Abstract

This research aims to determine the legal implications of the agreement on which the sharia banking dispute resolution clause was submitted through the state court's post-decision of the Constitutional Court No. 93/PUU-X/2012. The research method used normative research with a statute approach and a conceptual approach and analyzed descriptive qualitative. The results of the study show that the contract that contains the clause for the settlement of Islamic banking disputes through the District Court after the Constitutional Court decision has the implication of being null and void because it contradicts the contract or causa that is lawful, so that the parties make an addendum so that no future disputes occur.

Abstract

This study aims to determine the consumer protection system containing legal certainty and transparency of information and access to information. This study is normative, a study that examines the legal provisions of positive law and legal principles. The data used are secondary data, data obtained through library research and research tools for obtaining secondary data obtained through the study of documents. The results show that the picture is not clear that information obtained by the public in the case of infant formula reflects that the system of consumer protection provisions contained in the Consumer Protection Act can’t be realized the government and the level of knowledge/education is uneven between urban communities and suburban/rural . As such, it needs continuous efforts in fostering a critical attitude to the public on the quality of food products so as to encourage the creation of an attitude of prudence consuming public in terms of food products, and the Government should have good communication skills with the public as consumers.

Abstract

outsourcing sebagai mahluk Tuhan Yang Maha Esa yang juga memiliki hak asasi. Salah satu bentuk hak asasi pekerja kontrak adalah mendapatkan jaminan untuk dilindungi sesuai dengan nilai-nilai agama dan kemanusiaan serta pancasila dan tujuan Negara yang tercantum dalam UUD 1945. Perlindungan terhadap pekerja dimaksudkan untuk menjamin hak-hak dasar pekerja dan menjamin kesamaan kesempatan serta perlakuan tanpa diskriminasi atas apapun untuk mewujudkan kesejatraan pekerja dan keluarganya dengan tetap memperhatikan perkembangan kemajuan dunia usaha dan kepentingan pengusaha. Peraturan perundang-undangan yang terkait dengan perlindungan bagi pekerja yakni Undang-Undang no 13 Tahun 2003 tentang ketenaga kerjaan dan peraturan pelaksana dari perundang-undangan dibidang ketenagakerjaan.

Abstract

Dalam pembagiannya subjek hukum Perdata terdiri atas manusia (naturlijkperson) dan badan hukum (rechtperson). Tetapi dalam perkembangannya, ternyata pemerintah yang adalah lembaga publik dapat juga melakukan tindakan hukum perdata, hal ini dapt dibuktikan dengan terlibatnya pemerintah sebagai salah satu pihak dalam kontrak pengadaan barang atau jasa. Berdasarkan hasil penelusuran ternyata bahwa, ketika pemerintah bertindak dalam lapangan keperdataan dan tunduk pada peraturan hukum perdata, maka pemerintah bertindak sebagai wakil dari badan hukum bukan wakil dari jabatan, sehingga tindakan pemerintah tersebut adalah tindakan badan hukum.

Abstract

Sense of security, order and peace is a basic requirement in the life of a people a very close relationship with law enforcement process. Process of law enforcement in the area of customary law community unit as in the countries of the Moluccas should be understood as a unit which can’t be separated from their culture. Role of Institutions Latupati be one of the institution of customary law (adat institution) which is a cultural identity of indigenous people in Maluku in the resolution of conflicts between countries. Awareness of the legal sistem in fact is at the core of the culture of a community. For those reasons, the existence of latupati institutions need to be maintained and enhanced as an instrument of social control of society, so that the future of this institution is able to contribute to process of law, especially in sub Leihitu.

Abstract

Organisational culture is important when faced with efforts to improve organizational performance and employees therein. Many people do not realize that a work keberhsilan rooted in those values originated from the customs, habits, religious and other rules into confidence and then became a habit in people's behavior in carrying out the work. The values that have become a habit is called culture. Because culture is associated with higher levels of quality work, then called the culture of work culture, both inside and outside the organization. In connection with the professional values espoused, the employee should be adaptive to changes in the value of organizational culture. Attitudes toward the organization's culture becomes more meaningful in accelerating or slowing down of this adaptive ability. If employees have individual values that conflict with organizational culture, this suggests a low level of effectiveness, and vice versa. In this case there should be clear how the fact that employee attitudes towards the prevailing organizational culture. If an employee shows a good attitude towards the organization's culture, it is expected to easily form an organization of social behavior.

Abstract

Direct contact in the provision of services provide great opportunities happening maladministration practice (failure to provide service). Therefore, it needs an effort to minimize or even eliminate the practice maladministration by utilizing information and communication technology (ICT) in the frame of electronic-government to service delivery, so that direct contact between service providers and service users no longer occur. In Indonesia, the opportunity for that already exist with the issuance of Presidential Instruction No. 3 of 2003 on National Policy and Strategy Development of electronic-Government (electronic- Government framework), with the aim of supporting the change to democratic governance, facilitating communication between central and local governments, ensure the implementation of the principles of good governance, and facilitating the transformation towards an information society.

Abstract

The national development faster and rapidly, often requires the state to make the arrangement in all areas including land use that requires people to surrender their land to the State for use for the public interest. Industrial park development, highway construction, agriculture, plantation, mining and so on are some of the basic legitimacy of the state used in the takeover of customary rights of indigenous peoples. With the enactment of Act Number 32 Year 2004 on Regional Autonomy which generally contains the enforcement of the implementation of the handover of authority to the state's right to control local government district or city. In this regard it with the enactment of regional autonomy which is the state's right to control the delegation of authority in the area of land to local governments, local governments should be able to run the authority, especially in the area of land with due regard to the interests of local communities indigenous people themselves in the territory of the Republic of Indonesia
