Abstract

Standar Pelayanan Minimal Desa adalah ketentuan tentang jenis dan mutu pelayanan yang merupakan urusan desa yang berhak diperoleh setiap masyarakat desa secara minimal. Desa Wates masih banyak masalah yang menghambat penyelenggaraan Standar Pelayanan Minimal Desa secara optimal. Beberapa masalah tersebut antara lain adalah keterbatasan, informasi, anggaran, sarana, dan prasarana desa. Pelayanan publik memiliki peran penting dalam administrasi pemerintahan dan tata kelola yang baik. Hal ini terkait dengan implementasi Undang-Undang Nomor 30 Tahun 2014 dan Peraturan Menteri Dalam Negeri Republik Indonesia Nomor 2 Tahun 2017 tentang Standar Pelayanan Minimal Desa. Kepala Desa, sebagai pelaksana Standar Pelayanan Minimal Desa, memiliki tanggung jawab utama dalam memastikan bahwa pelayanan yang diberikan kepada masyarakat sesuai dengan ketentuan peraturan. Rumusan Masalah : 1) Bagaimana Peran Kepala Desa  Berdasarkan Peraturan Menteri Dalam Negeri Republik Indonesia Pasal 14(a) Nomor 2 Tahun 2017 Tentang Standar Pelayanan Minimal Desa Prespektif Fiqh Siyasah Tanfidziyah? 2)Bagaimana pandangan Fiqh Siyasah Tanfidziyah terhadap Peran Kepala Desa  Berdasarkan Peraturan Menteri Dalam Negeri Republik Indonesia Pasal 14(a) Nomor 2 Tahun 2017 Tentang Standar Pelayanan Minimal Desa Prespektif Fiqh Siyasah Tanfidziyah? Metode penelitian yang digunakan adalah penelitian lapangan (field research) yang bersifat deskriptif kualitatif. Data yang digunakan adalah data primer yaitu data yang diambil secara langsung, dan data sekuder diambil dari Buku, Skripsi,Tesis, Disertasi, Jurnal, Berita atau artikel Online. Hasil Penelitian ini Kepala Desa Wates telah melaksanan Pasal 14(a) Nomor 2 Tahun 2017 Tentang Standar Pelayanan Minimal Desa dengan menyediakan kemudahan pelayanan administrasi untuk semua warga yang dapat diakses secara online maupun offline, dan memperbaiki dan merawat fasiltias yang ada di desa yaitu fasilitas Kesehatan, Fasilitias Digital, Serta Fasilitas umum desa lainnya. Kepala Desa Wates dalam pemenuhannya sejalan dengan tugas kepemimpinan sesuai dengan prinsip-prinsip siyasah tanfidziyah dengan memberi petunjuk dengan benar, menjalankan keadilan, dan bertanggung jawab terhadap masyarakat desa yang dipimpinnya, sesuai dengan ajaran Islam.        Kata Kunci  : Kepala Desa, Standar Pelayanan Minimal Desa, Siyasah Tanfidziyah

Abstract

MUI Fatwa No. 1 of 2004 concerning Interest states that mu'amalah is not permitted using Conventional Banks because there is an Interest system in Conventional Financial Institutions and the practice of interest is haram. Fundraising zakat by BAZNAS Bandar Lampung City in practice is known to use Conventional Banks which are used in collecting zakat. This is contradictory and gives rise to speculation among the public because there is a discrepancy between the fundraising mechanism at BAZNAS Bandar Lampung City and the MUI fatwa No.1 of 2004. This research is field research with a descriptive qualitative approach. Data sources come from primary data and secondary data. The results obtained in this research are: First, the fundraising mechanism for zakat funds is carried out directly, namely muzaki go directly to the BAZNAS / UPZ office and indirectly, namely through transfers to bank accounts, including using conventional banks. This was done because of the existence of an MoU with the Bandar Lampung City Government in optimizing the collection of ASN zakat, the regulations of which are carried out by Regional Banks, and Commercial Banks are used to facilitate and target Muzakki who are not familiar with Sharia Banks, Commercial Banks are used only as a channel for zakat/UPZ (zakat collection unit), deposited and managed by Sharia Bank account. Second, the use of conventional banks in collecting zakat carried out by BAZNAS Bandar Lampung City from the perspective of sharia economic law based on findings and facts that occur in the field and based on maslahah murlah may be done because there are benefits and maslahah for many people (not problems for the interests of one group or certain individuals) and reject harm in order to maintain the goals of shara' (maqashid shari'ah)

Abstract

This study examines the potential of zakat as an economic instrument that can enhance the welfare of the Muslim community if managed properly according to Sharia principles. In practice, zakat's collection, management, and distribution should comply with religious guidelines to be used productively as a community fund source. However, current zakat management faces challenges, such as the use of conventional banks for zakat collection, distribution that is more consumption-oriented, and a management process that is not yet effective. This research was conducted at BAZNAS in Bandar Lampung City using a descriptive qualitative approach. The results show that the use of conventional banks by BAZNAS is solely as a zakat collection medium, not as a manager, and is considered compliant with Sharia economic law, referencing Ibn Asyur's maqashid shari'ah, as it provides broad benefits. As an official zakat management institution in Bandar Lampung, BAZNAS strives to manage zakat by government regulations to improve community welfare through distribution models that include consumptive and productive empowerment approaches.

Abstract

The enactment of Law Number 6 of 2014 concerning Villages and Law Number 23 of 2014 concerning Regional Government gives villages the right to regulate their regional affairs. In increasing the village's original income, the village government has the right and authority to widely utilize village wealth. Regarding village income sources, efforts to mobilize resources to develop the people's economic potential will increase people's productivity, so that the productivity of both human resources and natural resources around the people can be increased. In this research study, the formulation of the problem is how the strategy for increasing village original income has an impact on the community's economy and how siyāsah māliyah reviews this strategy. The aim of this research are to find out how the strategy of increasing village original income has an impact on the community's economy and how siyāsah māliyah views this strategy. The type of research used in this research is field research, where this research was carried out by interviewing staff at Sumber Agung Pekon, Ngambur District, Pesisir Barat Regency. Data analysis was carried out qualitatively, processing data analysis using descriptive analysis methods, namely discussions based on general thought patterns and then concluded in specific terms. The research results show that the strategy to increase village original income which has an impact on the community economy in the Sumber Agung area, Ngambur District, Pesisir Barat Regency is by establishing village-owned business entities, developing beach tourism, and also having village markets. The conclusion from the results of this research is that the strategy to increase village original income which has an impact on the economy of the community in the Ngambur area has made a contribution, although not much. Siyāsah māliyah's review of the increase in original village income which has an impact on the economy of the community in the Sumber Agung District of Ngambur is in accordance with the principle of benefit, namely prioritizing the interests of the people rather than the interests of the individual.

Abstract

Peraturan Menteri Sosial Nomor 1 Tahun 2018 Tentang Program Keluarga Harapan (PKH) merupakan program bantuan pemerintah berupa bantuan sosial bersyarat yang diperuntukan kepada keluarga miskin sebagai penerima manfaat PKH. Penerima manfaat PKH adalah masyarakat miskin dengan kriteria seperti ibu hamil/menyusui, keluarga miskin yang memiliki anak berusia 0 sampai 5 tahun 11 bulan, memiliki anak dalam masa belajar (SD sampai SMA sederajat), lansia serta penyandang disabilitas berat. Terbentuknya PKH merupakan upaya dalam mempercepat penanggulangan kemiskinan yang bertujuan untuk mengurangi angka dan memutus rantai kemiskinan. Kabupaten Ogan Komering Ulu Sumatera Selatan khususnya desa Bandar Agung Kecamatan Lubuk Batang, merupakan salah satu desa yang telah mengimplementasikan PKH sejak tahun 2014. Namun, bantuan PKH ini banyak menimbulkan berbagai macam kesenjangan sosial dalam masyarakat akibat bantuan PKH yang dirasa kurang tepat sasaran dan tidak merata sampai dengan dugaan adanya campur tangan aparatur desa dengan kepentingan pribadi sehingga banyaknya penerima manfaat PKH dari kalangan masyarakat yang dirasa kurang tepat. Tujuan dari penelitian ini adalah untuk mengetahui apakah masyarakat di Desa Bandar Agung adalah masyarakat yang memang layak mendapatkan bantuan tersebut sesuai dengan Pasal 4 Peraturan Menteri Sosial Nomor 1 Tahun 2018 serta untuk mengetahui bagaimana peran dari Aparatur Desa dalam menentukan batasan-batasan penerima PKH di Desa Bandar Agung di tinjau dari Siyasah Tanfidziyyah. Penelitian ini merupakan penelitian lapangan (Field-research), dan bersifat deskriptif analisis. Hasil penelitian menunjukan bahwa Peran Aparatur Desa dan Pengimplementasian Peraturan Menteri Sosial Nomor 1 Tahun 2018 Tentang Program Keluarga Harapan di Desa Bandar Agung masih kurang sesuai. Hal tersebut dikarenakan adanya kesenjangan sosial yang terjadi dikalangan masyarakat karena penentuan penerima manfaat PKH yang kurang tepat sasaran, disebabkan kurangnya koordinasi panitia PKH dengan aparatur desa yang kurang baik sehingga data yang didapat bukanlah data yang sesuai dengan kondisi ekonomi masyarakat saat ini.

Abstract

This study explores the 'Goes to Campus, School, and Islamic Boarding School' initiative by KPU Bandar Lampung aimed at enhancing political engagement among Gen Z and Millennials. By strategically targeting university students, pesantren, and high school students, KPU recognizes the unique challenges and opportunities each demographic presents in fostering a culture of civic responsibility. The effectiveness of these outreach efforts is analyzed through various methods, including interactive workshops, community engagement, and collaboration with local leaders. This paper discusses the importance of early political education, emphasizing how engaging young people in discussions about governance, democracy, and electoral processes can lead to informed voting behaviors in the future. Additionally, it addresses challenges such as political apathy and varying levels of awareness among students, proposing tailored strategies to overcome these barriers. The findings suggest that KPU's multifaceted approach not only prepares young individuals for participation in elections but also cultivates a lifelong habit of civic engagement. Ultimately, the initiative serves as a model for similar efforts across Indonesia, contributing to a more politically active and informed citizenry in the democratic landscape. The implications of these findings highlight the importance of sustained engagement and innovative outreach in promoting electoral participation among youth.

Abstract

Abstract: This research explores Generation Z’s perspectives on early marriage through the lens of Maqashid Syariah. The study reveals that most members of Generation Z oppose early marriage, considering it an obstacle to personal growth, education, and economic stability. However, some still view it as a viable option under certain conditions, particularly in relation to economic and cultural influences. From a Maqashid Syariah standpoint, early marriage has diverse implications. Concerning hifz ad-din , it should be approached with adequate mental and spiritual preparedness to avoid potential harm. In terms of hifz an-nafs , the physical and psychological health risks, especially for women, are significant considerations. Regarding hifz al-aql, interrupted education due to early marriage can negatively impact an individual's future prospects. From the hifz an-nasl perspective, insufficient readiness to raise children may affect the well-being of future generations. Lastly, in the aspect of hifz al-mal, financial instability among young couples often results in economic hardship. This study offers crucial insights for policymakers and scholars in developing preventive measures against early marriage in alignment with Maqāṣid Syariah principles. It emphasizes the need to consider not only religious teachings but also the broader socio-economic consequences in decision-making. Abstract

Among the obligations that must be fulfilled by a father or husband within the family structure is providing maintenance for those under his responsibility, including his wife and children. Both Islamic law and positive law firmly regulate the provision of maintenance. Furthermore, failure or deliberate neglect by a father to provide maintenance may be legally pursued through the religious courts. This article analyzes Islamic Law and Positive Law regarding nafkah mahdiyah (post-divorce maintenance) in Decision Number 328/Pdt.G/2018/Pa.Gsg, with the aim of examining how the judge’s decision reflects justice based on Islamic law and positive law. This study employs a documentation research method, supported by library research facilities. The approach used is a normative juridical approach, aiming to synchronize the existing legal provisions in the protection of legal norms and other regulations. The findings show that, in deciding nafkah mahdiyah cases, Indonesian judges harmonize Islamic law and positive law. According to Islamic law, a husband is obligated to provide maintenance to his wife during the iddah period. In positive law, this obligation is regulated under Article 156 letter (d) of the Compilation of Islamic Law (KHI), which mandates former husbands to provide maintenance. Judges consider the husband's financial ability and the evidence presented in court, referring to both Sharia norms and positive legal provisions to render a fair and proportional decision.

Abstract

This teacher cooperative has a minimum loan of Rp. 500,000 and a maximum loan of Rp. 10,000,000. In this cooperative system, the interest rate is 10% according to the loan with a repayment period of 10 months. Whereas in Islam forbids interest in every human activity. Ulama here have their own opinion regarding the law of saving and borrowing money in the Simpang Sender Village, OKU Selatan Regency. The role of the Ulama in society is very strong, their opinion will be taken into consideration in the community. This research is a type of field research, and is descriptive in nature. Primary data sources were obtained directly from the research site using the direct interview method with Nahdathul Ulama figures and savings and loan cooperatives in the Simpang Sender Village. Secondary data sources come from several sources, namely journals, books, and the internet related to this research, the data are analyzed qualitatively. Based on the results of the study, it can be concluded that the implementation of saving and borrowing money in the Simpang Sender Village Teacher Cooperative is like cooperatives in general, the funds used to provide loans are the savings funds of members who are members of the cooperative. All members registered in this cooperative are teachers, each member is required to save a minimum of Rp. 10,000 and a maximum of Rp. 100,000. Whereas the views of Nahdatul Ulama figures regarding the practice of Saving and Loans in the Simpang Sender Village Teacher Cooperative have not fulfilled the conditions permitted in Islamic law, where there is still 10% interest in repaying loans paid in installments by members at a time period of 10 months, the interest paid is pay monthly installments of 1% for 10 months.Keywords: cooperative, saving and borrowing money, Nahdatul Ulama figures

Abstract

Growth and economic development are very closely related. Economic growth is an important indicator in carrying out economic development in a country. Some economists pay special attention to capital as one of the factors that influence economic growth. One of the efforts that can be made by the government in encouraging economic growth is to seek capital or sources of financing, one of which is through investment both domestically and abroad. Like other developing countries, Indonesia relies heavily on investment to support the financing of its economic development, both through foreign and domestic investment. Islam strongly recommends investment from both a non-economic and an economic point of view. Viewed from an economic point of view, investment is a commitment to sacrifice funds in a definite amount at the present time to gain the profits in future, of course, with the guidance of the Shari'a. Investment activities are part of Muamalah activities that are permissible unless there is an implication of the argument from the Qur'an and al-Hadith which prohibits it either explicitly or implicitly.Keywords: Investment, Development Islamic Economics, and Economic Growth
