Abstract

Based on Minister of Home Affairs Regulation Number 1 of 2016, it is possible to transfer rights to village treasury land through the transfer of assets by means of exchange. This research aims to find out how the procedure for transferring land rights by means of the transfer of assets through exchange is reviewed based on Minister of Home Affairs Regulation Number 1 of 2016 concerning Village Asset Management, as well as what the legal consequences are on the status of land resulting from the transfer of land rights through the transfer of assets by means of exchange. This research uses Normative Juridical research, using qualitative data analysis methods presented descriptively. The research results show that Based on Minister of Home Affairs Regulation Number 1 of 2016, the transfer of village assets in the form of land through exchange consists of those for the public interest, not for the public interest and village treasury land other than for the public interest and not for the public interest, where the exchange is for the public interest and not for the public interest. generally have general similarities in procedures The transition requires permission from the Village Government, Regent and Governor with a stipulation through a decree. Meanwhile, the legal consequences for the status of land resulting from the transfer of land rights through the transfer of assets by means of exchange are that the village treasury land that is released will be removed from the village asset inventory list and the applicant can register the land as their ownership with freehold status. Meanwhile, the replacement land will be recorded in the village asset inventory list and will become village treasury land with right-to-use status owned by the village government.

Abstract

Law creates justice and benefits in people's lives, its existence is actually realized by the existence of legal certainty so that people can always obey and comply with the law. For example, the legal existence of controlling the conversion of paddy fields through Protected Paddy Lands (LSD) is very important in maintaining and maintaining the availability of paddy fields, this stems from the phenomenon of high levels of conversion of paddy fields causing the area of paddy fields to shrink, reducing the availability of basic necessities. food in the form of rice. With this phenomenon, control over the conversion of LSD rice fields is questionable, especially in the face of discrepancies in LSD determination with the Regional Spatial Planning (RTRW). So this journal was created with the aim of knowing the control over the conversion of paddy fields through LSD and also legal certainty. The results and conclusions in this research study can basically be explained that controlling the conversion of paddy fields through LSD by doing 2 things, namely, 1) LSD conversion and 2) LSD incentives. However, regarding the legal certainty of controlling the conversion of paddy fields through LSD, it is stated that it does not fully contain legal certainty, this is due to an error in determining the LSD in Ministerial Decree No. 1589/SK-HK.02.01/XII/2021. Therefore, it is undeniable that LSD needs to reform and perfect its legal policies so that the goal of controlling the conversion of paddy fields through LSD can be achieved and realized.

Abstract

ABSTRACT. Hard drugs are drugs that must be used or with a doctor's prescription, but in practice, consumers still often buy hard drugs without a doctor's prescription, even though from the consumer's perspective, the consumer's obligation is to read or follow information instructions and procedures for the use or utilization of goods and/or services. , for security and safety. Authorized institutions or governments such as BPOM must take part in preventing and enforcing the distribution of hard drugs without a doctor's prescription with more thorough outreach and supervision, because basically, it is stipulated in existing regulations that BPOM has pre-market and post-market functions. The results of the discussion revealed that the stage of consumer legal awareness in Kramat Jati District, East Jakarta, only reached stage 2 (two), which is why consumers still buy hard drugs without a doctor's prescription is due to a lack of legal understanding. For BPOM, although there have been many efforts made to increase legal awareness, in carrying out its functions, BPOM is still not in accordance with the principles of consistency, efficiency and proportionality in CROB which makes the law ineffective. Therefore, consumers should fulfill their obligations in accordance with the UUPK, and the Government should implement good preventive methods to increase consumers' legal awareness, one way is by implementing the nudging concept in the KIE program as a strategic effort to increase consumers' legal awareness of purchasing hard drugs without a prescription. doctor.

Abstract

Penal Code Number. 1 of 2023 revitalizes the adultery article which was previously removed in the old Penal Code. This sparked heated debate about the legal politics behind the criminalization of adultery and its implications for human rights, public morality, and the effectiveness of law enforcement. The criminalization of adultery is based on arguments of morality, family protection, and prevention of other criminal acts. Despite noble intentions, the criminalization of adultery raises concerns about potential invasions of privacy, gender discrimination, and abuse of power. It is important to seek a balance between fair and civilized law enforcement with respect for human rights. Narrow and proportional interpretation, a restorative justice approach, and prevention education are key. This research was carried out by identifying two problems, namely (1) what is the political basis of criminal law for the crime of adultery in the Penal Code Number 1 of 2023, (2) how is the application of the adultery article in the Penal Code Number 1 of 2023. The research method used is juridical research- normative because the subject of the study that will be researched uses library materials as basic material for research by conducting an investigation into the regulations related to the problem being discussed. The results of the research state that the penal policies in the adultery article provide substantive justice based on Pancasila. The implementation of criminalization of adultery is one of the efforts to protect human rights for the family/home through effective and dignified solutions.

Abstract

Tanah merupakan modal dasar yang memiliki peran dan manfaat yang sangat strategis bagi kehidupan manusia. Di dalam melakukan pembangunan nasional di Indonesia ini diperlukan adanya tanah. Namun, ketersediaan tanah saat ini sangat terbatas dan banyak permasalahan lain terkait dengan tanah. Salah satu contohnya adalah penguasaan tanah oleh pihak lain, dimana tanah PT. KAI dengan bukti grondkaartnya dianggap dikuasai oleh masyarakat Kebonharjo. Tanah yang dikuasai tersebut akan digunakan untuk reaktivasi jalur kereta api Semarang Tawang-Pelabuhan Tanjung Emas Kota Semarang sehingga dibutuhkannya upaya penyediaan tanah. Permasalahan antara PT. KAI dan masyarakat Kebonharjo yang tidak kunjung selesai ini memerlukan adanya pihak ketiga yaitu Pemerintah Daerah selaku Tim Terpadu untuk menjadi fasilitator dalam menangani tersebut. Upaya penanganan ini membutuhkan mekanisme Penanganan Dampak Sosial Kemasyarakan atau pemberian uang santunan kepada masyarakat yang menguasai untuk pemindahan masyarakat. Dalam pelaksanannya ada beberapa tahapan yang harus dilalui yaitu tahap persiapan, tahap pendataan, tahap penilaian, tahap pemberian santunan, dan tahap pendokumentasian dan pengadministrasian. Segala upaya yang dilakukan oleh pemerintah sejatinya untuk memberikan fasilitas kepada masyarakat dan PT. KAI agar dapat terselesaikan dan proyek reaktivasi sebagai proyek pembangunan nasional dapat terlaksana atas dasar kesepakatan.

Abstract

Penguasaan tanah tanpa hak dan tanpa izin merupakan masalah hukum yang kompleks di Indonesia. Perpu Nomor 51 Tahun 1960 tentang Larangan Pemakaian Tanah Tanpa Izin Yang Berhak Atau Kuasanya menjadi landasan hukum utama yang melarang penggunaan tanah oleh pihak yang tidak memiliki hak yang sah. Penelitian ini bertujuan untuk: (1) Mengetahui kondisi eksisting penguasaan tanah UPTD BPBTP yang dikuasai oleh masyarakat di Balai Benih Utama Maligano Kabupaten Muna Provinsi Sulawesi Tenggara; (2) Mengetahui faktor-faktor yang menyebabkan terjadinya penguasaan tanah UPTD BPBTP oleh masyarakat di Balai Benih Utama Maligano Kabupaten Muna Provinsi Sulawesi Tenggara; (3) Mengetahui penyelesaian terhadap penguasaan tanah UPTD BPBTP oleh masyarakat di Balai Benih Utama Maligano Kabupaten Muna Provinsi Sulawesi Tenggara. Metode penelitian yang digunakan adalah yuridis empiris dengan pendekatan kualitatif. Teknik pengumpulan data melalui wawancara, observasi dan dokumentasi. Teknik validitas data menggunakan teknik triangulasi sumber. Teknik analisis data dilakukan dengan empat tahapan yaitu, pengumpulan, reduksi data, penyajian data, dan kesimpulan. Hasil penelitian menunjukkan: (1) Kondisi eksisting penguasaan tanah BBU Maligano yang secara fisik dikuasai oleh UPTD BPBTP dengan alas hak pakai seluas 9,75 Ha dikuasai oleh masyarakat tanpa hak dan tanpa izin seluas 8 Ha yang digunakan untuk menanam tanaman tahunan seperti jati, kelapa, mete dan pembangunan 1 rumah tinggal. (2) Faktor yang menyebabkan terjadinya penguasaan tanah UPTD BPBTP adalah kurangnya anggaran dan sumber daya UPTD BPBTP untuk melakukan pengelolaan dan pengawasan terhadap lahan. (3) Penyelesaian yang dilakukan terhadap penguasaan tanah oleh masyarakat dengan melakukan musyawarah sehingga masyarakat bersedia keluar dengan berbagai syarat.

Abstract

Pelaksanaan penertiban tanah terindikasi terlantar di Kantor Pertanahan Kabupaten Sragen berdasarkan pada Peraturan Pemerintah Nomor 20 Tahun 2021 Tentang Penertiban Kawasan dan Tanah terlantar. Penelitian ini bertujuan untuk: 1) mengetahui dan menganalisis pelaksanaan penertiban tanah terindikasi terlantar di Kabupaten Sragen; 2) mengetahui dan menganalisis kendala dalam pelaksanaan penertiban tanah terindikasi terlantar di Kabupaten Sragen. Penelitian ini menggunakan metode penelitian yuridis empiris dengan pendekatan kualitatif yang menggunakan sumber data primer dan data sekunder. Data primer dilakukan dengan wawancara, dan dokumentasi. Validitas data menggunakan triangulasi, sedangkan analisis data melalui pengumpulan data, reduksi data, penyajian data, dan penarikan kesimpulan. Hasil penelitian ini adalah sebagai berikut: 1) pelaksanaan penertiban tanah terindikasi terlantar oleh Kantor Pertanahan Kabupaten Sragen yakni diawali dengan masih di tahap dua dari empat tahap, yaitu di tahap evaluai tanah terindikasi terlantar. Di Kantor Pertanahan Kabupaten Sragen terdapat 10 bidang tanah yang terindikasi terlantar. 2) Kendala dalam pelasanaan penertiban tanah terindikasi terlantar di Kabupaten Sragen yaitu adanya kendalan teknis dan non-teknis. Kendala internal meliputi kurangnya sumber daya dan kewenangan, sedangkan hambatan eksternal terkait dengan koordinasi dengan instansi lain. Simpulan dari penelitian ini yaitu: 1) Dalam pelaksanaan penertiban tanah terindikasi terlantar di Kantor Pertanahan Kabupaten Sragen dalam upaya menertibkan 10 bidang tanah yang terindikasi terlantar yang berakhir pada di tahap dua yaitu evaluasi tanah terindikasi terlantar, hasil menunjukan 10 bidang tersebut hanya terindikasi terlantar. 2) Kendala dalam pelaksanaan penertiban tanah terindikasi terlantar di Kantor Pertanahan Kabupaten Sragen mengalami berbagai kendala yaitu kendala teknis maupun non-teknis. Faktor kendala utama yaitu: subyek hak sulit untuk ditemui dan sering tidak diketahui keberadaanya, kurangnya kepedulian subyek hak terhadap tanah yang dikuasai dan obyek hak atas tanah seringkali digunakan atau dijaminkan.

Abstract

ABSTRACT. Islamic boarding schools are religious-based educational institutions with a focus on forming children's morals and character as an effort to prevent children from falling into immorality which can obstruck the fulfillment of children's educational rights to the maximum. The problem is that the survey results of the target community (Santri Islamic Boarding School Ar Rosyid) do not yet have an optimal understanding (17 respondents answered incorrectly) regarding marriage regulations as regulated in the Marriage Law, including regarding the minimum age limit for marriage. The target community also does not optimally understand the existence of alternative solutions for children dropping out of school due to child marriage, so that the right to education cannot be obtained optimally. Based on this concern, the author offered an alternative solution in the form of sustainable activities that focused on increasing the urgency of understanding the age of marriage in order to manifest children's educational rights at the Ar Rosyid Pemalang Islamic boarding school. The target achievement is increasing the urgency of understanding the marriage age and educational forum solutions through post tests with higher correct answers than the survey results. The methods used to achieve the objectives of this service program are: (1) Coordination and survey of partner needs (2) legal counseling; and (3) Evaluation. The target audience for this service program are ordinary people who have not optimally understood and analyzed the urgency of understanding the marriage age so that basic education is fulfilled.

Abstract

Bullying yang terjadi di lingkungan sekolah menjadi fenomena “gunung es”, kasus yang terungkap hanya sebagian kecil dibanding yang terjadi karena tidak mudah bagi korban untuk mengungkapkan apa yang dialaminya. SMP Tahfidh Yanbu’ul Qur’an 5 Tegal merupakan salah satu bentuk sekolah yang terintegrasi dengan pondok pesantren sehingga siswa dituntut harus mandiri. Permasalahan yang dihadapi oleh para siswa maupun pihak  sekolah, pertama, bahwa siswa dituntut dapat menyelesaikan apapun yang membuatnya tidak nyaman secara pribadi dan mandiri karena jauh dari orangtua. Kedua, beberapa siswa mengalami kendala dalam mengungkapkan apa yang dirasakannya sehingga menimbulkan ketidaknyamanan yang berdampak pada proses pembelajaran di sekolah. Ketiga, siswa yang masih remaja mengalami degradasi kepercayaan diri dan kebingungan. Sehingga dibutuhkan solusi berupa penguatan psikologi, konsultasi hukum, bimbingan konseling secara terstruktur, dan pembentukan pendidikan karakter bagi siswa. Tujuan pengabdian ini untuk penguatan pendidikan karakter, pendidikan hukum, pendampingan psikologi, dan pengembangan kreativitas bagi siswa. Metode pelaksanaan yang digunakan yaitu dengan mekaksanakan sosialisasi hukum tentang bullying, pemberian pendidikan karakter bagi peserta didik, pendampingan konseling psikologi bagi korban dan pelaku bullying, dan pembuatan poster. Hasil pengabdian diharapkan para siswa SMP Tahfidh Yanbu’ul Qur’an 5 Tegal mulai menyadari dan menghentikan segala bentuk perilaku bullying atau perundungan yang ada di lingkungan sekolah.

Abstract

Indramayu Regency has become increasingly concerned about absentee land ownership, or the ownership of agricultural land by people who do not live nearby, especially after inheritance events. This approach is at odds with the regulations designed to guarantee that the outcomes of land management are accessible to the local community. This study seeks to identify and examine the factors contributing to absentee land ownership practices following inheritance in Indramayu Regency, as well as the legal ramifications associated with these practices in the same region. The study employs a qualitative methodology, drawing on a juridical-empirical approach. The results show that the social factors that lead to absentee land ownership after inheritance in Indramayu Regency are the community's lack of legal knowledge and cultural norms that protect and allow this practice without meaning to. From an economic standpoint, the heirs' consideration of absentee land as an investment and a security for their retirement plays a significant role. Given the rights and responsibilities of the heirs of absentee landowners, the legal consequences of absentee land ownership practices following inheritance indicate that the heirs have a rightful claim to the inherited land. When land is designated as absentee land, the heirs must transfer it to another individual living in the district where the land is situated within one year following the testator's death. The heir's failure to adhere to the prohibition ultimately results in a legal conflict.
