Abstract

Ground plan is one of the documents on allocating a plot of land in Batam, issued by BP Batam (Batam Exploitation Authority). Since there are many vested interests of its holders, its ownership can be transferred which is usually caused by buy and sell. It is found that ground plan, issued by the BP Batam is an administrative requirement in managing land; therefore, it does not guarantee its legal certainty on land ownership. It only provides physical data of the land allocated to an applicant according to the result of surveying. It is recommended that the legal domicile of the ground plan be strengthened by collaborating with the National Land Agency in order to obtain accurate data and avoid the repeated surveying. Abstract

Mixed marriage, according to Law No. 1/1974 on Marriage, is a marriage between an Indonesian and a foreigner and both of them live in Indonesia. In a mixed marriage, both of them have to provide letters and documents which are concerned with the requirements for a mixed marriage according to legal provisions. The research used judicial normative and descriptive analytic method by analyzing legal provisions on marriage in general and mixed marriage in particular. The result of the research shows that a mixed marriage which has incomplete documents is legally defective and vulnerable to be sued for cancelling it to the court by the parties concerned. The Panel of Judges’ legal consideration at the Jakarta District Court in cancelling the marriage between Jessika Iskandar and Ludwig Franz Willibald in the Verdict No. 586/PDT.G/2014/PN Jaksel was that the marriage used illegal documents or it was contrary to legal provisions in mixed marriage so that the judges had reasonable decision to cancel it. Abstract

The different rate of NPOPTKP (Non-Taxable Purchase Value) for the same rate of NPOP (Tax Object Purchase Value) will influence the rate of NPOPKP (Taxable Purchase Value). It will then lead to different rate of BPHTB (Property Title Acquisition Duty) that has to be paid by tax payers. It will certainly bring impacts on the justice principle that has to be strongly held in tax collection. Therefore, a research was done on the rate difference of NPOPTKP in calculating the outstanding BPHTB for inheritors and grant beneficiaries; and, for non-inheritors and non-grant beneficiaries, the fulfillment of justice principle in determining the rate of NPOPTKP for inheritors and grant beneficiaries; and, for non-inheritors and non-grant beneficiaries, and on the fulfillment of legal certainty on the alleviation of outstanding BPHTB to inheritors and grant beneficiaries. Abstract

A marriage with owed dowry in the Islamic law is legitimate when it fulfills all marriage requirements. The obligation of giving dowry is not the requirement in a marriage. An owed dowry does not affect the validity of a marriage, but it has to be given by a husband to his wife. Some factors which cause a husband not to give a dowry to his wife are as follows: first, economic factor in which a man with low income feels that he cannot afford to provide dowry. Secondly, it is a socio-cultural reason in which the value of dowry in the Acehnese culture is a symbol of honor and prestige for both families. For the women’s side, the high value of dowry indicates her social position. Thirdly, a husband’s lack of kno9wledge of dowry; if later on it is paid off, it is by the court’s verdict and not by the husband’s willingness. The Panel of Judges also consider that the complaint about dowry as the result of divorce is a kind of judgment toward the wife by providing protection and increasing a woman’s dignity in getting her right for dowry. Abstract

The Regulation of Bank Indonesia Number 10/181PBI/2008 stipulates the settlement and or restructuring of troublesome financing. In the practice of Syaria Banking, the addendum method is preferable to be applied than to make a new agreement for any changes and or additions to the content of a financing agreement. The problems in this research are what factors that constitute the making of the addendum in solving the troublesome financing at BPR (Rural Bank) Syariah Mustaqim Sukamakmur. How are the mechanisms of adding the content of the agreement carried out by BPR Syari’ah Mustaqim Sukamakmur. Abstract

BPHTB (Duty on Land and Building Right Acquisition) actually has to be payed by taxpayers; in reality, they entrust it to PPAT (official empowered to draw up land deeds) so that PPAT has to be responsible for it. It indicates that it is contrary to law. This thesis would discuss it. The problem is that PPAT entrusts it to another party that is not responsible for paying it. The research problems were as follows: how far the responsibility of PPAT for the BPTB safekeeping was and how far the responsibility of PPAT for the payment of BPHTB was when it was missing. A person who has no responsibility according to regulation or contract and he violates against law, PPAT who entrusts PPHTB can be imprisoned  and can also be imposed a sanction of code of ethics since he violates PPAT Code of Ethics and it is related to writing certificate.   Keywords: Self Assessment, Acquisition of Land and Building, taxpayer

Abstract

Land plots can be one of land disputes because of rapid development of an area so that its sales value will be high. Therefore, if a person wants to buy a plot of land, he has to find out its physical condition, ownership status, and other important documents, and the most important thing is that it is free from dispute.[1] Land title transfer should be made in authentic certificate before a PPAT (official empowered to draw up land deeds). It has to contain the facts and it has to be registered. The validity of legal basis on land certificate is basically the same as land registration. Therefore, the aim of land registration, which used to follow Article 19, paragraph 1 of the Land Act, was merely to guarantee legal certainty. However, based on Article 3 of the Government Regulation No. 24/1997 the purpose of land registration was broadened by settling dispute in the ownership of land plots owned by groups of retired employees of the Department of Forestry in Kampar Regency. Abstract

As a legal entity consisting of the assets that are separated and intended to achieve social, religious and humanitarian purposes, foundation is prohibited to transfer its assets to its bodies. The prohibition, accompanied by criminal sanctions to those who violate it, induced a protest from a foundation manager, Dahlan Pido, who files a request to examine the regulation, leading to Constitutional Court’s Ruling No. 5/PUU-XIII/2015. The research showed that the management of the foundation’s duties and functions are limited as far as the Articles of Association and Law on Foundation allow. Prohibition on fee payment is to ensure that foundation’s assets are used only to reach foundation’s purposes. The research also found that the consideration of the Constitutional Court’s Panel of Judges to deny the request of Dahlan Pido was accurate and in accordance with legal provisions as well as Rights without Subject Theory, Social Purposes Theory and Utility Theory. Abstract

Sales contract on land and building in cash signed by a Notary usually causes dispute because after the contract has been made the seller does not do physicall delivery on the object since he feels that the contract has not yet been made before the real offcial empowered to drow it up. In consequence, the buyer files a complaint ti the court. The problems of the reseach were as follows: how about the legal consequence of making a sales contract on certified land and building, how about the consequence of not continuing to follow up sales contract, and how about judge’s legal consideration in the supreme court’s ruling No.396 PK/Pdt/2014. Abstract

In Law No. 9/2016 on Prevention and Handling Financial System Crisis of Systemic Effect, it is stated that filing for bankruptcy cannot be made by a non-performing Bank because it will affect national economic system, but it can be made by a non-performing Bank which does not have any systemic effect on national economic system. This is one of the indicators of a Bank which can file for bankruptcy in Indonesia. Based on the analysis on the role of Bank of Indonesia when legal standing of filing for bankruptcy by a certain Bank is shifted to the Financial Service Authority, it is necessary to consider the status of the Bank, whether it has systemic effect when it files for bankruptcy or not. The Financial Service Authority can be asked to consider or coordinate with Bank of Indonesia in determining systemic effect of a certain Bank as far as Bank of Indonesia still has its authority in macro-prudentials.
