Abstract

This study examines the role of the State Administrative Court (PTUN) as a judicial control mechanism for the State Administrative Decree (KTUN) issued by the Regent of Magetan, particularly regarding the ratification and appointment of Village Heads elected through the E-voting system. Technological innovation in the Village Head Election in Magetan Regency, which should have increased efficiency and accountability, instead triggered disputes due to unresolved technical "irregularities and problems", resulting in the Surabaya PTUN Decision Number 31/G/2024/PTUN.SBY. Through normative legal research with a law-in-books approach, the analysis was conducted using Lawrence M. Friedman's legal system theory. The results of the study show that, in terms of Legal Structure, the lawsuit to the PTUN proves its function as a corrective institution against executive discretion. In terms of Legal Substance, this dispute tests the legality of the Regent's KTUN against the principles of LUBER JURDIL and the General Principles of Good Governance (AUPB), especially the principles of accuracy and professionalism. The systematic failure of e-voting has the potential to create procedural and substantive flaws, making the State Administrative Court (KTUN) inconsistent with substantive law and the AUPB. From a legal cultural perspective, the lawsuit by the losing candidate demonstrates the public's high level of legal awareness in demanding a clean democratic process. Regional governments are obligated to improve e-voting regulations and system quality.

Abstract

This article discusses forestry crimes, specifically the prevention and eradication of forest destruction, with a focus on Decision Letter Number 454/Pid.B/LH/2023/PN Spt. The purpose of this paper is to identify the types of forestry crimes and analyze dispute resolution mechanisms based on these cases. The method used is normative legal research, involving the review and analysis of applicable laws and regulations and legal practices. The results show that forestry crimes, such as illegal logging and document falsification, are regulated by Law Number 18 of 2013. The case analyzed illustrates how invalid forest product certificates can result in strict criminal sanctions. The High Court upheld the previous decision, demonstrating that the legal system functions to uphold justice. In conclusion, preventing forestry crimes requires a holistic approach involving strict law enforcement, community empowerment, and inter-agency collaboration. Success in eradicating forest destruction will depend on public legal awareness and firm enforcement.

Abstract

Land acquisition for public interest is a crucial instrument in national infrastructure development. This study examines the regulation and implementation of compensation in land acquisition based on the principle of public interest, using the construction of the Joglo Flyover in Banjarsari District, Surakarta City as a case study. This study uses a juridical-sociological approach and is analyzed using Lawrence M. Friedman's legal system theory, which encompasses three elements: legal structure, legal substance, and legal culture. The study shows that structurally and normatively, land acquisition has been regulated in detail through Law Number 2 of 2012, the Job Creation Law, and its derivative regulations. However, implementation in the field shows obstacles in the legal culture aspect, such as disagreements over compensation values ​​and a lack of public trust in the appraisal process. This reflects the need for synergy between formal legal and social approaches to ensure substantive justice. This study recommends strengthening deliberation mechanisms, taking compensation values ​​into account the socio-economic aspects of residents, and the importance of building a participatory legal culture to support a just and sustainable development process.

Abstract

Political parties in Indonesia play a crucial role in nominating regional head candidates through the issuance of recommendation letters based on each party’s (AD/ART). However, this practice frequently leads to disputes because the regional election process itself is strictly governed by Law Number 10 of 2016. This study examines the legal status of these recommendation letters within the state administration system and assesses whether internal party decisions can be subjected to litigation at the State Administrative Court (PTUN). The analysis focuses on Padang PTUN Decision Number 21/G/2015/PTUN-PDG, in which a lawsuit against a recommendation letter issued by the Gerindra (DPP) was rejected for failing to meet the legal criteria of a State Administrative Decision (KTUN).Using a normative juridical approach, this study finds that internal party decisions are inherently private because they are made by organisational administrators based on internal regulations rather than by public officials executing governance. Consequently, party recommendation letters fall outside the absolute competence of the PTUN, which only possesses the jurisdiction to review concrete, individual, and final actions derived from statutory authority. This paper highlights the tension between political party autonomy, as stipulated in Law Number 2 of 2011, and the need for public legal certainty. Therefore, disputes related to candidate recommendations must be resolved through the internal Party Court (Mahkamah Partai) first to ensure local democratic processes continue without disrupting state administration.

Abstract

The purpose of this article is to explore the conflict between basic human rights principles and the death penalty policy applied to corruption perpetrators in Indonesia. One of the human rights principles is the right to life, which is guaranteed by various international conventions. Therefore, this paper can focus on whether the death penalty is properly implemented and whether the sanctions imposed provide a deterrent effect or actually create injustice. The method used in this paper uses a normative juridical study that focuses on applicable legal norms, both written and unwritten, in an effort to understand and analyze legal issues. The results of the discussion are that the death penalty for corruption perpetrators in Indonesia is regulated by Law No. 20 of 2001 concerning Amendments to Law No. 31 of 1999 concerning the Eradication of Corruption. Although the death penalty can be imposed under certain conditions, its application faces controversy related to human rights violations, particularly the right to life. In addition, the imbalance between state losses and sanctions imposed, as well as international pressure from the UN to abolish the death penalty, pose challenges in implementing this policy. The conclusion shows that the death penalty is difficult to determine because Article 2 paragraph (2) of the Corruption Law states that the death penalty can be imposed if the crime of corruption is committed under certain circumstances, which refers to situations that make the crime of corruption more serious, such as corruption committed in emergency situations or natural disasters.

Abstract

This study examines the Jakarta Administrative Court Decision Number 285/G/2024/PTUN.JKT regarding the validity of the Bawaslu Chairperson's decision to impose employee sanctions as a follow-up to the Election Organizer Honor Council (DKPP) decision. The research method used in this study is a normative juridical research method. The results of the study found that the implementation of ethical decisions is indeed the authority of the Bawaslu chairperson but must still comply with the provisions of state administrative law and the principles of good governance. The panel of judges considered that the sanction decision in this case did not fully comply with procedures and limits of authority, so it can be tested and overturned by the PTUN. This decision emphasises that the implementation of ethical sanctions must uphold the principle of legality while protecting the rights of election organisers. In conclusion, the Bawaslu Chairperson does have the authority to impose employee sanctions as a follow-up to the DKPP ethical decision, but this authority must still be exercised in accordance with the provisions of state administrative law. Bawaslu's recommendations include clarifying and standardising the mechanism for implementing DKPP decisions, strengthening coordination with the DKPP, and ensuring that all personnel sanctions are implemented in accordance with the principles of legality, transparency, and protection of election organisers' rights to prevent similar disputes in the future.

Abstract

Village infrastructure development plays a crucial role in improving community welfare, yet it often faces obstacles in the land acquisition process. This study aims to analyze the application of the public interest principle in land acquisition through a case study in Wadas Village, Central Java. The method used was a desk study, reviewing relevant laws and regulations and literature. The study results indicate that although land acquisition is legally regulated, its implementation still generates conflict due to a lack of public participation and information transparency. The case in Wadas Village reflects community resistance to development projects due to concerns about environmental and social impacts. In conclusion, the application of the public interest principle must prioritize justice, transparency, and participation so that development does not compromise community rights.

Abstract

Asas kepentingan umum merupakan salah satu asas yang krusial dalam hukum positif di Indonesia. Kasussertifikat ganda di Tambun, Bekasi, menjadi contoh nyata lemahnya implementasi Asas Kepentingan Umum dalam praktik pertanahan. Kasus ini menyoroti permasalahan dimana kepemilikan Sertifikat Hak Milik (SHM) yang sah tidak selalu menjamin kepastian hukum bagi pemiliknya. Metode penelitian yang digunakan adalah studi kepustakaan. Hasil penelitian menunjukkan bahwa penerapan asas kepastian hukum dalam kasus sertifikat ganda seringkali tidak terlaksana dengan baik, yang berakibat pada kerugian dan ketidakadilan bagi pemilik SHM. Penelitian ini menyimpulkan bahwa penyelesaian kasus sertifikasi ganda memerlukan kejelasan dalam prosedur penyelesaian sengketa, konsistensi dalam pengambilan keputusan oleh Badan Pertanahan Nasional (BPN) dan pengadilan, serta penegakan hukum yang tegas terhadap pelanggaran.

Abstract

The management of Hazardous and Toxic Materials (B3) waste is highly urgent in maintaining environmental sustainability and public health, and is part of the constitutional rights of Indonesian citizens. This study aims to analyze the implementation of the principle of legal certainty in B3 waste management, with a case study of the agreement between PT Honda Precision Parts Manufacturing and PT Cipta Jaya Hakiki. The method used is a juridical-normative method with a literature study approach to relevant laws and regulations. The results of the study indicate that B3 waste management in Indonesia has been regulated through Law No. 32 of 2009 and Government Regulation No. 22 of 2021, which require official permits for every business entity involved. However, in practice, legal violations were found because PT Cipta Jaya Hakiki did not have an official permit but continued to carry out B3 waste management activities based on a power of attorney from PT Lut Putra Solder. This creates a legal flaw in the agreement involving elements of naturalia and accidentalia, and violates the principles of legality and legal certainty. This study recommends that the government strengthen supervision, enforce legal sanctions strictly, and provide education and verification to business actors to ensure compliance with regulations. Thus, hazardous waste management can be carried out legally, responsibly, and sustainably.

Abstract

This study aims to analyze the implementation of the Regional Spatial Planning (RTRW) policy based on the principles of sustainable development and to identify the inhibiting and supporting factors in its implementation. This study uses a normative legal research method with a statute approach and a case approach, supported by a literature review based on laws and regulations, books, official documents, and previous research findings. The results indicate that the implementation of the RTRW policy plays a strategic role in supporting sustainable development through efficient land use regulation, environmental protection, and the integration of socio-economic aspects into the spatial planning process. However, the implementation of this policy still faces several obstacles such as conflicts of interest between parties, lack of coordination, and low public participation in the planning and decision-making process. Meanwhile, influential supporting factors include infrastructure development in accordance with the spatial plan and the improvement of regional economic sectors, such as mining, which impacts Regional Original Income (PAD). Based on the analysis, it is concluded that the successful implementation of the RTRW based on sustainable development depends heavily on the synergy between the government, the community, and the private sector in achieving a balance between economic growth, environmental preservation, and sustainable social welfare.
