Abstract

Law creates justice and benefits in people's lives, its existence is actually realized by the existence of legal certainty so that people can always obey and comply with the law. For example, the legal existence of controlling the conversion of paddy fields through Protected Paddy Lands (LSD) is very important in maintaining and maintaining the availability of paddy fields, this stems from the phenomenon of high levels of conversion of paddy fields causing the area of paddy fields to shrink, reducing the availability of basic necessities. food in the form of rice. With this phenomenon, control over the conversion of LSD rice fields is questionable, especially in the face of discrepancies in LSD determination with the Regional Spatial Planning (RTRW). So this journal was created with the aim of knowing the control over the conversion of paddy fields through LSD and also legal certainty. The results and conclusions in this research study can basically be explained that controlling the conversion of paddy fields through LSD by doing 2 things, namely, 1) LSD conversion and 2) LSD incentives. However, regarding the legal certainty of controlling the conversion of paddy fields through LSD, it is stated that it does not fully contain legal certainty, this is due to an error in determining the LSD in Ministerial Decree No. 1589/SK-HK.02.01/XII/2021. Therefore, it is undeniable that LSD needs to reform and perfect its legal policies so that the goal of controlling the conversion of paddy fields through LSD can be achieved and realized.

Abstract

ABSTRACT. Hard drugs are drugs that must be used or with a doctor's prescription, but in practice, consumers still often buy hard drugs without a doctor's prescription, even though from the consumer's perspective, the consumer's obligation is to read or follow information instructions and procedures for the use or utilization of goods and/or services. , for security and safety. Authorized institutions or governments such as BPOM must take part in preventing and enforcing the distribution of hard drugs without a doctor's prescription with more thorough outreach and supervision, because basically, it is stipulated in existing regulations that BPOM has pre-market and post-market functions. The results of the discussion revealed that the stage of consumer legal awareness in Kramat Jati District, East Jakarta, only reached stage 2 (two), which is why consumers still buy hard drugs without a doctor's prescription is due to a lack of legal understanding. For BPOM, although there have been many efforts made to increase legal awareness, in carrying out its functions, BPOM is still not in accordance with the principles of consistency, efficiency and proportionality in CROB which makes the law ineffective. Therefore, consumers should fulfill their obligations in accordance with the UUPK, and the Government should implement good preventive methods to increase consumers' legal awareness, one way is by implementing the nudging concept in the KIE program as a strategic effort to increase consumers' legal awareness of purchasing hard drugs without a prescription. doctor.

Abstract

Penal Code Number. 1 of 2023 revitalizes the adultery article which was previously removed in the old Penal Code. This sparked heated debate about the legal politics behind the criminalization of adultery and its implications for human rights, public morality, and the effectiveness of law enforcement. The criminalization of adultery is based on arguments of morality, family protection, and prevention of other criminal acts. Despite noble intentions, the criminalization of adultery raises concerns about potential invasions of privacy, gender discrimination, and abuse of power. It is important to seek a balance between fair and civilized law enforcement with respect for human rights. Narrow and proportional interpretation, a restorative justice approach, and prevention education are key. This research was carried out by identifying two problems, namely (1) what is the political basis of criminal law for the crime of adultery in the Penal Code Number 1 of 2023, (2) how is the application of the adultery article in the Penal Code Number 1 of 2023. The research method used is juridical research- normative because the subject of the study that will be researched uses library materials as basic material for research by conducting an investigation into the regulations related to the problem being discussed. The results of the research state that the penal policies in the adultery article provide substantive justice based on Pancasila. The implementation of criminalization of adultery is one of the efforts to protect human rights for the family/home through effective and dignified solutions.

Abstract

Penguasaan tanah tanpa hak dan tanpa izin merupakan masalah hukum yang kompleks di Indonesia. Perpu Nomor 51 Tahun 1960 tentang Larangan Pemakaian Tanah Tanpa Izin Yang Berhak Atau Kuasanya menjadi landasan hukum utama yang melarang penggunaan tanah oleh pihak yang tidak memiliki hak yang sah. Penelitian ini bertujuan untuk: (1) Mengetahui kondisi eksisting penguasaan tanah UPTD BPBTP yang dikuasai oleh masyarakat di Balai Benih Utama Maligano Kabupaten Muna Provinsi Sulawesi Tenggara; (2) Mengetahui faktor-faktor yang menyebabkan terjadinya penguasaan tanah UPTD BPBTP oleh masyarakat di Balai Benih Utama Maligano Kabupaten Muna Provinsi Sulawesi Tenggara; (3) Mengetahui penyelesaian terhadap penguasaan tanah UPTD BPBTP oleh masyarakat di Balai Benih Utama Maligano Kabupaten Muna Provinsi Sulawesi Tenggara. Metode penelitian yang digunakan adalah yuridis empiris dengan pendekatan kualitatif. Teknik pengumpulan data melalui wawancara, observasi dan dokumentasi. Teknik validitas data menggunakan teknik triangulasi sumber. Teknik analisis data dilakukan dengan empat tahapan yaitu, pengumpulan, reduksi data, penyajian data, dan kesimpulan. Hasil penelitian menunjukkan: (1) Kondisi eksisting penguasaan tanah BBU Maligano yang secara fisik dikuasai oleh UPTD BPBTP dengan alas hak pakai seluas 9,75 Ha dikuasai oleh masyarakat tanpa hak dan tanpa izin seluas 8 Ha yang digunakan untuk menanam tanaman tahunan seperti jati, kelapa, mete dan pembangunan 1 rumah tinggal. (2) Faktor yang menyebabkan terjadinya penguasaan tanah UPTD BPBTP adalah kurangnya anggaran dan sumber daya UPTD BPBTP untuk melakukan pengelolaan dan pengawasan terhadap lahan. (3) Penyelesaian yang dilakukan terhadap penguasaan tanah oleh masyarakat dengan melakukan musyawarah sehingga masyarakat bersedia keluar dengan berbagai syarat.

Abstract

Indramayu Regency has become increasingly concerned about absentee land ownership, or the ownership of agricultural land by people who do not live nearby, especially after inheritance events. This approach is at odds with the regulations designed to guarantee that the outcomes of land management are accessible to the local community. This study seeks to identify and examine the factors contributing to absentee land ownership practices following inheritance in Indramayu Regency, as well as the legal ramifications associated with these practices in the same region. The study employs a qualitative methodology, drawing on a juridical-empirical approach. The results show that the social factors that lead to absentee land ownership after inheritance in Indramayu Regency are the community's lack of legal knowledge and cultural norms that protect and allow this practice without meaning to. From an economic standpoint, the heirs' consideration of absentee land as an investment and a security for their retirement plays a significant role. Given the rights and responsibilities of the heirs of absentee landowners, the legal consequences of absentee land ownership practices following inheritance indicate that the heirs have a rightful claim to the inherited land. When land is designated as absentee land, the heirs must transfer it to another individual living in the district where the land is situated within one year following the testator's death. The heir's failure to adhere to the prohibition ultimately results in a legal conflict.

Abstract

Economic exploitation of children is a form of human rights violation that is still rampant, especially in areas with high poverty rates and limited access to education and legal protection. In Central Java, this phenomenon often affects children from marginalized families who are forced to work to help support their families' economy. This study aims to analyze how empowering marginalized communities can be an effective strategy in supporting the implementation of legal protection for children who are victims of economic exploitation. Using a qualitative approach and case study methods in several areas in Central Java, this study explores the role of local communities, civil society organizations, and government institutions in building legal awareness and social capacity of marginalized communities. The results of the study show that community empowerment not only increases understanding of children's rights but also strengthens the community's bargaining position in rejecting exploitative practices. Programs such as skills training, legal counseling, and the formation of local advocacy groups have been shown to create a more protective environment for children. In addition, collaboration between the community, local government, and child protection institutions is key to building a sustainable protection system that is responsive to local needs. This study confirms that a community-based approach is an important element in child protection strategies, especially in areas with limited resources. Therefore, policies are needed that support the active participation of marginalized communities in the process of formulating and implementing child legal protection. Thus, child protection efforts are not only the responsibility of the state, but also become a collective movement from the grassroots that starts from shared awareness and concern.
