Abstract

Konstitusi merupakan kumpulan asas-asas yang menyelenggarakan kekuasaan pemerintahan, hak-hak dari yang diperintah dan hubungan antara pemerintah dan yang diperintah). Secara umum konstitusi atau undang-undang dasar berisi 3 (tiga) hal pokok, yaitu: Pertama, adanya jaminan terhadap hak-hak asasi manusia dan warga negara; Kedua, ditetapkannya susunan ketatanegaraan yang bersifat fundamental; dan Ketiga, adanya pembagian dan pembatasan tugas ketatanegaraan yang juga bersifat fundamental. Metode penelitian dalam tulisan ini menggunakan metode penelitian yuridis normatif yaitu penelitian hukum kepustakaan yang dilakukan dengan cara meneliti bahan-bahan kepustakaan atau data sekunder belaka. Secara umum, terdapat beberapa perbedaan antara Konstitusi Negara Portugal dan Negara Uzbekistan dalam hal sifat, prosedur perubahan konstitusi, bentuk pemerintahan, bentuk negara, serta sistem pemerintahan. Abstract

Abstract

Decentralization under Law Number 23 of 2014 grants broad authority to local governments in managing social and religious affairs. However, practices such as the prohibition of Ahmadiyya Jamaah’s Jalsah Salanah by certain regional governments raise tensions between freedom of religion and the rule of law. This study aims to evaluate the legality and legitimacy of such restrictions using John Rawls’ theory of justice, particularly the principles of basic liberties and the difference principle. A normative juridical method is employed, with statutory, case-based, and conceptual approaches. The findings reveal that many local regulations lack a national legal basis, fail the proportionality test, and discriminate against minority groups without social compensation, thereby conflicting with Rawlsian principles. The study concludes that Rawlsian justice principles must be integrated into local legislative processes, judicial review mechanisms strengthened, and inclusive deliberative forums implemented to ensure regional autonomy aligns with constitutional supremacy. Practically, this research offers an evaluative framework for local policymakers and serves as a normative reference for the Supreme Court and Constitutional Court in reviewing potentially discriminatory local regulations. Abstrak Desentralisasi melalui Undang-Undang Nomor 23 Tahun 2014 memberikan kewenangan luas kepada pemerintah daerah dalam urusan sosial dan keagamaan. Namun, praktik pembatasan ibadah oleh beberapa Pemda, seperti pelarangan Jalsah Salanah Jamaah Ahmadiyah, menimbulkan konflik antara kebebasan beragama dan prinsip negara hukum. Penelitian ini bertujuan mengevaluasi legalitas dan legitimasi pembatasan tersebut dengan teori keadilan John Rawls, khususnya prinsip kebebasan dasar dan difference principle. Metode yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan, kasus, dan konseptual. Hasil penelitian menunjukkan bahwa sejumlah kebijakan daerah tidak berlandaskan hukum nasional, tidak proporsional, serta merugikan kelompok minoritas secara diskriminatif. Kesimpulannya, diperlukan integrasi prinsip keadilan Rawlsian dalam legislasi daerah, penguatan judicial review, dan forum deliberatif yang inklusif agar otonomi daerah tidak melanggar supremasi konstitusi. Penelitian ini berkontribusi dalam menyediakan kerangka evaluatif bagi pemerintah daerah dan menjadi rujukan normatif bagi Mahkamah Agung dan Mahkamah Konstitusi dalam menilai keabsahan peraturan daerah yang potensial melanggar kebebasan beragama.

Abstract

The effectiveness of the jurisdiction of the International Court of Justice (ICJ) in enforcing international humanitarian law related to war crimes and forced displacement in Gaza faces complex challenges. Although the ICJ has international legal authority to adjudicate violations of international obligations, the implementation of ICJ decisions, in particular provisional measures that have been issued regarding Gaza, are often ignored by Israel. This non-compliance is further complicated by global political factors, especially the United States' support for the temporary relocation policy of Gazans which exacerbates patterns of forced displacement. This research uses a normative juridical method, with a focus on studying international legal norms, such as the 1945 Statute of the International Court of Justice, the 1949 Geneva Convention IV, and the 1998 Rome Statute. A conceptual approach is used to dissect the concept of the effectiveness of the ICJ's jurisdiction, while a case approach is applied in analyzing the application of the ICJ's jurisdiction to the post-2023 Gaza conflict. political domination of big countries. Therefore, strengthening the ICJ's jurisdiction requires effective compliance system reform and firmer political support from the international community so that the ICJ does not simply become a normative symbol.

Abstract

This article examines the implementation of political rights for persons with disabilities during the General Election in Kuningan Regency, as outlined in Law Number 7 of 2017 on General Elections and Law Number 8 of 2016 on Persons with Disabilities. The research focuses on issues of accessibility and the effectiveness of electoral outreach. Using a normative legal method with a qualitative approach, this study examines legal frameworks, policy documents, and conducts interviews with relevant stakeholders. The findings reveal a significant gap between legal provisions and field implementation. Many polling stations remain physically inaccessible, and outreach programs often fail to consider the diversity of disability types. These barriers limit the participation of persons with disabilities in democratic processes. The study concludes that without accessible infrastructure and inclusive political communication, the right to vote and be elected cannot be fully realized for this marginalized group. It recommends stronger affirmative policies and collaboration between the General Election Commission, local authorities, and disability organizations topromote inclusive, non-discriminatory elections in line with human rights principles.

Abstract

This study aims to analyze the role of Faith Diplomacy in strengthening the international refugee protection regime through the framework of international law. The research employs a normative legal approach using doctrinal, conceptual, and comparative analysis methods. The data are derived from international legal instruments, reports from international bodies such as UNHCR and OIC, and scholarly publications from 2020–2025. The findings indicate that faith diplomacy plays a strategic role in bridging the gap between positive legal norms and universal moral values, thereby enhancing the legitimacy and effectiveness of the implementation of non-refoulement, responsibility sharing, and respect for human dignity. Furthermore, faith diplomacy introduces a new paradigm in international law—a human-centered and ethical-normative approach—wherein legal norms gain both legal and moral legitimacy. Consequently, faith diplomacy serves as an ethical foundation for strengthening the global refugee protection regime toward greater inclusivity, adaptability, and justice.

Abstract

The discourse of distortion of the Ahmadiyya Community started in the early 2000s. The facts that occur in the field are the issuance of MUI fatwa stating that the Ahmadiyya Community is misguided and misleading. In 2004 this religious group received a reprimand from a regional official who issued a Joint Decree (SKB) for the regent, the ministry of religion, the Kuningan district prosecutor's office Number: 451.7 / KEP.58-Pem.Um / 2004 concerning the prohibition of Ahmadiyah teachings in the Kuningan Regency . The Joint Decree is a written policy from the government that is general in nature. But what happened to the Ahmadiyya Jama'at who was a member of the Jama'at was Indonesian citizens experiencing obstacles in public services including the prohibition of marriage registration at the Office of Religious Affairs (KUA) of Jalaksana sub-district and the postponement of E-KTP for members of the Ahmadiyya Manislor Jamaat District of Kuningan District. Therefore the problems examined in this thesis research are: how is the view of Siyasah Dusturiyah on Joint Decree (SKB) Number: 451.7 / KEP.58-Pem.Um / 2004 concerning the prohibition of Ahmadiyah teachings.This research uses the theory of siyasah dusturiyah, that the fiqh of siyasah dusturiyah is the relationship between the leader on one side and the people on the other side and the institutions in the community, of course the scope of the discussion. Therefore, in fiqh siyasah dusturiyah is usually limited to discussing the regulations and regulations that are demanded by matters of state in terms of compliance with religious principles and is the realization of human benefit and fulfill their needs. This research is a field research using descriptive-analytical method with a political sociology approach. This study found that the Joint Decree involving Kuningan district regional officials Number: 451.7 / KEP.58-Pem.Um / 2004 regarding the prohibition of Ahmadiyah teachings was constitutionally contradictory. Where the constitution protects Human Rights (HAM). Meanwhile, according to Siyasah Dusturiyah, with the issuance of the SKB, local government officials do not reflect the principles of Siyasah Dusturiyah which uphold the benefit and protection of citizens, based on the principles of justice (al-is) and equality before the law (al-Musawwah) . According to maqashid asy-shari'ah, the issuance of the Joint Decree on the prohibition of Ahmadiyah teachings in the Kuningan District Region reflected the absence of protection of the five main elements, namely hifzh al-din (maintenance of religion), hifzh al-nafs (maintenance of souls), hifzh al-aql ( mind maintenance), hifzh al-nasl (care of descendants), and hifzh al-mal (maintenance of property). Abstrak Diskursus pendistorsian Jemaat Ahmadiyah merebak di awal tahun 2000an. Fakta-fakta yang terjadi dilapangan adalah keluarnya fatwa MUI yang menyatakan bahwa Jemaat Ahmadiyah sesat dan menyesatkan. Pada tahun 2004 kelompok agama ini mendapat teguran dari pejabat daerah yang mengeluarkan Surat Keputusan Bersama (SKB) bupati, departemen agama, kejaksaan negeri kabupaten Kuningan Nomor : 451.7/KEP.58-Pem.Um/2004 tentang pelarangan kegiatan ajaran Ahmadiyah di Wilayah Kabupaten Kuningan. Surat Keputusan Bersama merupakan suatu kebijakan tertulis dari pemerintah yang bersifat mengatur secara umum. Namun yang terjadi pada Jemaat Ahmadiyah yang merupakan anggota Jemaatnya adalah Warga negara Indonesia mengalami kendala dalam pelayanan publik diantaranya adalah pelarangan pencatatan pernikahan di Kantor Urusan Agama (KUA) kecamatan Jalaksana dan Penundaan E-KTP bagi anggota Jemaat Ahmadiyah Manislor Kecamatan Jalaksana Kabupaten Kuningan. Oleh sebab itu permasalahan yang dikaji dalam penelitian skripsi ini yaitu : bagaimana pandangan siyasah dusturiyah terhadap Surat Keputusan Bersama (SKB) Nomor: 451.7/KEP.58-Pem.Um/2004 tentang pelarangan kegiatan ajaran Ahmadiyah. Penelitian ini menggunakan teori siyasah dusturiyah, bahwa fiqh siyasah dusturiyah adalah hubungan antara pimpinan di satu pihak dan rakyatnya di pihak lain serta kelembagaan yang ada di dalam masyarakat, sudah tentu ruang lingkup pembahasannya. Oleh karena itu, dalam fiqh siyasah dusturiyah biasanya dibatasihanya membahas pengaturan dan perundang-undangan yang dituntut oleh hal ihwal kenegaraan dari segi persesuaian dengan prinsip-prinsip agama dan merupakan realisasi kemaslahatan manusia serta memenuhi kebutuhannya. Penelitian ini merupakan penelitian lapangan (field research) menggunakan metode deksriptif-analistis dengan pendekatan sosiologi politik. Penelitian ini menemukan bahwa Surat Keputusan Bersama yang melibatkan pejabat daerah kabupaten Kuningan Nomor: 451.7/KEP.58-Pem.Um/2004 tentang pelarangan kegiatan ajaran Ahmadiyah bertentangan secara konstitusional. Dimana konstitusi melindungi Hak Asasi Manusia (HAM). Sedangkan menurut siyasah dusturiyah , dengan dikeluarkan SKB pejabat pemerintah daerah amatlah tidak mencerminkan prinsip-prinsip dari siyasah dusturiyah yang menjunjung tinggi kemaslahatan dan perlindungan terhadap warga negara, dengan berpijak kepada prinsip keadilan (al-adalah) dan persamaan di depan hukum (al-musawwah). Menurut maqashid asy-syari’ah dikeluarkannya SKB mengenai pelarangan kegiatan ajaran Ahmadiyah di Wilayah Kabupaten Kuningan mencerminkan tidak adanya perlindungan terhadap lima unsur pokok yaitu hifzh al-dīn (pemeliharaan agama), hifzh al-nafs (pemeliharaan jiwa), hifzh al-aql (pemeliharaan akal), hifzh al-nasl (pemeliharaan keturunan), dan hifzh al-māl (pemeliharaan harta).

Abstract

Freedom of religion in Indonesia has become a shared commitment, this is enshrined in the 1945 Constitution and Law Number 39 of 1999 concerning Human Rights. However, in practice there are still violations, this happens that there is an imbalance between the rules and law enforcement. So this study discusses how the freedom of diversity in the 1945 Constitution is viewed from prophetic political values; humanization (ta'muru bil ma'ruf), liberation (tanhawna 'anil munkar), and transcendence (tu'minu billah). This research is normative legal research or library research, which examines applied research through data collection or scientific writing work whose object or data collection is the library. This research concludes that the right to freedom of religion as regulated in Article 28 I paragraph 1 of the 1945 Constitution is in accordance with the spirit of the basic values ​​of prophetic politics, namely liberation, humanization and transcendence.
