MUASYARAH: Jurnal Kajian Hukum Keluarga Islam aims to serve as an academic discussion ground on the development of Islamic Family Law and gender issues. It is intended to contribute to the long-standing (classical) debate and to the ongoing development of Islamic Family Law and gender issues regardless of time, region, and medium in both theoretical or empirical studies. Abstract

Artikel ini mengkaji harmonisasi hukum Islam dan tradisi lokal dalam praktik perkawinan dan pewarisan di komunitas Muslim Indonesia, dengan fokus pada wilayah Pekalongan, Batang, dan Pemalang. Menggunakan pendekatan kualitatif berbasis studi literatur, penelitian ini menganalisis interaksi antara syariat Islam dan adat Jawa, seperti upacara siraman dalam perkawinan dan sistem pewarisan bilateral atau matrilineal. Temuan menunjukkan bahwa akulturasi ini menghasilkan praktik yang memperkaya nilai spiritual dan sosial, namun juga menghadapi tantangan berupa konflik nilai, pengaruh modernisasi, dan ketimpangan gender. Solusi seperti pendidikan agama yang inklusif, dialog antara ulama dan tokoh adat, serta pendekatan hukum fleksibel seperti takharrūj dan musyawarah keluarga terbukti efektif dalam menjembatani syariat dan adat. Penelitian ini menegaskan pentingnya pendekatan kontekstual untuk memastikan relevansi hukum keluarga Islam di tengah keragaman budaya Indonesia, sekaligus merekomendasikan studi lanjutan untuk memperkuat harmonisasi ini.

Abstract

: Marriage for Muslims is something that is very sacred and has a sacred purpose and cannot be separated from the provisions stipulated by Islamic law. The existence of customary marriage regulations between one indigenous community and another, with differences in these customary regulations, often resolves inter-customary marriages into protracted problems. Sako Village, Rambutan District, Banyuasin Regency has Sako Village Regulation Number 05 of 2014 concerning the Existence of Traditional Law Communities and the Compilation of Sako Village Customs. In one of the chapters discussing traditional marriages, the village regulations explain that there are 2 types of marriage feelings, one of which is "Evil Rasan". "Rasan Evil" Traditional Marriage is a form of marital deviation that occurs in Sako Village, Rambutan District, Banyuasin Regency. This research uses a qualitative approach method with the type of field research (Field Research). This study was carried out by interviewing informants in the field regarding the "Rasan Evil" traditional marriage mechanism from the Maqashid Syariah perspective and the primary data sources used were the results of interviews with informants in the field, and also secondary data sources such as books, journals, mass media, and related regulations regarding marriage. The research results show that the "Evil Rasan" Traditional Marriage is caused by 2 things, namely First, it is based on the "Pull" from the Maqasid Syariah perspective, in this case the aim is to protect offspring (hifdz an-nasl). Second, based on being pregnant out of wedlock, when viewed from the Maqashid Sharia perspective, this traditional marriage is not in accordance with the objectives of Sharia law.: Marriage for Muslims is something that is very sacred and has a sacred purpose and cannot be separated from the provisions stipulated by Islamic law. Abstract

Among the obligations that must be fulfilled by a father or husband within the family structure is providing maintenance for those under his responsibility, including his wife and children. Both Islamic law and positive law firmly regulate the provision of maintenance. Furthermore, failure or deliberate neglect by a father to provide maintenance may be legally pursued through the religious courts. This article analyzes Islamic Law and Positive Law regarding nafkah mahdiyah (post-divorce maintenance) in Decision Number 328/Pdt.G/2018/Pa.Gsg, with the aim of examining how the judge’s decision reflects justice based on Islamic law and positive law. This study employs a documentation research method, supported by library research facilities. The approach used is a normative juridical approach, aiming to synchronize the existing legal provisions in the protection of legal norms and other regulations. The findings show that, in deciding nafkah mahdiyah cases, Indonesian judges harmonize Islamic law and positive law. According to Islamic law, a husband is obligated to provide maintenance to his wife during the iddah period. In positive law, this obligation is regulated under Article 156 letter (d) of the Compilation of Islamic Law (KHI), which mandates former husbands to provide maintenance. Judges consider the husband's financial ability and the evidence presented in court, referring to both Sharia norms and positive legal provisions to render a fair and proportional decision.
