Abstract

The benefits are so great on marine management must make all parties or nations wanted to do the exploration and exploitation of these resources, including sea off, so sometimes causing disputes between parties including between countries in implementing management. Dispute can be resolved nationally and internationally, depending of the parties therein. International dispute resolution fisheries that occur at sea off can be resolved amicably between the two sides, but when the agreements of peace between the parties can not be reached, the dispute settlement procedure of fisheries at sea off can be done by 4 ways namely through the International Tribunal for the Law of the Sea, the International Court of Justice, or the Special Arbitration Procedure Arbitration and Conciliation Consiliation.

Abstract

Constitutional Court Decision Number 27 / UUP-IX / 2011 is the ruling Judge Constitutional Court on the judicial review of articles in Law Number 13 of 2003 on Labour as positive law for industrial relations in Indonesia. Practice of handing over part of its work to another company, known by the term outsourcing, is a means used by a company to be able to make profits and save large financing. By using normative juridical method, with casuistry approach that elevates examples of cases that occur in the PT. PLN (PERSERO) Region Maluku and North Maluku. This research study into a material that can contribute to the relevant parties.

Abstract

Law No. 5 of 1986, as amended and supplemented by Law No. 9 of 2004 concerning the State Administrative Court, and also in the explanation, the term process of dismissal is not known, but the substance of meanings provided for in Article 62 Court Law. The process of dismissal or a consultative meeting of the screening process to suit the incoming State Administrative Court. Events in the consultative meeting or dismissal examinations conducted by deliberation whether the case is accepted or not. The existence of the background of this dismissal is based on a claim that not all can be received at the Administrative Court so that the process is solid filtered dismissal cases that entered in the Administrative Court. The dismissal process must be passed every lawsuit that goes to the administrative court. It was to assess the feasibility of a lawsuit proceed to the next stage of the trial. In the process of dismissal, accompanied by the Chairman of the Administrative Court clerks who recorded the course of the examination file. "If adopted, the chairman of the administrative court will appoint a panel of judges, but if not accepted, will be issued the determination of dismissal, thepartiesobjected to the determination of dismissal can take the fight, and the chairman of the State Administrative Court would reassess. Assessment isa lawsuit under the authority Administrative Courtor not to prosecute. It could have entered his complaint to the administrative court but after examination, the general judicial authority,not the administrative court.

Abstract

Human Rights in general is defined as every human rights acquired since he was born that apply universally. In Indonesia, religious freedom is a part of many human rights are constitutionally stipulated in the Constitution of the Republic of Indonesia in particular in Article 28A through Article 28J. Which is then more specifically regulated in Law Number 39 Year 1999 on Human Rights, and Law No. 12 of 2005 on the Ratification of the International Covenant On Civil Rights and Politics (International Covenant on Civil and Political Rights). Karenya each of Indonesia's population is given the freedom of religion but in practice these freedoms must remain within the limits stipulated in legislation

Abstract

Abortus provocatus is a controversial case until now because there are pros and cons in the community.In criminal law of Indonesia abortion is a crime provocatus.Perpetrators in the case of abortion provocatus by reason of the failure of contraception is Pregnancy (dader) who want abortion occurs in an abortion, pregnant women can not do the criminal act itself but because of the people assisted by the helper perpetrators will also be punished.

Abstract

Corruption has become a complex phenomenom in Indonesia which frequently involves the government officials, legislative and judicative. Members, bankers, conglomerates, and also corporation that misuse the state’s finance. As a result, Indonesia must suffer from a huge  loss which directly affects the people’s economy. This criminal act, somehow, must be teckled seriously as it has become a national issue. In addressing that problem, the writer specifically focuses on three crusial sections which composed. Of the regulation of death penalty based on law, the development of thoughts regarding the existence of death penalty, and also factors that influence the implementation of death penalty on corruption. As a conclusion, the writer points out that overcoming the act of corrupt which refers to an extraordinary crime has been regulated in law of Indonesian Number 31 years 1999 juncto law number 20 year 2001 as an. Effort to solve the corruption. The threat of death penalty which becomes the hardest penalty is settled as a sort of main criminal based om article 10 substantive of law. Moreover, the discussion of death penalty in law number 31 year 1999 juncto law number 20 year 2001 about counter-corruption, is also stated in article 2 verse (2), however its implementation depends on the requirement indicated in the law. Last but not least is the substantial factor that impedes the implementation of the death penalty which points out the lack of seriousness of legislative members in formulating the sanction of dead penalty as stated in law number 31 year 1999 juncto law number 20 year 2001, which indeed prevent the law enforcement to be implemented successfully in Indonesia

Abstract

Proof needed to convince the judge that there has been a criminal offense, after HIR to the Code of Criminal Procedure (Criminal Procedure Code) was added Specification Expert as a form of evidence, in the Corruption MCK Ambon City in 2012, the Prosecutor requested an expert witness of the National Association of Indonesian Consultants (NAIC) Mollucas, to perform calculations MCK building construction Ambon, at the hearing the expert testimony submitted evidently not in accordance with skills, whereas in providing expert testimony at both the investigation and the court should have the skills to enter. The results showed that specification experts given for criminal acts that occure and seek state losses in the corruption of Crime MCK Ambon City, but it turns out experts who testified in the investigation process does not have a certification as a construction expert, and he was not breathing sworn. In the process of the corruption court, the public prosecutor can not bring experts from NAIC Mollucas, and testimony just recited, this shows that the expert testimony can not be used or invalid

Abstract

With the enactment of Law Advocate gave an Advocate for proceeds in this country, becausethe existence of the Advocate has been recognized as one of the law enforcement officers whohad not been enacted or not the enforcement of Law Advocates. Role of Advocates as otherlaw enforcement officers are always considered Advocate at the time as an integral part thatdoes not have a strategic position in the system of law in Indonesia. Position advocate for lawenforcement officers to be not a figment, it is proved by the enactment of Law No. 18 Year2003 on Advocates. In Article 5, paragraph (1) expressly says that "Advocates status as lawenforcement, free and independent and guaranteed by laws and regulations. Pursuant toArticle 5 paragraph (1) of Law Advocates, the advocate should position is equal or equivalentother law enforcement officers (police, prosecutors and judges), but the reality of lawenforcement in Indonesia Advocates have not been treated or respected by other lawenforcement officials as law enforcement officers. This can be evidenced by the presence ofthe Advocate inspected, prosecuted and even convicted for their profession, but in theAdvocates Act clearly and explicitly set the immunities under Article 16 of Law No. 18 Year2003 on Advocate: "Advocates can't prosecuted both civil and criminal in carrying tugsprofession in good faith under on the interests of the defense of clients in court"

Abstract

That moment Religion Court as Section 49 letter (i) Law Number 3 Year 2003 about Religion Court, having absolute authority judge economic case of Moslem law banking included Moslem law Banking, of course this matter give paradigm differ in solving of Moslem law banking dispute compared to before existence of the law (Act No.7/1989). So that the solving of Moslem law banking dispute follow rule Islamic Law among others Jurisdiction (Wilayat Al-Qadla), peace/deliberation (Sulh/Ishlah), and Arbitrase (Tahkim), according to agreement in akad by the parties. This matter because of Moslem law Banking represent economic institution which in its execution use Islamic law principles.

Abstract

Merger as a merger of companies regulated in Act Number 40 of 2007. The arrangement of the merger is also regulated in Act Number 5 of 1999 on the Prohibition of Monopolistic Practices and Unfair Business Competition. Merger is closely associated with the potential for monopolistic practices and or unfair business competition, because it's basically the essence of the merger is the added value of the companies that are merging. Actions such merger should be prohibited and regulated in the law because it can cause negative effects to healthy market competition. Many people who suffer losses potentially caused by the merger, such as minority shareholders, employees, creditors, and other community stakeholders. Setting merger in the legislation is a form of prevention and mitigation activities or mergers that could reduce competition.
