Abstract

The beginning of Indonesia’s independence period was marked by the enthusiasm of the ulama in reformulating Islamic laws after previously Islamic law had been “castrated” by the Dutch. In this paper, the author wants to show the efforts of the Indonesian ulama and government in formulating Islamic law (especially family) to be used as a general benchmark for all Religious Courts in the archipelago. Of course, their efforts to formulate Islamic law are not as easy as turning the palm of their hand, because there are contradictions and differences of opinion. However, the emergence of the 1974 Marriage Law, and then its refinement with the KHI (Compilation of Islamic Law) became a success in itself for the Indonesian government and ulama’ to unite their voices on the issue of Marriage, Endowments and Inheritance. On the other hand, the existence of efforts to renew the KHI through the CLD (Counter Legal Draft)-KHI shows that some groups are dissatisfied with the KHI formulation. However, their efforts were in vain because they were considered to be contrary to Islamic teachings and were finally recorded by the Ministry of Religion.

Abstract

Ontology explains the nature of everything that exists. In the study of ontology, understanding human nature involves not only comprehending it in actual human terms but, in terms of essence, humans are seen as beings of Monodualism, consisting of two elements yet forming a unity within. Nasr, with his traditional approach, attempts to elucidate the essence of human beings by critiquing the ideologies of the modern world that currently encompass human life. This research is conducted through a literature review, utilizing a descriptive-analytical approach. Sayyed Huseen Nasr consistently ties his discussions to the texts of the Quran and Hadith. Nasr asserts that the essence of human beings cannot be separated from the intervention of God. Thus, the contribution of Nasr's thoughts regarding the concept of human nature in its relevance to morality is that humans are actually related to divine nature and provide direction to the morality of the nation's leadership. In this way, it is possible to create a state of law, not a state of power, in the implementation of state administration.

Abstract

This research discusses compliance with sharia principles which is an absolute requirement that must be implemented by financial institutions that implement sharia principles. This research uses descriptive qualitative methods. The results of the research show that the implementation of the Mudharabah  contract product at BMT UM Sarolangun Regency is said to be in accordance with sharia compliance standards, considering the results of the analysis regarding implementation at BMT UM Sarolangun Regency in KHES article 248 regarding for contract implementation and is confirmed by the opinion of the sharia supervisory board that implementation in the contract Mudharabah  at BMT UM Sarolangun Regency is in accordance with sharia compliance through analysis carried out by the supervisory board using general and internal regulations. Regarding the distribution of results, if it is concluded from the previous discussion, it can be said that the BMT UM Sarolangun Regency is in accordance with Sharia Compliance. If you look at the Compilation of Sharia Economic Law, among other things, article 236 regarding the percentage of distribution of business results is stated as clear and certain.

Abstract

Interdisciplinary research is becoming a major focus in academic science and policy. Islamic Studies has adopted this approach, especially in addressing social issues such as gender, environment, and pluralism. Although controversial, interdisciplinary research in Islamic studies is considered essential for understanding the complexity of life and solving the problems of this age. This research is a literature study that describes the dynamics of the interdisciplinary approach in Islamic studies, including its obstacles and projections. Descriptive analysis is used to get the right and appropriate results to answer the existing problem formulations. Data collection is carried out systematically and structured by using literature and data relevant to the topic of the interdisciplinary approach in Islamic studies with the dialog of the concept of challenges and prospects. In Islamic studies, the interdisciplinary approach has received attention due to the complexity of religious phenomena. However, cognitive barriers arise from epistemological differences and difficulties integrating concepts, while intellectualism barriers are related to methodological conflicts, personal disagreements, and language factors. Awareness and collaborative efforts are needed to overcome these barriers in developing interdisciplinary research in Islamic studies. Interdisciplinary approach in Islamic studies is increasingly relevant in the face of the complexity of contemporary issues. It is important to maintain consistency with Islamic principles and understand the religion from various perspectives. Although there are pros and cons to this approach, interdisciplinary research can overcome cognitive barriers and intellectualism. Awareness and support for interdisciplinary cooperation is key to advancing this research.

Abstract

This article examines the saweran tradition of reciting the Qur’an using the Tafsir Maqāṣid approach initiated by Abdul Mustaqim. The tradition of saweran against Qur'ānic reciters is usually done by pelted, and even tucked with money into the clothes of a reciter who is chanting the holy verses of the Qur'ān by spectators or worshippers. This is widely found in an event commemorating Islamic holidays. In QS. al-A'rāf [7]: 204 it has been explained that when the Qur'ān is recited, listen and listen so that you understand the verses it contains and take the lessons it conveys. Based on this verse, the commentators agreed to prohibit the transfer of money to the readers of the Qur'ān for various reasons, but when viewed in terms of the overall opinion of the commentators leads that the tradition of saweran towards the Qur'ānic reciter is not in accordance with the rules in listening to the Qur'ān. However, by using the Tafsir Maqāṣid approach the results of the interpretation are not only limited to prohibiting the recitation of the Qur'ān, but also produce the main intention or message behind the QS. al-A'rāf [7]: 204. If viewed from  the Maqāṣid, namely ḥifẓ al-Dīn, ḥifẓ al-Māl, ḥifẓ al-Nafs, and ḥifẓ al-Dawlah Saweran tradition against the Qur'ānic qāri’  has the potential to tarnish the sanctity of Islam and the glory of the Qur'ān and its readers, like to show off wealth (flexing), degrading the dignity of a Qur'ān qāri’ , and including sexual harassment.

Abstract

The recent phenomenon of flexing has become a hot topic, with not only influencers and YouTubers showcasing and flaunting their wealth but also the general public, including those in religious circles, being affected by flexing behavior, such as viralizing humanitarian and charitable activities. This has impacted the sincerity of those almsgiving or giving charity, resulting in both positive and negative consequences in their behavior. This research aims to analyze how Islam views the flexing phenomenon by exploring the meanings of open and hidden attitudes in giving charity in Surah Al-Baqarah [2]:271, using a qualitative method with a Ma’nā-cum-Maghzā approach. It dissects several aspects, including the Quranic perspective on the flexing phenomenon, principles of giving charity, limitations in displaying charity, and extracting the Maghzā from Surah Al-Baqarah [2]:271 related to the flexing phenomenon. The results of this research demonstrate that flexing behavior can lead to negative attitudes such as showing off (riyā’) and also motivations that can inspire the general public in the online world. Thus, there is a shift in meaning in Surah Al-Baqarah [2]:271, suggesting that while hidden charity is preferred (as a historical meaning), openly giving charity can also have virtues as long as it adheres to ethical principles in giving charity (as Maghzā).

Abstract

Matchmaking is a practice that has precedents in Islam. It is widely practiced by the community in an effort to marry off children to someone who is considered to be well known. However, many of these arranged marriages lead to negative outcomes in the form of domestic violence due to the difficulty in adjusting to a new person who is not personally known, counseling theory becomes the main focus in efforts to understand and handle this problem. Utilizing a counseling approach, this article investigates the relationship between disagreement in arranged marriages and increased risk of domestic violence. Through a literature review, case studies, and theoretical analysis, the article discusses counseling strategies that can be used to ease tensions in an arranged marriage relationship and prevent its escalation into domestic violence. In conclusion, counseling theory opens up space for a deeper understanding of the dynamics of arranged marriage and domestic violence, while providing practical guidance for effective counseling interventions in this context.
