Abstract

ABSTRACT The objective of the research was to analyze the aspect of legal protection granted by the Civil Code for housing customers against a dispute over land title between a developer and a third party after PJB (Sales Contract) has been made between the customer and the developer. It is concluded, based on the research results and discussions, that the force that binds a PJB made between the developer and the customers when the dispute over land title emerges mostly depends on the form of the deed; whether it is an authentic or underhanded one. It is recommended that the parties involved in the making of the PJB before the Notary really understand the agreed clause so that all contents of the PJB Deed can be known and comprehended by both parties. Abstract

Abstract Certified land right transfer through transact has to be done by public official, PPAT, in an authentic certificate; in this case, AJB (Sales Contract). When the case above is not done through AJB signed by PPAT, the process of transferring title of ownership of the land from the seller and the buyer cannot be processed in the Land Office. The research used juridical normative method on the prevailing law. The result of the research shows that sales contract on certified land drawn up by PPAT and has been revoked by the Court will be illegal and has no legal force to be used as an authentic certificate in sales contract. It cannot be used for a transferring title, from the seller to a buyer, in the Land Office. PPAT is liable for the revocation of the Sales Contract since it was illegal. The liability is in the form of compensation for the harmed party because of the revocation of the Sales Contract by the Court when the harmed party files the complaint to the Court and accepted by the Court as final and conclusive..   Keywords: PPAT, Sales Contract, Revoked by the Court

Abstract

ABSTRACT Coastal Resources Management is intersectoral because marine sector covers the authority of some state institutions which work fields are related to oceans; for example, transportation, tourism and culture, energy and mineral resources, as well as marine and fishery. PT. Mutiara Hitam Pertiwi in Pandeglang, Banten, has set up cottages after buying a piece of land from the society; its purchase was conducted before the Head of Subdistrict. In fact, problems due to the land owner are frequently found. There was abrasion on the land that has decreased the resale value of the land or the cottage. The position of the land with coastal borders which was purchased from the people in Pandeglang Regency, Carita Village, Banten Province, according to the land entitlement, is the letter of notification by the Village Head or what is also called a temporary deed of ownership; which was gained from the people, sold to PT. Mutiara Hitam Pertiwi, managed into cottages and granted HGB (Building Rights). Abstract

ABSTRACT Biak tribe follows patrilineal kinship system which draws line of descent from father side (man). As what occurs in patrilineal system, in inheritance, the adat (customary) law of Biak tribe regulates that only the son who has the right to inherit his parents’ wealth which means that daughters have no right at all. The distribution of inheritance in Biak tribe occurs when a testator is still alive. Biak community follows individual ad collective inheritance system. Both son and daughter get inheritance although the share of the son is more than that of a daughter. When there is a dispute in the adat inheritance, the parties concerned choose the method of settlement by viewing the condition of the conflicting parties. Settlement can be done by negotiation in consanguinity by presenting ‘Mananwir’ or adat leaders or through Adat Biak Council, ‘Kankain Karkara Byak’. Abstract

ABSTRACT Official empowered to draw up land deeds (henceforth he is called PPAT) is an official who helps the National Land Agency (henceforth it is called BPN) as the agency that is responsible for registering land. A PPAT is one of the public officials (ambtenaar) who needs development and supervision in doing his job as an official who empowers to draw up land deeds. The function of developing and supervising PPAT is done by the BPN of Deli Serdang Regency according to legal provisions by directly visiting PPAT offices and not registering the land in the BPN of Deli Serdang in doing its development and supervision. Abstract

ABSTRACT Patumbak is a sub-district which has several Wakaf lands in its villages. Nearly all villages have Wakaf lands such as Madrasah (Islamic schools), mosques, foundations, and graveyards for Moslems. In reality, these wakaf lands are not used properly; some of them are still in the form of uncultivated lands and houses for worship which are empty and neglected; therefore, nazhir (sextons) should actively increase these land productivity. The research problems were as follows: how about the legal provisions on the change of function in which it was not in accordance with the wakaf certificate, how anbout the responsibility of nazhir in wakaf land which had changed its function in Patumbak Sub-district, Deli Serdang Regency, and how about the role of BWI (Indonesian Wakaf Agency) in North Sumatera Province in controlling wakaf lands which had been changed their function in Patumbak Sub-district, Deli Serdang Regency. Abstract

Every giving credit to a debtor, the Bank usually faces the risk of non-performing loan which can potentially cause the loss for the Bank and debtor himself. Therefore, the Bank will decide to give credit when it has really been confident and has analyzed it profoundly. The research used judicial normative and descriptive analytic method. In its implementation, obstacles usually occur, caused by debtors, creditor, and the third party. This research analyzed a case which occurred at PT Bank Sumut, Main Branch Office, Medan, about the auction winner who could not control the auction object. The Bank attempted to do consanguinity approach. When it failed, according to the prevailing regulations, the Bank suggested the auction winner to request for the execution of clearing out to the Head of the District Court by enclosing Auction Letter as the evidence of Auction Winner. Abstract

  ABSTRACT Land registration is important because land registration is the beginning of the birth process of the proof of land ownership. In Clause 19 administer the registration of land in the entire territory of the republic of Indonesia under the terms of which are set by government regulation. This research was a descriptive analytical, with normative juridical approach is research which refers to the theories, norms, the principles contained in the legislation applicable as a normative foundation. Descriptive in this reasearch describe the fact that developed in the community about rights responsibilities of notary certificate (covernote) on the maintenance of housing certificates. In addition to issuing written evidence in the form of authentic act as a notary public officials also made a statement that is often referred to as covernote. Covernote is a letter explaining that the process is still running in the management of the deeds unfinished and facilitate the process of completeness of the credit agreement. Abstract

ABSTRACT According to the adat (custumery) law, martgaging has  an explotation element because the profit received by the man who lands the money is much bigger than the natural interest which should be paid by the land owner. In general, a pledgor is securer in economy than a land owner which indicates feudalism and contrary to UUPA (Agrarian Law). Mortgage of the land owned by the people in Karo District as its object does not meet this law ad has taken more then seven years. Most of the land was controlled by the pledgors while the pledgees never ask the pledgors to return the land to them. The problem of the research were as follws; how about the effctiveness of law in the implementation of mortgaging farmland in karo District, how about the development of the government regulation No. 56/1960 after it was amanded to law No. 1/1961 on determining the area of farmland, and how about legal consequence of the pledgors on farmland under the Ruling of the Supreme Court No.626K/Pdt/2010. Abstract

ABSTRACT In its implementing parate execution, it usually undergoes many obstacles so that it does not protect PT. OTO Multiartha. In fact, according to Law on Fiduciary Collateral, the company is protected by law with fiduciary collateral which has executorial title power. The research used judicial normative method. The data were gathered by conducting library research and interviews in which the materials or data were organized systematically and analyzed by using scientific logical procedure qualitatively. Conclusion From thesis singer is the implementation of parate execution by PT. OTO Multiartha, Medan, on fiduciary collateral which was transferred by debtors to the third party was ineffective because the third party that received and controlled the fiduciary collateral rejected. In this case, legal remedy carried out by PT. OTO Multiartha, Medan, was that it used non-litigation method by performing reconciliation.
