HOKI: Jurnal Ilmiah Hukum Keluarga Islam merupakan inisiatif dari Jurusan Hukum Keluarga Islam, Universitas Sunan Drajat Lamongan. Tujuan utamanya adalah untuk memfasilitasi mahasiswa, dan/atau Civitas Akademika yang memuat diskusi ilmiah mengenai perkembangan isu-isu hukum di Indonesia saat ini serta untuk mempublikasikan penelitian hukum inovatif mengenai hukum dan sistem hukum Indonesia. Kajian ini pada dasarnya memuat topik-topik baru tentang hukum dan sistem hukum Indonesia. Kisaran konten yang dicakup oleh ulasan ini mencakup dari bidang hukum seperti hukum Islam, hukum perdata, dan hukum publik yang meliputi: Hukum Islam Hukum tata negara dan administrasi Hukum Kriminal berbagai pendekatan Studi hukum seperti perbandingan hukum, hukum dan ekonomi, dan sosiologi hukum, dan Bagian lain yang berkaitan dengan isu-isu kontemporer dalam hukum. Naskah tentang subjek yang tidak tersedia pada daftar di atas akan dipertimbangkan, sepanjang topik tersebut menyangkut atau terkait dengan hukum Indonesia.

Abstract

Fenomena pernikahan usia dini masih menjadi persoalan serius di Indonesia, termasuk di Kabupaten Bondowoso, yang hingga kini mencatat angka tinggi dalam pengajuan dispensasi nikah. Padahal, Undang-Undang Nomor 16 Tahun 2019 telah dengan tegas menetapkan usia minimal untuk menikah adalah 19 tahun. Kondisi tersebut menimbulkan dilema antara penerapan hukum positif, tekanan sosial-budaya yang kuat, serta nilai-nilai syariat Islam yang hidup di masyarakat. Penelitian ini berupaya menjawab dua pokok permasalahan utama. Pertama, bagaimana peran strategis Pengadilan Agama Bondowoso dalam mencegah pernikahan dini ditinjau dari perspektif Maqāṣid al-Syarī‘ah Abdul Majid An-Najjar. Kedua, apa saja faktor pendukung dan penghambat dalam pelaksanaan strategi pencegahan tersebut menurut pandangan maqāṣid. Tujuan penelitian ini adalah untuk menggambarkan praktik pencegahan pernikahan dini yang dilakukan oleh Pengadilan Agama Bondowoso serta menganalisisnya melalui pendekatan maqāṣid al-syarī‘ah, agar dapat memberikan pemahaman akademis dan praktis terkait upaya perlindungan anak oleh lembaga peradilan agama. Penelitian ini menggunakan pendekatan kualitatif dengan metode studi kasus, melalui teknik observasi, wawancara, dan dokumentasi. Hasil penelitian menunjukkan bahwa Pengadilan Agama Bondowoso menjalankan peran strategis melalui kebijakan pengetatan dispensasi nikah, edukasi hukum kepada masyarakat, serta kerja sama lintas lembaga. Dalam pandangan maqāṣid al-syarī‘ah, kebijakan tersebut sejalan dengan tujuan menjaga jiwa (ḥifẓ al-nafs), melindungi keturunan (ḥifẓ al-nasl), dan menjaga kehormatan (ḥifẓ al-‘irḍ). Temuan ini menegaskan pentingnya penguatan literasi hukum dan kesadaran sosial masyarakat sebagai upaya menekan angka pernikahan anak, sehingga nilai-nilai keadilan dan kemaslahatan syariat dapat terwujud secara berkelanjutan.

Abstract

Polygamy is one of the contemporary issues in marriage law that continues to spark debate, particularly regarding its relationship with religious freedom and the protection of human rights. Differences in how countries regulate polygamy reflect the legal frameworks followed by each legal system. This article aims to analyze the prohibition of polygamy in Dutch marriage law and its impact on religious freedom, comparing it with the regulation of polygamy in Indonesia. This study uses a normative legal research method with a legislative and comparative law approach. The results show that Indonesia applies the principle of monogamy but allows limited polygamy through strict legal mechanisms as a compromise between religious values and the protection of women's rights. In contrast, the Netherlands completely prohibits polygamy as a result of the principles of secularism and gender equality in family law. These differences influence how each country interprets religious freedom in the context of family law. This article concludes that both conditional restrictions and total bans on polygamy have different legal and social implications, so that the regulation of polygamy should ideally consider the balance between religious freedom, the protection of human rights, and public order.

Abstract

This study examines the comparative development of minimum marriage age regulations in Indonesia and Malaysia, with particular attention to the underlying reasons for legal reform and the mechanisms for granting permission for underage marriage. The research employs a normative legal research method using statutory and comparative law approaches. The data consist of secondary sources, including legislation, court decisions, academic books, journals, and other relevant legal materials. The findings reveal that Indonesia raised the minimum marriage age for both men and women to 19 years through Law Number 16 of 2019, following Constitutional Court Decision Number 22/PUU-XV/2017, which declared the previous age disparity discriminatory and contrary to the constitutional rights of children. In contrast, Malaysia’s initiative to raise the minimum marriage age for women was primarily driven by political commitments and pressure from women’s rights organizations and UNICEF, as reflected in the Pakatan Harapan coalition’s manifesto. Nevertheless, the implementation has been uneven due to the decentralized authority of Islamic family law at the state level. This study concludes that differences in legal structure, political dynamics, and institutional authority account for the varying pace and scope of minimum marriage age reforms in Indonesia and Malaysia.

Abstract

This study aims to analyze juridically unregistered marriages from the perspective of Islamic law in Indonesia. This research employs a normative legal method with a library research approach, utilizing primary and secondary legal sources, which are then analyzed qualitatively. The results indicate that in classical Islamic law, the validity of marriage is determined by the fulfillment of its pillars and conditions, without requiring administrative registration. However, in the context of modern Indonesian law, marriage registration holds a significant position as regulated in Law Number 1 of 1974 and the Compilation of Islamic Law. Through the approaches of qiyas, sadd adz-dzari’ah, and mashlahah mursalah, marriage registration can be understood as an effort to achieve public benefit and to provide legal certainty and protection for husbands, wives, and children. Unregistered marriages lead to various legal consequences, particularly for women and children, such as lack of legal recognition, difficulties in obtaining inheritance rights, and weak legal protection. Therefore, marriage registration can be considered an essential legal necessity and is relevant to be incorporated as part of strengthening the pillars of marriage within the framework of Islamic law in Indonesia.

Abstract

This study aims to examine the deconstruction of patriarchal fiqh and the reinterpretation of women’s fiqh from a gender perspective in order to present a more just and inclusive understanding of Islamic law. Fiqh, as a product of scholars’ ijtihad, cannot be separated from the socio-historical context in which it emerged; therefore, many formulations of classical fiqh reflect patriarchal culture and hierarchical gender relations. This study employs a qualitative approach using library research, through analysis of classical fiqh texts and contemporary literature using content analysis methods and an interdisciplinary approach integrating gender studies, hermeneutics, and maqāṣid al-sharī‘ah. The findings indicate that patriarchal bias in fiqh is influenced more by scholars’ interpretations than by the substance of Islamic teachings themselves. Therefore, the deconstruction of fiqh is necessary to reexamine epistemological, methodological, and interpretative aspects within Islamic law. The reinterpretation of women’s fiqh through a contextual and maqāṣid al-sharī‘ah-based approach is able to produce an understanding that places greater emphasis on justice, equality, and public benefit (maṣlaḥah). In addition, the role of religious institutions and scholars, including female scholars, is an important factor in encouraging the transformation of fiqh thought to become more responsive to gender issues. The implications of this process are evident in contemporary Islamic legal reforms, particularly in family law, which increasingly aim toward protecting women’s rights and eliminating discriminatory practices. Thus, the deconstruction of fiqh contributes to building Islamic law that is dynamic, adaptive, and oriented toward substantive justice.

Abstract

This article examines the fiqh principle Al-Masyaqqah Tajlibu at-Taysīr and its relation to community economic activities within the framework of Islamic economics, as stated in Qur'an Surah Al-Baqarah: 185. This study aims to analyze the concept of this principle and its implementation in daily economic activities. The method used is a qualitative approach through a literature study based on the Qur'an, Hadith, classical Islamic texts, and relevant academic journals. The findings show that this principle provides ease in various economic activities such as financial transactions and muamalah practices, especially under difficult or emergency conditions. However, its application is not absolute, as it must fulfill specific shar’iyyah requirements to prevent misuse. Therefore, a proper understanding of this principle is essential in maintaining a balance between flexibility and the provisions of Islamic law in community economic life.

Abstract

This study analyses the implementation of Islamic inheritance law within the Bugis indigenous community in South Sulawesi, highlighting the relationship between Islamic sharia and local traditions. The study employs a qualitative approach, specifically library research, through the analysis of various relevant primary and secondary sources. The findings indicate that the practice of inheritance law among the Bugis community reflects legal pluralism, in which the principles of Islamic inheritance coexist alongside customary values such as pangadereng, tudang adeq, and siri’. Customary law functions as a mechanism for deliberation and social legitimisation in the distribution of inheritance without disregarding the provisions of Sharia. The implementation of inheritance law is also influenced by factors such as education, gender, social stratification, migration and modernisation. Therefore, it is necessary to strengthen the synergy between Islamic law and customary law through the maqāṣid al-syarī‘ah approach, to improve education on family law, and to strengthen the role of customary and religious leaders in order to achieve fair, harmonious and equitable inheritance settlements that are in line with the values of Bugis society.
