Abstract

ABSTRACT One of the properties which is commonly bequeathed is land. The problem arises when an heir wants to sell an inherited land he has received from his late father. The land certificate has not been transferred yet; let alone if there is more than one heir. They feel that they have been cheated since it is sold without their knowledge; therefore, they can file a complaint in civil case as it is stipulated in Article 1365 of the Civil Code which states that a person who violates law and harms other people has to compensate the loss. Abstract

ABSTRACT Generally, in the division of inheritance will be settled by deliberation, but if a dispute arises between an heir of the other heirs, then the division of inheritance is will be resolved through the courts As for problems raised in this research is the First: "How the power of a certificate as a proof of land rights registered in the name of an heir, Second: How judge the legal considerations in the decision of religion syar'iah No: 0220 / Pdt.G / 2015 / MS-TKN has fulfilled justice for heirs, Third: How legal remedies on the settlement of inheritance and the presence of one of the heir that inhibit the implementation of the division of inheritance. The Research Methods used were normative juridical. The research result revealed that the position of a certificate as evidence of proof of ownership of land registered in the name of an heir, would have the force of law when there is no denial of the other heirs. With the denial of the certificate, the legal force is becoming weaker. The legal considerations of judges in the Court's Syar'iyah decision has fulfilled justice to heirs based on consideration of the judge and the evidence submitted by the parties, turns out it was revealed that the certificate is based on legally flawed right base. Moreover proved the land on which the cases object is still the Rights of together for the certificate to be canceled. The legal solutions on the settlement of inheritance with one of the heirs that inhibit the implementation of inheritance is pursued through deliberation by all the heirs, if not obtained a settlement, can be through mediation requested assistance from the village and subdistrict heads, if still not obtained the agreement, then the inheritance dispute resolution is pursued through the courts. Abstract

ABSTRACT Adat law on adat land in the Batak Toba community, Samosir Regency, becomes the main attention in scientific measure. Batak Toba ethnic group that reside in Samosir is generally farmers. Therefore, it is undeniable that they have different perspective on land, compared with the other ethnic groups in Indonesia, including legal concept on the State with adat land. Rapid economic development also needs land in economic activity such as buy and sell, let and sublet, and burden of land rights on collateral for the credit so that the longer the time is, the more the need for legal certainty in land rights. The title of the research was “The Problems in the Registration of Adat Land to Become Proprietary Rights without the Approval of all Heirs at the Land Office of Samosir Regency”. Abstract

ABSTRACT Research on the Implementation of Adjustment Articles of Association of Higher Education based on Government Regulation No. 2 of 2013 , aims to determine how the implementation of the adjustment of the Articles of Association of Higher Education Foundation and to know how the legal consequences of Higher Education Foundation His foundation Statutes adjustment in terms of Government Regulation No. 2 of 2013 .  Implementation of the Regulation is expected to provide legal certainty to the establishment and legal status of higher education foundations , and also became controversial for the foundation in running their business , so it does not deviate from the intent and purpose of its establishment . Inconnection with the proposed research in terms of the approach used in sociological termsis juridical . Data collection techniques in the field of research is associated with the rulesof law which is equipped with library research . Direct communication with the techniques used in the form of unstructured interview guides ( Unstructured interviews ) . Data analysis was done qualitatively and  presented descriptively . Based on the research conducted it could be concluded that , on the theory of legal entities , the foundation said asa legal entity if it has been approved by the Minister . It is also stated in Article 71 of Law Foundation , a foundation that does not make adjustments to the base budget to the limit specified time then can not use the word " foundation " in front of his name .

Abstract

ABSTRACT In accomplishing his job, a Notary/PPAT not only comply with Law but also provides services which support his job; for example, before making a Land Title Transfer Certificate, he has to ask his clients to pay the required PPh and BPHTB. The research used prescriptive method to find legal provisions, legal principles, and legal doctrines to answer the research problems. The aim of the research was to describe, explain, and analyze general legal theories and legal provisions on PPh and BPHTB so that a Notary/PPAT’s services for his clients in paying PPh and BPHTB could be obtained. The services of a Notary/PPAT to his clients in paying PPh and BPHTB are not regulated in the prevailing legal provisions. Keywords: Services by a Notary/PPAT to his Clients.

Abstract

ABSTRACT Every person has his own human right to get his offspring through marriage. The procedure of a marriage in Indonesia varies since Indonesia recognizes multi religions and ethnicities that have different procedures. The result of the research shows that the Gayonese community still perform exogamy marriage system with some reasons, and one of them is that they consider that one clan/belah is one offspring so that they will maintain this system forever. Since the majority of them are Moslems, a marriage will be valid when it has fulfilled rukun or requirements for a marriage. Even though it dooms to extinct, there is a unique procedure of the marriage system in the Gayonese community such as sesuk pantang, teniron, i sarahen ku guru, mujule mas, sedulung, nik mas, sawah ukun, upacara dalem, membilang mas, beru, and mah beru. If they do not use exogamy system, they will be imposed on an adat  sanction like ‘farak’ (segregated) which is done by doing adat negotiation by sarak opai (adat institution). Abstract

ABSTRACT The Indonesian police officers as state’s apparatus have to comply with the prevailing legal provisions, especially a marriage conducted by an Indonesian police officer has to follow Marriage Law and the other regulations imposed on the Police Force. One of the requirements for getting marriage, before registering it to the Religious Affairs Office and the Civil Registry Office, is getting permission from the superiors. Police officers and government employees who work for the Police Force have to report to their superiors in written form when they want to get married. Without the acknowledge of their superiors, they will be considered as being single and their wives and children will not get any allowance; in other words, they are considered as having no dependent. A marriage without getting permission in the Police Force has an effect on a police officer’s wife and children in which they are legally protected by Law on Marriage and Law on Child Protection. The result of the research showed that the decision of the Disciplinary Infraction Meeting was considered correct in imposing punishment on police officers who violated the Government Regulation No. 2/2003 on Disciplinary regulation on the Indonesian Police Officers. Abstract

ABSTRACT Hibah (grant) is a direct handover unconditionally, without self-interest. In a legal act, it is a transfer of right of a person’s property to other people free of charge, without expecting anything in return. It cannot be withdrawn except it is from parents to their children as it is stipulated in Article 212 of KHI (Compilation of the Islamic laws. The research used normative juridical research and descriptive analytic method. The primary and secondary data were gathered by conducting library research and field research and analyzed qualitatively, and the conclusion was drawn deductively. The result of the research shows that a hibah actually cannot be revoked except it has been given by parents to their children as it is embodied in the Hadist and in the KHI. The building which has been built on the hibah land will automatically be owned by the person who built it, and the land which hibah is revoked will be owned by the giver of hibah so that the building built on it becomes illegal since it has no legal basis. Judge’s consideration in the Ruling is in accordance with the prevailing regulation since he uses Hadist and the KHI in his consideration. Keywords: Hibah, Revocation of Hibah, Building

Abstract

ABSTRACT Land registration is intended to compile and provide complete information about a plot of land and give legal certainty to the holders of land rights. The system of land registration in Indonesia is a negative system which has the positive tendency in placing land rights certificate as strong evidence although it is not absolute one since there will be the possibility for its holder to be claimed by other people who feel harmed by that certificate. The objective of this thesis is to analyze the dispute between Norma Tampubolon against the Land Office of Medan and Datuk Syahrial as the certificate holder that caused the Ownership Certificate No. 327/Sukaraja, registered in the name of Datuk Syahrial to be revoked due to its administrative defect through the Supreme Court’s Ruling No. 457 K/TUN/2013. This Ruling has encouraged the writer to find out the reason(s) of the State Administrative Court to pronounce the revocation of the certificate, the legal consequence on the revoked certificate, and the legal protection for its holder. The research used descriptive analytic and juridical normative method by analyzing the prevailing and competent legal provisions to be used as the basis for solving the research problems by using information from the source persons in supporting it. The result of the research showed that administrative defect became one of the reasons why the State Administrative Court pronounced an order to revoke the certificate. Since the Supreme Court’s Ruling No. 457 K/TUN/2013 was final and conclusive, the Ownership Certificate No. 327/Sukaraja was declared revoked and withdrawn from the circulation, and its status became the state land. Besides that, in reality, the Ruling did not give any legal certainty and legal protection to the certificate holder; on the other hand, it provided legal protection for the party that was won by the Court. Abstract

ABSTRACT In the implementation of auction, there is auctioning organizational structure which in the central government it is known as Auction Administration Inspection, and the regional level the implementation and/or the Ruling on Auction  Postponement from the Court should be informed in 3 (three) days prior to auctioning implementation. From the Articles found in the Civil Code and the Compilation of the Islamic laws, it is found that those who want to make an agreement, especially loan agreement, either in Sharia Banks or in Conventional Banks, have to fulfill the basic requirements stipulated in the Civil Code. The research problems were as follows: first, how about the legal force on foreclosure sale executed by the State Loan Service Office against non-performing loan; secondly, how about the legal provisions on joint property which is auctioned; thirdly, how about the postponement of foreclosure sale by the Medan District Court in its Ruling No. 601PK/Pdt./2007. The conclusion of the research is that legal force on foreclosure sale by the State Loan Service Office against non-performing loan in the execution or the implementation of the rulings is done by coercion on the loser in litigation. Article 35 of Law No. 1/1974 regulates joint property. In general, joint property is the property which is obtained during the marriage period in which both husband and wife attempt to fulfill their needs in their wedlock.
