Abstract

Legal reforms carried out by Islamic countries since the beginning of the 20th century starting with Turkey in 1917, then Egypt (1920 and 1929), Jordan (1951), Syria (1953) and Tunisia in 1956 with the publication of the Code of Personal Status Law or Majallah al-Ahwal ash-Syakhsiyah. Then several countries in Asia such as Indonesia Malaysia and others. The material of family law reform in general is about marriage registration because it did not exist at the time of the prophet or the companions and the classical fiqh books. If reviewed, marriage registration has positive values for the sake of order and convenience in this modern era. This research is a library research that examines legal issues by relying on secondary materials, analyzing and then concluding using the theory of legal modernization. In this paper, the author tries to classify the provisions of marriage registration based on three sides, the law of marriage registration, sanctions and registration mechanisms in various Muslim countries and identify the extent to which some Islamic countries depart from the teachings of classical fiqh in reforming family law. The regulation of marriage registration is different in every Muslim country, some of which strictly enforce it so that it determines it as a crime for violators or only makes registration as an administrative requirement, while in terms of the mechanism it is also applied differently in each country.

Abstract

Biological relations between husband and wife are an obligation and one of the factors of harmony in the household, in Islam it has been regulated in detail about this matter, one of which is regarding the husband's invitation to his wife to have sex has been regulated by naṣ shar'i both in the Qur'an and hadith, in the hadith narrated by Abu Hurairah the prophet once said that the wife who refuses the husband's invitation to have sex will be cursed by the angels. Many internal and external Muslims consider this hadith as a form of misogynistic and marital rape behavior. This paper seeks to address this feminist speculation as a misogynistic hadith. The research method used is descriptive-analytical technique with a normative-sociological approach and library research that examines in more depth the meaning of the naṣ hadith in question from the books of hadith experts as well as the views and ideas of the scholars regarding the hadith through takhrij hadith so that its quality and validity in fiqh are known. The results of this paper cite the view of the hadith scholars, the husband does not have full power over his wife, she can refuse her husband's invitation if she is sick, tired, menstruating and others, and the opposite applies that the husband must fulfill his wife's invitation if there is no urgent reason that allows him to refuse his wife's invitation to have intercourse, because the fulfillment of biological rights in the household is an obligation for both husband and wife.

Abstract

The recommendation to get married is clearly explained in the naṣ shara', but in reality at this time many teenagers who are considered mature and ready to get married are reluctant to get married and prefer to delay being single. This phenomenon has recently become widespread and is used as a principle by many teenagers in various parts of the world to Indonesia and is known as waithood. In the context of millennial adolescents today, the reasons that become factors for choosing waithood are so diverse that it is interesting to study and review their correlation with Islamic studies and gender issues. This research is a library research with a normative-sociological approach by analyzing the phenomenon of the idea of waithood through gender studies and Islamic law. The results of this study indicate that there are many factors, concepts and goals of waithood carried out by millennial adolescents today that contradict Islamic principles which clearly recommend getting married immediately if you are able and there is a connection to gender issues in the case of women who prefer waithood to not getting married, as well as gender inequality which is being called for by the UN program Transforming Our World: The 2030 Agenda for Sustainable Development which is not only on the issue of roles in marriage but even on many other factors so that the shift in the meaning of marriage and the decision to have children is no longer considered an obligation, but a choice that can be made by women

Abstract

Matchmaking is a practice that has precedents in Islam. It is widely practiced by the community in an effort to marry off children to someone who is considered to be well known. However, many of these arranged marriages lead to negative outcomes in the form of domestic violence due to the difficulty in adjusting to a new person who is not personally known, counseling theory becomes the main focus in efforts to understand and handle this problem. Utilizing a counseling approach, this article investigates the relationship between disagreement in arranged marriages and increased risk of domestic violence. Through a literature review, case studies, and theoretical analysis, the article discusses counseling strategies that can be used to ease tensions in an arranged marriage relationship and prevent its escalation into domestic violence. In conclusion, counseling theory opens up space for a deeper understanding of the dynamics of arranged marriage and domestic violence, while providing practical guidance for effective counseling interventions in this context.

Abstract

The role of the Marriage Registration Officer (PPN) is considered very important in the KUA agency because marriage is a sacred event in order to protect the dignity and sanctity, especially of women and aims to provide legal certainty and control over personal interests and social life of the community, therefore it needs to be recorded and it becomes a valid requirement for marriage for the state as Paragraph 2 Article 2 of Law No. 1 of 1974 concerning Marriage. However, in the implementation mechanism, marriage registration officials in Indonesia have only focused on men, and it is questionable whether women can also carry out this task considering that in reality today there are equal rights and obligations between women and men in various spheres of social life. In this case, some people think that Indonesia and several other Islamic countries still do not apply gender equality in their social life which has been applied in several Islamic countries such as Morocco, Egypt and Turkey. The research method used in this research is descriptive-analytical techniques and library research and uses a gender and comparative studies approach that focuses on comparing legal systems and practices in various countries to understand the differences and similarities in the acceptance and implementation of the role of women as Marriage Registrar Employees. The results of this study are the values that motivate some Islamic countries not to make women as marriage registrars such as different madhhabs or different views on the concept of gender in several Islamic countries.
