Abstract

Out-of-court dispute resolution, known as Alternative Dispute Resolution (ADDR), offers a more flexible, efficient, and cost-effective solution compared to formal litigation. ADRs include mechanisms such as mediation, conciliation, and arbitration, which enable parties to reach agreements more quickly and constructively without going through lengthy court procedures. In the Indonesian context, ADRs serve to reduce the caseload in courts, increase the efficiency of the legal system, and maintain relationships between parties through dialogue that prioritizes deliberation and consensus. However, challenges such as a lack of public understanding, limited expertise, and the relatively high cost of arbitration remain major obstacles to ADR implementation. This study uses a descriptive qualitative approach to analyze the advantages, challenges, and effectiveness of ADRs in the Indonesian legal system. The results indicate that ADRs can be an effective solution for dispute resolution, but require strengthening regulations, institutional capacity, and public education to increase their success.

Facing increasingly complex market competition, traditional retail businesses must develop marketing strategies that not only retain loyal customers but also attract new ones. This research adopts a descriptive qualitative approach, using observation, interviews, and documentation for data collection. The findings reveal that personalized customer approaches, flexible pricing, friendly service, and strategic location usage are key factors in sustaining the competitiveness of Madurese grocery stores. The study concludes that appropriate and contextual marketing strategies can strengthen MSMEs amidst the rise of modern retail outlets.

Abstract

This article examines the dialectics of judicial review of laws and regulations in Indonesia from the perspective of authority and effectiveness, with a particular focus on the Constitutional Court Decision Number 30/PUU-XVI/2018 and the Supreme Court Decision Number 65 P/HUM/2018. The research aims to analyze the classification and characteristics of judicial review, the mechanisms and institutional authority involved, and the legal implications arising from differences in review models exercised by the Constitutional Court and the Supreme Court. This study employs normative legal research using a statutory approach and a case approach. Primary legal materials include the 1945 Constitution of the Republic of Indonesia, statutes governing judicial authority, and relevant court decisions, supported by secondary legal materials from scholarly literature. The analysis is conducted qualitatively through deductive legal reasoning. The findings indicate that the dualism of judicial review authority, while normatively intended to maintain hierarchical order of norms, in practice generates potential disharmony in legal interpretation and weakens legal certainty. Differences in review orientation—constitutional-based review by the Constitutional Court and legal-formal review by the Supreme Court—may result in fragmented implementation of constitutional norms. Therefore, strengthening constitutional supremacy and harmonizing judicial interpretation between both institutions are essential to ensure consistency, effectiveness, and protection of constitutional rights within Indonesia’s legal system.

Abstract

This study aims to determine how social behaviour affects the emergence of online motorcycle taxi technology and the legal protection of online motorcycle taxi drivers vis-à-vis their online transportation partners. The method used in this study is normative with a legislative approach. Legal materials were collected through literature study and then analysed prescriptively. The results of the study show that the influence of online motorcycle taxis has had a significant impact on people's behaviour, both economically and socially. Online motorcycle taxi drivers still receive occupational safety protection by registering as participants in the Employment Social Security Agency (BPJS Ketenagakerjaan) through the Swadaya Proteksi programme organised by online transportation service providers. With this, service providers are not obliged to provide BPJS facilities.
