Abstract

This paper aims to explain the Mu'tazilite perspective on their perception of the Sunnah as the second source of law after the Qur'an. To achieve this, the author employs a library research method to understand the development of Mu'tazilite thought regarding the use of the Sunnah. The research findings show that the Mu'tazilah do not reject the Sunnah as a whole but rather question the legal authority of hadith Ahad (single transmission hadith). The implications of this research suggest that it is essential for every Ahl al-Sunnah to view Mu'tazilah as a school that uses the Sunnah, albeit with different interpretations. Understanding this, it is advisable for hadith scholars not to be averse to the works of the Mu'tazilah.

Abstract

This article aims to reexamine the foundational perspectives of Sunni and Shia views on Hadith. The main focus is on the Shia doctrine, which includes the infallible sayings (qaul ma'shum) of the Imams as part of the 'Prophetic' Hadith, which can be considered truthful. The occurrence of these sayings in key Shia Hadith texts is also notably problematic in number. In contrast to the sayings directly attributed to the Prophet or Ali, these collections are predominantly filled with the sayings of the sixth Imam, Ja'far al-Sadiq. Hence, the article discusses how robust this concept is when compared with the more widely accepted stance of the majority (jumhur).

Abstract

Polygyny, as a marital system, has a long history that differs across cultures. Before the advent of Islam, polygyny was practiced by various ethnic groups, including the Hebrew and Arab peoples during the Jahiliyah period. In addition, there were also "Salafiyun" ethnic groups, now represented by countries such as Russia, Latvia, the Czech Republic, and Yugoslavia, as well as parts of Germany and England. The practice of polygyny in the Jahiliyah era, or before the time of Prophet Muhammad, was widespread and unrestricted in terms of the number of wives. During the time of Prophet Muhammad, Islam not only allowed monogamous marriages but also permitted polygyny with a maximum limit of four wives. In contrast, those who reject polygyny in Islamic law often argue that it conflicts with gender equality principles or serves as a protest against the practice of free sex. This study aims to explain the concept of polygyny in Islam, its historical evolution from era to era, and the establishment of polygyny during the time of Prophet Muhammad. It also explores the wisdom of Islamic law regarding polygyny and provides a comparison with the Western notion of free sex, which rejects polygyny due to gender equality concerns.

Abstract

The rejection of al-Sunnah (Inkar al-Sunnah) is a movement that has been recorded in the history of the development of Hadith. One of the factors that led to the emergence of this movement was the political differences among Muslims, which caused them to split into several sects. Among these sects, those who held views different from the majority of Sunni scholars are referred to in Hadith tradition as al-mubtadi' (innovators), and the Khawarij’s views are one of the opinions among these sects. This paper aims to discuss the views of the Khawarij, who rejected the Sunnah after the Battle of Siffin, leading to the denial of the Sunnah that had been established. This article employs a literature survey method related to the subject matter discussed. One of the findings is that the Khawarij initially accepted the Sunnah of the Prophet Muhammad (PBUH) as a source of law, but after the Battle of Siffin, they rejected the Sunnah, refused arbitration (tahkim), and viewed the companions of the Prophet as unreliable (dhu'afa). They did not accept the Hadiths narrated by the companions, except for a few, with interpretations that aligned with their beliefs. This article will explain the Khawarij's response to Hadith, the aspects of Hadith they rejected, and the division of their opposition to Hadith.

Abstract

The study of Qur'anic verses in the classification of qath'iy and zhanniy is known to be not a new discourse. Muslim scientists in the classical era have initiated the discussion of qath'iy and zhanniy within the framework of ijtihad in understanding texts in the contemporary era, the issue of qath'iy and zhanniy, even though their discussion has been preceded in the classical era, it is realized that they still leave room for discussion related to their contextualism rather than simply its dogmative doctrine. From the perspective of scientific authority, for example, there is a view that suggests that the issue of qath'iy and zhanniy is more appropriate to be a discourse on ushul fiqh rather than 'ulum Al-QurÄn and was not one of the subjects of discussion for muftassirin in the process of interpretation. Other than that, According to Imam As-Syatibi, the categorization of Qur'anic verses into qathiy and zhanniy is the ulama's ijtihad which does not have to be viewed dogmatically. So that in terms and applications qathiy and zhanniy must be understood in a more dynamic sense.
