Abstract

Artikel ini membahas masalah hukum perkawinan antar pemeluk agama yang berbeda di Indonesia, terutama setelah penerapan RUU nomor 1 tahun 1974 tentang Perkawinan. Namun dalam diskusi, pernikahan antar agama yang berbeda sulit untuk dilakukan setelah RUU itu berlaku. Karena kurang memadainya penjelasan tentang perkawinan beda agama pada RUU tersebut, beberapa masalah pun kerap terjadi pada interpretasi dan aplikasi. Mengacu pada RUU Perkawinan Bab 2, disebutkan tidak boleh menikah dengan orang yang berbeda agama. Namun, berdasarkan Bill of Marriage nomor 66, ahli hukum menyatakan bahwa ada kekosongan di hukum tersebut, dengan demikian aturan perkawinan beda agama mampu diterapkan. Dengan begitu, perkawinan beda agama dapat diterapkan. Pada kenyataannya, masyarakat Indonesia masih menuntut pemberlakuan nikah antar beda agama. Kesimpulan tersebut dikumpulkan dari banyak pernikahan antar agama yang berbeda dan relatif sulit untuk dilakukan. Oleh karena itu, masalah tersebut perlu mendapatkan solusi.

Abstract

Artikel ini membahas mengenai hukum perkawinan antar suku lain yang bukan merupakan suku batak yang diatur dalam tradisi masyarakat batak yang ada di Indonesia, terutama setelah terjadinya perkembangan di era globalisasi dimana, setiap mereka yang bersuku batak justru ikut melunturkan salah satu yang menjadi tradisi adat batak yang sejak dulu sudah ada. Metode penelitian yang digunakan dalam penelitian ini adalah metode penelitian kualitatif. Hasil daripada penelitian ini mengemukakan bahwasanya ciriciri mereka sebagai orang Batak terutama di daerah Sumatera sudah tidak lagi berpegang teguh pada ajaran gofmatik adat yang telah diperoleh sejak kecil. Kurangnya penanaman budaya asat sejak dini menjadi salah satu alasannya. Prosesi pernikahan yang melibatkan marga kerap kali tidak diindahkan oleh orang Batak yang merantau ataupun tinggal di luar daerah Sumatera karena sudah terpapar dengan beberapa kebudayaan dan perubahan zaman yang ada. Negosiasi yang diciptakan oleh orang Batak dirasa akan berjalan lebih mudah apabila mendapat dukungan lewat komunikasi dan hubungan kekerabatan yang terjalin dengan baik Pemudaran identitas adat dalam diri orang-orang batak secara khusus bagi mereka yang merantau atau tinggal di luar daerah Sumatera bahkan sudah menjadi hal biasa dan bahkan terkesan kuno menurut meraka apabila masi mengikuti tradisi nenek moyang untuk menikah dengan “Halak Hita” atau menikah sesame dengan orang batak.

Abstract

The criminal act of currency counterfeiting is a crime that attacks public confidence in the authenticity of currency, therefore the truth of the currency value must be guaranteed from counterfeiting. Based on the description, the objectives are to find out how the current regulation of counterfeiting and circulation of counterfeit money is, and to find out how to enforce the law against the perpetrators of counterfeiting and circulating counterfeit money. The method used by the author in this study is a normative juridical approach using primary and secondary data collection techniques and data collection tools used through interviews and document studies. The results of this study with the theme of research on the responsibility of the perpetrators of the crime of counterfeiting and circulating counterfeit money. From a positive legal perspective, counterfeiting and circulation of counterfeit money carried out by perpetrators as makers and dealers must have fulfilled the elements in the formulation of Articles 244 and 245 of the Criminal Code. Law enforcement against perpetrators of counterfeiting and circulation of counterfeit money is carried out by law enforcement officers starting from the police, prosecutors and courts in the stages of the criminal justice system in Indonesia which aims to impose penalties on perpetrators of criminal acts of counterfeiting money and prevent and cope with people becoming victims of counterfeiting money, resolving criminal cases and create a deterrent effect for perpetrators of criminal acts of counterfeiting and circulating counterfeit money.

Abstract

Indonesia is a state of law, the basic law for all laws and regulations in Indonesia is the 1945 Constitution of the Republic of Indonesia. In an effort to uphold the constitution and the principles of a democratic rule of law, the Constitutional Court has the authority to examine laws on the 1945 Constitution of the Republic of Indonesia. to find out how the judges of the Constitutional Court considered the decision Number 106/PUU-XVIII/2020 and to find out the impact of the decision. This study uses a normative juridical approach with a descriptive analytical method which will explain the description of the analysis of the data that has been collected. Based on the results of the research on Decision Number 106/PUU-XVIII/2020, it can be concluded that the judge in his decision had careful considerations such as looking at the facts contained in the trial and considering the results of the examination of related parties. The impact of this decision is that the public is prohibited from using class I narcotics for health services. The use of narcotics is only allowed within the scope of the development of science and technology. There is a strong impetus for research on the use of class I narcotics in the government and the private sector.Keywords: Judge's Consideration, Impact of Decision Number 106/PUU-XVIII/2020.

Abstract

Ketertarikan dan kepedulian peneliti terhadap perlindungan anak dalam ranah politik khususnya keterlibatan anak dalam kampanye kepemiluan, maka peneliti ingin mengetahui bagaimana pelindungan hukum terhadap anak dalam masa kampanye saat Pemilu serentak yang dilakukan pada tahun 2019 . Metode Penelitian yang digunakan dalam penelitian ini adalah metode penelitian normatif empiris karena menggunakan kajian secara mendalam, di butuhkan pendekatan UU atau normatif serta pengalaman ataupun pengamatan dilapangan. Bawaslu atau Badan Pengawas Pemilu Kota Samarinda sebagai lembaga pengawas dan sebagai salah satu penyelenggara Pemilu memiliki peranan penting dalam mengawasi keterlibatan anak karena Bawaslulah yang bersentuhan secara langsung dengan berbagai proses pengawasan tahapan Pemilu termasuk kampanye yang terlaksana. Ada berbagai kendala yang dihadapi Bawaslu sehingga dalam menjalankan wewenangnya menjadi tidak maksimal maka langkah yang harus dilakukan Bawaslu dalam mengawasi ketelibatan anak adalah dengan memperkuat sinergitas bersama masyarakat dan Sentra Gakkumdu atau Sentra Penegakan Hukum Terpadu serta menerapkan kampanye yang ramah anak. Bawaslu atau Badan Pengawas Pemilu Kota Samarinda sebagai lembaga pengawas dan sebagai salah satu penyelenggara Pemilu memiliki peranan penting dalam mengawasi keterlibatan anak karena Bawaslulah yang bersentuhan secara langsung dengan berbagai proses pengawasan tahapan Pemilu termasuk kampanye yang terlaksana.

Abstract

Termination of Employment is the termination of the employment relationship between the company and the employee. Severance pay must be given to workers who have been laid off for normal reasons, such as resignation/retirement but in practice there are companies that are not willing to pay severance pay to workers in the Indonesian Borneo Labor Union. The research uses normative juridical sources from legal materials and interviews. The research focuses on the actions of companies that do not pay severance pay. The results show that the company does not pay severance pay because the worker is considered to have resigned unilaterally but what is considered here is related to the company employing workers/laborers over the age of 60 years who should have retired because they avoid unwanted things such as work accidents, the retirement age is regulated in the Permenaker No. 2 of 1995 Paragraph 1 and Paragraph 2, so that the company is obliged to pay severance pay in Article 156. Type It is recommended that the company pays severance pay in accordance with the provisions of Article 167 Paragraph 5, namely Severance Pay in Article 156 Paragraph 2, severance pay in Article 156 Paragraph 3, Reimbursement of Rights Article 156 Paragraph 4 of Law No. 13 of 2003 concerning Manpower in conjunction with Law No. 11 of 2020 concerning Job Creation and implementing the contents of Decision Number: 83/Pdt.Sus-PHI/2015/PN Smr who already have permanent legal force related to the nominal payment of severance pay due to the termination of the law employment interest because the worker/labourer has retired.

Abstract

The legal status of ownership of land rights is as regulated in the basic agrarian law number 5 of 1960 article 7 which reads: "In order not to harm the public interest, land ownership and control that exceeds the limit is not allowed". But what about the legal status of land ownership that extends beyond the boundaries of the Dayak Lundayeh Indigenous community in Berian Baru Village? And what is the obstacle for the government of Nunukan Regency in the context of returning the maximum land limit that exceeds the limit?. The method that the authors use in this study is Empirical Legal research, which is a legal research method using empirical facts arising from human behavior, both verbal behavior obtained from interviews and real behavior carried out through direct observation. The results of the study show that the legal status of land rights ownership of the Dayak Lundayeh indigenous peoples in the village of Berian Baru which exceeds the maximum limit will later be determined by the customary apparatus to be returned to customary land rights or jointly managed land which will benefit the indigenous people themselves. In writing this thesis, the author tries to provide an explanation of the legal status of ownership of land rights beyond the boundaries of the Dayak Lundayeh Indigenous community in Berian Baru Village.
