I’tiqadiah: Jurnal Hukum dan Ilmu-ilmu Kesyariahan, P-ISSN: 3062-8016; E-ISSN: 3063-0371 diterbitkan oleh Yayasan Baitul Hikmah al-Zain Tapanuli Selatan. I’tiqadiah bertujuan untuk menjadi platform peer-review dan sumber informasi resmi mengenai studi hukum dan ilmu-ilmu Kesyariahan. Ruang lingkup I’tiqadiah adalah literatur analitis, obyektif, empiris, dan kontributif terhadap dinamika dan perkembangan ilmu hukum dan ilmu Kesyariahan khususnya di Indonesia. Abstract

This research aims to comprehensively examine the relationship between da’wah and fardhu kifayah in Islam, as well as to identify the central role of da’wah in revitalizing the values of these collective obligations in the lives of individuals and society. The study uses a qualitative method with a library research approach, which involves in-depth analysis of authoritative sources such as the Qur’an, Hadith, fiqh books, and writings of classical and modern scholars .The results of the discussion show that da’wah is a broad concept that not only functions as a means of spreading Islamic teachings but also as a spiritual guide, character builder, driver of social change, balancer of injustice, unifier of community solidarity, and promoter of civilization. Meanwhile, fardhu kifayah is a collective obligation based on the principles of mutual cooperation and public interest (maslahah), which includes not only religious worship but also social, economic, and cultural issues. The role of da’wah in revitalizing the values of fardhu kifayah is realized through the dissemination of knowledge, the development of social awareness, the formation of an active attitude, the organization of networks and institutions, monitoring and evaluation, and the use of modern technology. Without da’wah, the values of fardhu kifayah tend to remain merely theoretical, while with effective da’wah, these values can come alive as culture and behavior, enabling the Muslim community to fulfill its role as a middle community (ummatan wasatan) that brings truth and goodness.

Abstract

Divorce constitutes a legal event that carries significant juridical and social implications for family life. In Indonesia, the practice of divorce conducted outside the Religious Court is still found within society, particularly among Muslim communities, despite the normative provisions stipulated in Law Number 1 of 1974 on Marriage, which explicitly mandate that divorce may only be effected before a court of law. This study aims to analyze the legal and social consequences of divorces carried out outside the Religious Court within the framework of the national legal system. Employing a normative legal research method with statutory and conceptual approaches, this study is supported by an extensive review of legislation, court decisions, and doctrines of Islamic family law. The findings indicate that divorce for Muslim couples is legally valid only when it is pronounced through a decision of the Religious Court. Nevertheless, in social practice, divorces conducted outside the Religious Court—either unilaterally or through oral agreements between the parties—remain prevalent. Such practices generate complex implications. From a juridical perspective, divorces conducted outside the court lack legal force, resulting in the marriage status remaining administratively valid, which in turn complicates the fulfillment of civil rights, including the division of marital property, inheritance rights, and the issuance of divorce certificates. From a social perspective, this condition has the potential to give rise to stigma, discrimination, and socio-economic vulnerability, particularly for women and children. Furthermore, from the standpoint of state administration, out-of-court divorces create obstacles in civil registration processes and weaken legal protection mechanisms for children. This article underscores the urgency of law enforcement and the enhancement of public awareness regarding legally valid divorce procedures in accordance with Indonesian law in order to ensure legal certainty, the protection of women’s and children’s rights, and orderly state administration.

Abstract

The rapid development of artificial intelligence (AI) has increasingly influenced various aspects of social life, including religious practices among Muslim communities in Indonesia. The use of AI in religious contexts—such as Islamic question-and-answer applications, automated sermon and khutbah generation, religious text translation, and digital worship assistants—has raised normative and ethical debates regarding its legitimacy and legal boundaries within Islamic law. This article aims to examine the response of Islamic law to the use of artificial intelligence in religious practices in Indonesia by focusing on normative and ethical considerations. The study employs a qualitative normative–critical approach through document analysis of fatwas, contemporary scholarly opinions, relevant digital technology regulations, and previous research findings on AI and religion. The analysis is conducted using the frameworks of uṣūl al-fiqh and maqāṣid al-sharīʿah to assess the compatibility of AI applications with the fundamental principles of Islamic law. The findings indicate that Islamic law is generally receptive to the utilization of AI as a supportive tool in religious practices, provided that it does not replace scholarly authority, undermine core theological principles, or generate social and religious harm. Nevertheless, the use of AI in religious contexts requires clear normative boundaries and ethical oversight to prevent the erosion of religious meaning and scholarly legitimacy. This study underscores the need for an adaptive and critical Islamic legal framework to address the challenges posed by artificial intelligence in contemporary Indonesian religious life.

Abstract

Development of a modern period and globalization have increased various social interaction. Such interaction may vary from free sex to unregistered marriage to cover disgrace. The status of children resulted in unregistered marriage is not clear in society whether they are legitimate or not, especially in terms of inheritance. There are three laws of inheritance prevailing in Indonesia, each has advantages and disadvantages, as well as different purpose. This research proposes to reveal the status of children resulted from unregistered marriage in accordance with the Indonesia positive laws, and that according to Islamic Law. This research is a legal research. The approach used is the statutory approach by reviewing the laws related to the inheritance of unregistered marriage, and comparative approach by comparing two existing inheritance laws in Indonesia, that is civil law and Islamic law. Children from unregistered marriage Have the same position as legitimate children in Indonesian law Nevertheless, there are two things that make difference, that is in term of identity and in inheritance, children from unregistered marriage Have the same position and part of inheritance as legitimate children, provided that the children have been authorized. While in Islamic law, children from the unregistered marriage and legitimate marriage have the same position although they have not been authorized. In both perspectives, marriage should be registered and get a certificate, otherwise, the children are categorized as those of outside marriage. So that, without recording a child’s identity, that children considered outsider child.

Abstract

Family mediation constitutes an alternative instrument for resolving domestic conflicts that emphasizes a dialogical and reconciliatory approach rather than rigid litigation procedures. This study aims to analyze the position of family mediation from both normative and psychological perspectives by examining the relevant legal regulations and their implications for the mental well-being of the parties involved. Normatively, the research is grounded in Law Number 1 of 1974 as amended by Law Number 16 of 2019 on Marriage, Law Number 23 of 2004 on the Elimination of Domestic Violence, and Supreme Court Regulation Number 1 of 2016 concerning Mediation Procedures. From a psychological standpoint, mediation is viewed as capable of reducing tension, enhancing communication, and maintaining the continuity of family relationships. The findings indicate that family mediation has the potential to serve as a humane dispute resolution mechanism; however, its effectiveness remains constrained by limited legal awareness, a lack of professional mediators, and insufficient psychological protection for vulnerable parties. Strengthening regulatory frameworks and integrating psychosocial support are therefore necessary to ensure that family mediation functions as an adaptive and equitable legal instrument.

Abstract

Premarital counseling serves as both a legal instrument and an educational medium to prepare young couples for family life. Within the framework of Law Number 1 of 1974 as amended by Law Number 16 of 2019 on Marriage, marriage is regarded as a sacred bond that requires physical, mental, and spiritual readiness. This study aims to analyze the effectiveness of premarital counseling in shaping the preparedness of young couples from the perspective of family law. The research employs a normative-juridical method with a descriptive-analytical approach through the examination of statutory regulations, legal literature, and documents related to the implementation of premarital counseling programs in Indonesia. The findings indicate that premarital counseling contributes to enhancing young couples’ understanding of rights and obligations, conflict management, and child protection. However, its implementation still encounters challenges in terms of accessibility, curriculum standardization, and public legal awareness. Therefore, premarital counseling needs to be strengthened both regulatory and substantively to function effectively as a legal instrument in fostering harmonious and equitable families.

Abstract

Domestic violence constitutes a complex social and legal issue as it involves emotional, relational, and normative dimensions. Litigation-oriented approaches often generate further consequences in the form of family disintegration and deeper psychological trauma for both victims and perpetrators. Therefore, restorative justice is regarded as a relevant alternative in addressing domestic violence cases. This study employs a normative legal approach by examining statutory regulations, legal literature, and mediation practices oriented toward reconciliation. The analysis reveals that restorative justice has the potential to enhance victim protection while maintaining the continuity of family functions, although its implementation continues to face normative and structural challenges. Accordingly, the integration of family law values with restorative justice principles may offer a more humane, equitable, and relationship-oriented solution without neglecting the rights of victims.
