Abstract

Formation regulation must meet the indicator does not contradict the legislation ofhigher and not contrary to public interest. If both indicators are not met in the establishmentof a law, then in the evaluation by the Government, there apabil established law contrary tothe legislation of higher and contrary to public interest, the Government may cancel a legalproduct. Indicators of general interest in the cancellation law is vague norm, because thisindicator is to open a space for the Government to make the interpretation of the meaning ofpublic interest norms. Very complex public interest, public interest is not always to beunderstood as a national interest, regional interest may also be the public interest because itincludes all interests in the communal areas. Interest means the area of interest to allindividuals in the region as a whole.

Abstract

In a country like power organization, decentralization is one form of devolution orsharing of authority (power) between the central government and local administrations (localgovernment). Understanding local government may have a double meaning state localgovernment based on the principle of deconcentration, and local self / autonomousgovernment, decentralization leads to Devolution of power. The decentralization policyshould always united with the objectives to democratize governance, strengthening nationalintegration, empowering local communities, respect for diversity, and increased socialwelfare. The four main objectives of decentralization, namely in the fields of economics,politics, administration and culture. In the field of economic decentralization can reduce costsand ensure more effective service (on target). In the political sphere, decentralization developgrassroots democracy, reducing the abuse of power by the center, and will satisfy localpsychologically because given the trust to administer their own affairs. This is wheredecentralization is expected to prevent national disintegration. In the field of administration,decentralization cut rail tape bureaucracy and decision-making more effective. In the field ofsocial and cultural decentralization and develop diversity and appreciate the local culture.

Abstract

Morally required all states to respect, uphold and protect the rights of women. Oneform of women's rights is a guarantee to protect in accordance with religious values andhumanitarian as well as Pancasila and destination country listed in the 1945 Constitution. But until this moment women's right can't be applied to case of violance on women, especially in Maluku. The majority of women will not know their rights. Even if the female community, not many people demanding the fulfillment of these rights in the country. Abstract

This paper aimed to understand the factors inhibiting legal protection for the moral rights of the author from free internet downloading and causes for difficulties in punishing downloading from internet. Eventhough Indonesia has the copyright’s act since 1912, but until today the infringement of  copyrights be on increase. People can get all they need which they want to hear or they want to read from internet downloading. For example, Asosiasi Industri Rekaman Indonesia (ASIRI) shown that the authors lose a lot of money because of free internet downloading. According to Asosiasi Rekaman Indonesia-ASIRI’s estimate that Indonesia was lose Rp 762.000.000.000,- a year because of free internet downloading. The factors inhibiting legal protection, for the moral rights of the authors from free internet downloading include the authors’ lack of understanding on their own moral rights, and the lack of appreciation in free internet downloading. The dispute resolution faces difficulties in deciding the punishment, for free downloading from internet, since the police have no accurate understanding on the Act No 28/2014 about Copyrights. In addition, the creators must be more active to file their complaints, despite the fact that the infringement of moral copyrights is categorized as ordinary delict in the Act No 28/2014, whenever they find out that their creation are offered for free download without their written permission.  The author must play more active role as they are supposed to know better the originality of their creation.

Abstract

international law as rules of law relating to individuals and non-state bodies, the rights and obligations that turned out to be important for the international community is international trade. International trade in general evolve towards freer trade and open. The presence of the World Trade Organization (WTO), and cooperated with other trade cooperation such as AFTA, APEC, even in the current developments in the region such as the AEC, resulting in world trade pushed towards freer trade and open. Trade through forms of cooperation, it is also cultivated free from unfair business practices so that it can evolve into a more conducive climate, therefore, to anticipate these developments, in addition to the use of a means of protection which are public, business people should also carry out protection in ways that are self-protection as business interests through contract law. The principle of freedom of contract as provided for in Article 1338 of the Civil Law Consequences to bring new contract models that were previously unknown in treaty law in Indonesia. Abstract

armed conflict or war often brings its own problems for women and girls, where women are always used as a means of impingement biological desire of the perpetrators of war. Internationally there are several recorded cases bring the dark history for women, for example Akayesu case, Furundzija case. Partizan cases, Foca-Yugoslavia also to witness how the women were abused her self-esteem. Universal Declaration of Human Rights (UDHR) which is the foundation of all human rights norms are universal, in preamble set recognition of the equality of human dignity. All of it is the foundation of freedom, justice and peace in the world. Article 7 of the Convention rights-civil and political rights states that everyone has the right to freedom from torture, treatment or punishment or Punishment cruel Inhuman and Degrading. Indonesia then ratified through Law No. 5 of 1998 and Act No. 39 of 1999 on Human Rights. By ratifying these provisions, then Indonesia is bound by the legal norms and by itself is a part of national law. based on the law, it is for the completion of each issue of human rights violations established national human rights commission

Abstract

In particular the problem of crime committed by juveniles is usually referred to as delinquency and how efforts to overcome a complicated issue. This is because the crime or criminal offenses committed by the many factors that contribute and influence the behavior of the youth. Associated with criminal behavior committed by adolescents and a violation of legal norms and social. Thus, from the standpoint of criminal politics and global macro, then the non-penal efforts and strategic occupy key positions in tackling the causes and conditions that give rise to crime. Therefore tackling juvenile crime with criminal approach must be grounded.
