthening the role of advocates is expected to improve legal protection, ensure the fulfillment of victims’ rights, and support the recovery process for rape victims in Indonesia.

Abstract

 The relocation of graves in Palangka Raya City often gives rise to administrative problems due to the limited availability of burial land and the public’s lack of understanding of the applicable procedures. This issue has become increasingly complex with the rising demand for grave relocations since 2025 and the implementation of Palangka Raya City Regional Regulation No. 13 of 2024, which aims to maintain order and legal certainty in the management of graves. This study aims to examine the role and efforts of the Department of Housing, Settlements and Land Affairs (Disperkimtan) in ensuring orderly administrative procedures for grave relocation, as well as to identify the obstacles encountered. The research method employed is a normative-empirical legal study using a qualitative approach, in which data was collected through observation, interviews and a literature review. The research findings indicate that the Department of Public Works and Housing plays a vital role as a regulator, provider of administrative services, data manager, and field supervisor in the grave relocation process. However, several challenges have been encountered, such as the public’s limited understanding of grave relocation procedures and the scarcity of cemetery land. To address these challenges, the Department of Public Works and Housing has undertaken various initiatives, including public awareness campaigns, streamlining service procedures, and optimising the use of cemetery land. It is hoped that this research will contribute to improving the effectiveness of grave relocation management, ensuring it is more orderly, systematic, and in accordance with applicable laws and regulations.

Abstract

This study examines the role of business law in ensuring protection for exporters, importers, and investors in international trade amid globalization. The research addresses two key issues: the effectiveness of dispute resolution mechanisms (national law, international courts, and arbitration) and the role of business law in regulating legal protections, particularly for international payment methods. The normative juridical method was employed, analyzing primary and secondary legal materials, including Law No. 7/2014 on Trade, Law No. 30/1999 on Arbitration, and Bank Indonesia Regulation No. 20/2018. The findings reveal that national law is effective for simple disputes but limited in cross-border enforcement. International arbitration proves more efficient, though challenges such as costs and low awareness among businesses persist. Additionally, the study highlights regulatory gaps in addressing globalization challenges, such as digital trade and cSurrency fluctuations. The research concludes that revising national legal frameworks, enhancing outreach programs, and harmonizing with international standards are critical to strengthening legal protections for businesses.

Abstract

This study aims to analyze the factors hindering the implementation of Regional Regulation Number 1 of 2018 concerning Public Order in Gorontalo City. The method used is empirical legal research with a descriptive analytical approach, through the collection of primary data in the form of interviews and observations, as well as secondary data from laws and regulations and related literature. The results indicate that the implementation of this regional regulation has not been effective, as indicated by the continued occurrence of various violations in public spaces. The main inhibiting factors include low public legal awareness, weak law enforcement by officials, the community's economic conditions, lack of regulation dissemination, and limited facilities and infrastructure. Therefore, comprehensive and sustainable efforts are needed to improve the effectiveness of regional regulation implementation by strengthening law enforcement, increasing public awareness, and policies that are more responsive to the community's socio-economic conditions.

Abstract

This study aims to analyze the effectiveness of the Police's role in handling narcotics trafficking in Kapuas Hulu Regency and identify legal gaps that hinder the optimization of law enforcement, while simultaneously formulating relevant legal reforms. The method used is normative juridical with a statutory and conceptual approach, through a study of Law Number 2 of 2002 concerning the Indonesian National Police and Law Number 35 of 2009 concerning Narcotics. The results of the study indicate that although normatively the Police's authority has been clearly regulated, its implementation in border areas such as Kapuas Hulu still faces various obstacles, including limited resources, geographical conditions, weak coordination between institutions, and the absence of specific regulations that accommodate the characteristics of border areas. In addition, there are legal gaps and unclear norms in the aspects of authority, coordination, and community-based prevention mechanisms and handling of technology-based crime modes. Therefore, legal reconstruction and reform are needed through strengthening regional-based regulations, increasing the police's accountable discretionary powers, strengthening cross-sectoral coordination, and integrating penal and non-penal approaches to create a more effective and adaptive law enforcement system in combating narcotics trafficking and providing optimal protection to the community.
