Abstract

A creative work is a work produced by a creator, while a creator can be defined as an individual who, individually or collectively, produces a creation based on expertise, imagination, skills, proficiency, and various other elements that are expressed in a tangible form. In its application, Copyright is vulnerable to disputes due to limited regulations and the lack of certainty regarding the subject matter involved. In this regard, Intellectual Property Rights disputes in Indonesia can be resolved through two mechanisms: litigation, which involves the role of the courts, and non-litigation, namely dispute resolution conducted outside the court through arbitration and other institutions. The laws governing the settlement of Intellectual Property Rights disputes can be found in Law No. 31 of 2000 concerning Industrial Designs and Law No. 32 of 2000 concerning Layout Designs of Integrated Circuits. Furthermore, Law No. 13 of 2016 concerning Patents, Law No. 20 of 2016 concerning Trademarks, and Law No. 28 of 2014 concerning Copyright explicitly stipulate that disputes relating to intellectual property fall under the jurisdiction of the Commercial Court.

Abstract

The need for legal certainty in society is reflected in the increasing number of agreements executed in the form of authentic deeds prepared by Notaries. The presence of Notaries as public officials or public officers serves as a response to every citizen’s need for legal certainty. Such legal certainty is manifested through contractual documents in the form of Notarial Deeds, which possess authentic status and full evidentiary force. However, when a Notary commits violations in carrying out their duties and authority, the deed may experience a degradation of its evidentiary value, resulting in its status being reduced to that of a private deed or even being declared null and void by law. This study employs a normative legal research method with a descriptive approach, aiming to analyze the causes of the degradation of the evidentiary value of Notarial Deeds and its legal consequences for the protection of civil rights. The degradation of the evidentiary value of authentic deeds may occur due to violations of formal requirements in the process of preparing the deed. Such violations continue to occur in practice, indicating vulnerabilities in the performance of Notaries’ duties and offices and potentially affecting legal certainty and legal protection for the parties concerned.

Abstract

This study aims to analyze the protection of women's rights from a human rights perspective and to examine its implementation within the framework of Indonesian legislation. The research employs a normative juridical method using statutory, conceptual, and human rights approaches. The data were collected through library research involving primary, secondary, and tertiary legal materials. The findings indicate that the protection of women's rights has been firmly established through the 1945 Constitution of the Republic of Indonesia, Law Number 39 of 1999 on Human Rights, Law Number 7 of 1984 concerning the Ratification of the Convention on the Elimination of All Forms of Discrimination Against Women (CEDAW), Law Number 23 of 2004 on the Elimination of Domestic Violence, Law Number 12 of 2022 on Sexual Violence Crimes, and other related legislation. These legal instruments have provided a comprehensive framework for protecting women's rights in various sectors. Nevertheless, their implementation has not yet achieved optimal effectiveness due to persistent patriarchal culture, limited public legal awareness, restricted access to justice, and weaknesses in law enforcement. Strengthening the protection of women's rights requires harmonized legal regulations, improved capacity of law enforcement officers, enhanced victim protection services, and broader education on human rights and gender equality to ensure effective and equitable legal protection.
