Abstract

To initiate the discussion about what is meant by the Omnibus Law, which later became controversial over the government's choice to propose a draft Law on Job Creation submitted to the House of Representatives (DPR), when the draft Omnibus Law draft was still being debated from side of the legal position in the Indonesian legal system. Apart from the debate regarding the policies of the Joko Widodo - KH. Ma`ruf Amin government regarding the Omnibus Law, we need to explore the use and utilization of omnibus law policies in the applicable legal system and the State that uses this concept. Given, the concept of omnibus law in practice is often used by countries that adhere to the “common law” legal system, not countries that adhere to the “civil law” legal system. And how the Indonesian State, which adopts the civil law legal system, applies the concept of the omnibus law policy in its legal system. ABSTRAKSI Untuk mengawali pembahasan tentang apa yang dimaksud dengan Undang-Undang (UU) Omnibus Law, yang kemudian menjadi kontroversial atas pilihan pemerintah untuk mengusulkan rancangan UU tentang Cipta Kerja yang diajukan kepada Dewan Perwakilan Rakyat (DPR), ketika draft rancangan UU Omnibus Law masih diperdebatkan dari sisi kedudukan hukum di dalam sistem hukum Indonesia. Terlepas dari perdebatan mengenai kebijakan pemerintahan Joko Widodo – KH. Ma`ruf Amin mengenai UU Omnibus Law perlu kita telusuri penggunaan dan pemanfaatan kebijakan omnibus law di dalam sistem hukum yang berlaku dan Negara yang menggunakan konsep tersebut. Mengingat, konsep omnibus law di dalam praktek pada dasarnya, sering digunakan oleh Negara yang menganut sistem hukum “common law”, bukan Negara yang menganut sistem hukum ”civil law”. Dan bagaimana Negara Indonesia yang menganut sistem hukum civil law mempraktekkan kebijakan konsep omnibus law di dalam sistem hukumnya.

Abstract

Corruption is a crime that not only damages State finances but also damages the joints of national and state life. Therefore the application of Article 2 of Law no. 20 of 2001 against perpetrators of criminal acts of corruption for state officials in the perspective of Islamic law can be implemented because it is appropriate and in line with maqasid al-tasyri 'in the sense that it still considers the public interest which is benefit-oriented and rejects all evil. Corruption is against the objectives of law (maqasid al-tasyri ') in order to protect religion, life, property, descent and reason. Because it is in accordance with applicable justice and if proven guilty, the perpetrator of corruption and proven guilty can be subject to maximum punishment. The main problems presented by the compilers in the discussion of corporate crime in the perspective of Islamic law and positive law are: 1) What is the positive legal view of corruption? and what are the sanctions for the perpetrators of corruption in positive law? 2) What is the view of Islamic law on corruption? And how to sanction corruption in Islamic law? The research method used is a comparative descriptive qualitative research method which is sourced from various references both classical books and comprehensive books as the main reference, namely by presenting a comparative depiction of the problem of corruption (comparison) according to versions of positive law and Islamic law. . with the aim of obtaining relevant and credible answers so that readers or knowledge seekers can draw conclusions about the problem of corruption appropriately. From the description of the description of the criminal act of corruption above, it can be concluded that, in terms of Islamic religion, criminal acts are the prohibitions of syara 'which are threatened by Allah with the punishment of had or ta'zir. Meanwhile, according to positive law, a criminal act is an act that violates the prohibitions regulated by the rule of law which is punishable by criminal sanctions. Criminal acts in Islam will receive appropriate sanctions, such as murder must be punished by death. Meanwhile, according to positive law, offenders of a crime are punished with conditional provisions, such as someone who kills is sentenced to only a few years in prison, which should be a death sentence, on the grounds of compassion or protecting human rights. Abstrak Korupsi merupakan kejahatan yang bukan saja hanya merusak keuangan Negara tetapi juga merusak sendi-sendi kehidupan berbangsa dan bernegara. Karena itu penerapan pasal 2 Undang-undang No. 20 tahun 2001 terhadap pelaku tindak pidana korupsi bagi penyelenggara negara dalam prespektif hukum Islam bisa dilaksanakan karena sesuai dan sejalan dengan maqasid al-tasyri’ dalam artian tetap mempertimbangkan kepentingan umum yang berorientasi pada kemaslahatan dan menolak segala kemungkaran. Korupsi bertentangan dengan tujuan hukum (maqasid al-tasyri’) dalam rangka menjaga agama, jiwa, harta, keturunan, dan akal. Oleh karena sesuai dengan keadilan yang berlaku dan bila terbukti bersalah, maka pelaku pidana korupsi dan terbukti bersalah dapat dikenai pidana maksimal. Pokok permasalahan yang disajikan penyusun didalam pembahasan tindak pidana korporasi dalam perspektif hukum Islam dan hukum positif adalah: 1) Bagaimana pandangan hukum positif terhadap tindak pidana korupsi? dan apa sangsi terhadap pelaku korupsi dalam hukum positif ? 2) Bagaimana pandangan hukum Islam terhadap tindak pidana korupsi? Dan bagaimana sangsi tindak pidana korupsi dalam hukum islam?. Metode penelitian yang digunakan adalah metode penelitian kualitatif deskriptif komperatif yang bersumber dari berbagai referensi baik kitab-kitab klasik maupun buku-buku yang komperensif sebagai acuan utama, yakni dengan cara menyuguhakan penggambaran mengenai masalah korupsi secara komperatif (perbandingan) menurut versi hukum positif dan hukum Islam.dengan maksud untuk mendapatkan jawaban yang relevan dan kredibel sehingga para pembaca atau pencari ilmu dapat mengambil kesimpulan mengenai masalah korupsi dengan tepat. Dari penjelasan deskripsi mengenai tindak pidana korupsi di atas bisa di ambil kesimpulan bahwa,Tindak pidana ditinjau dari sisi agama islam adalah larangan-larangan syara’ yang diancam oleh Allah dengan hukuman had atau ta’zir. Sedangkan menurut hukum positif tindak pidana adalah perbuatan yang melanggar larangan yang diatur oleh aturan hukum yang diancam dengan sanksi pidana. Perbuatan pidana dalam islam akan mendapatkan sanksi yang setimpal, semisal pembunuhan harus dihukum mati. Sedangkan menurut hukum positif, pelanggar tindak pidana dihukum dengan ketentuan yang kondisional, semisal seseorang yang membunuh dihukum hanya sekian tahun hukuman penjara, yang seharusnya adalah hukuman mati, dengan alasan karena kasihan ataupun melindungi hak asasi.

Abstract

ABSTRAK The presence of the e-Court application will certainly change the paradigm of the judicial apparatus, especially in case administration, besides that it will also change the image of the court which is now increasingly sophisticated with the role of information technology. This application is a contribution of the Supreme Court to the Indonesian Judiciary. The process of case administration in the court becomes more concise, for example, the trial agenda will be more effective and efficient, because case files can be submitted online (summarizes several trial processes that only exchange documents). The e-Court application can be accessed from anywhere, by anyone (as long as they have an account / user) armed with an internet connection and a device that has a web browser. So that a simple, fast and low cost trial can be realized. Keywords: Judicial administration, civil, E-Court, Banjar City Religious Court Absktrak Konteks penelitian ini adalah guna menunjang peradilan yang kredibilitas dan akuntabilas di seluruh Indonesia yang lebih baik dan lebih cepat dan Efisien. Mahkamah Agung dengan percaya diri menerbitkan Peraturan mahkamah agung Tahun 2019 No 1 tentang adminidtrasi perdata secara elektronik yang mana maksud di keluarkannya perma tersebut diharapkan dapat membantu bagi setiap orang yang ingin mencari keadilan di Pengadilan, dan tidak harus pergi setiap akan melakukan persidangan di pengadilan dengan tidak lagi off line melainkan persidangan dengan system online atau e-court di Pengadilan Agama Kota Banjar, sehingga di Era revolusi industri 4.0 seperti sekarang ini yang mayoritas masyarakat menggunakan elektronik, pemerintah dalam hal ini Mahkamah Agung berinisiatif menggunakan alat (e-Court) tersebut untuk dapat diakses dalam hal pengadministrasian perdata di pengadilan. Secara wilayah mungkin masih banyak kabupaten yang minim terkait akses elektronik ini. Akan tetapi tidak menutup kemungkinan setelah perma ini berjalan dalam hal ini pemerintah akan memenuhi kebutuhan masyarakat diantaranya adalah dengan adanya akses jaringan elektronik yang bisa dimanfaatkan dimana-dimana tidak hanya di wilayah kota Banjar, Provinsi Jawa Barat. Abstract

Freedom of religion in Indonesia has become a shared commitment, this is enshrined in the 1945 Constitution and Law Number 39 of 1999 concerning Human Rights. However, in practice there are still violations, this happens that there is an imbalance between the rules and law enforcement. So this study discusses how the freedom of diversity in the 1945 Constitution is viewed from prophetic political values; humanization (ta'muru bil ma'ruf), liberation (tanhawna 'anil munkar), and transcendence (tu'minu billah). This research is normative legal research or library research, which examines applied research through data collection or scientific writing work whose object or data collection is the library. This research concludes that the right to freedom of religion as regulated in Article 28 I paragraph 1 of the 1945 Constitution is in accordance with the spirit of the basic values ​​of prophetic politics, namely liberation, humanization and transcendence.

Abstract

Democracy, political parties, and elections, are terms that are no longer foreign to our ears. This paper wants to discuss the relationship between democracy, political parties, and elections. By using the analytical descriptive method, it is concluded that the relationship between democracy, political parties and elections in general is basically a logical consequence of the implementation of modern democratic practices. Modern democracy based on representative democracy requires the establishment of an instrument of democracy as the main support for the implementation of the practice of representative democracy. Even in a more extreme perspective, there are those who say that without the two instruments of democracy (political parties and elections), the practice of representative democracy is impossible to run optimally.

Abstract

The purpose of this study is to show the view of Islamic law in criminal acts of children from the side of responsibility for criminal acts in terms of theft. This study uses normative juridical law research, by reviewing legislation, by looking at the normative aspect. The data used in this research is legal material. The results of this study indicate that the forms and criteria in Islamic criminal law that can be categorized as criminal acts of theft are in the form of behavior, unlawful nature, errors, constitutive consequences, accompanying conditions, additional requirements to be criminally prosecuted, and additional conditions to be convicted.

Abstract

Democracy is a form of two words demos (the people) and cratein or cratos (power and sovereignty). The combination of the words demos and cratein or cratos forms the word democracy which has a general understanding as a form of government of the people (government of the people) in which the highest power lies in the hands of the people carried out directly by the people or through their representatives through direct and indirect election mechanisms. freely. In a systematic and standard procedure to obtain the required data there is always a relationship between the data collection method and the research problem to be solved, the data collection method used in this research is the study method or (library). Democratic ethics can simply be understood as a political ethic that adheres to the existential principles of democracy. Democratic ethics is part of political ethics that places democracy as an ethical measuring tool. If political ethics questions the legitimacy factor that is the basis of power, while political ethics emphasizes more on how to do politics. The problem of the way, the making, or the behavior to express the attitude of political action by referring to the elements of democratic values ​​is what is referred to as democratic political ethics. So the ethics of democracy is a democratic way of doing politics. What is the democratic way of doing politics? Theoretically, democratic ethics is a moral teaching in acting that prioritizes the will of the people through equal respect for the rights to be able to freely express choices and opinions. Etika demokrasi secara sederhana dapat dipahami sebagai etika politik yang menganut prinsip-prinsip eksistensial demokrasi. Etika demokrasi merupakan bagian dari etika politik yang menempatkan demokrasi sebagai alat ukur etis. Jika etika politik mempersoalkan faktor legitimasi yang menjadi dasar kekuasaan, sedangkan etika politik lebih menekankan pada bagaimana berpolitik. Masalah cara, pembuatan, atau perilaku untuk mengungkapkan sikap tindakan politik dengan mengacu pada unsur-unsur nilai demokrasi inilah yang disebut dengan etika politik demokrasi. Jadi etika demokrasi adalah cara berdemokrasi dalam berpolitik. Bagaimana cara demokrasi dalam berpolitik?
