Abstract

This study explores the application of substantive justice principles in Indonesia’s criminal justice system through the lens of natural law philosophy. Natural law demands a paradigm shift from rigid legal formalism toward an approach that emphasizes moral, humanitarian, and contextual justice values. Within this framework, law is not merely seen as a set of written rules, but as an expression of universal moral principles derived from human reason. The thoughts of philosophers such as John Rawls, Aristotle, and Jeremy Bentham reinforce the urgency of substantive justice, particularly in protecting vulnerable groups, restoring social balance, and achieving public benefit. This research employs a qualitative method with juridical and philosophical approaches, focusing on analyzing the role of law enforcement officials in implementing substantive justice through criminal sentencing. The findings reveal that the prevailing legalistic approach hinders the realization of substantive justice. Major obstacles include unequal access to justice, low integrity among law enforcers, and the dominance of retributive punishment. Although restorative justice practices are beginning to emerge, their implementation remains limited and inconsistent. The study recommends strengthening legal aid for vulnerable groups, internalizing ethical values in legal education and training, and developing policies aligned with substantive justice principles. Collaboration between the state, civil society, and academia is essential to building a criminal justice system that is not only repressive but also transformative and capable of serving as a means of social restoration that upholds human dignity.

Abstract

Disputes are inevitable in today's complex legal world, and effective and efficient resolution is crucial to maintain legal certainty. In addition to litigation in the Courts, Alternative Dispute Resolution (APS) is becoming increasingly popular. This is because it offers faster, cheaper and more flexible solutions. One of the most popular methods in APS is expert judgment. Therefore, this research will comprehensively examine the definition, function, process, and advantages of expert judgment in the context of dispute resolution. Expert judgment generally involves one or more experts in a particular field to provide an objective evaluation and comprehensive analysis of the technical or complex issues at the heart of the dispute. In contrast to expert testimony in Court, expert assessment in APS serves more as an instrument to help the parties understand the specific aspects of the problem, facilitate negotiations, and reach a mutually beneficial consensus. In addition, this research aims to provide a clear and comprehensive insight into the strategic role of expert judgment in realizing effective and equitable dispute resolution in Indonesia.

Abstract

The State Administrative Court is one of the executors of judicial power for people seeking justice regarding State Administrative disputes. Settlement of disputes in the general election of village heads through a State Administrative Court lawsuit is the appropriate legal action because the PTUN has the authority to decide and adjudicate disputes at the election stages. This research aims to review the execution process of decision Number 57/G/2020/PTUN.BDG. The method used in this research is qualitative with a normative juridical approach. The data collection used is literature. The results of this research show that the decision letter in question has been decided to be valid and declared to remain in effect since the PTUN decision has permanent legal force and the Regent of Cirebon did not make a new decision because the person who received the most votes in the process of recounting the votes at the Court regarding the elected Kuwu did not change. even though there were additional votes for all candidates from votes that were previously considered invalid.

Abstract

The rapid growth of the cosmetics industry demands effective product labeling regulations to protect consumers and ensure information transparency. Labels serve to convey essential details such as ingredients, benefits, usage instructions, and warnings. This study analyzes and compares the cosmetic labeling regulations of Indonesia’s BPOM and the United States FDA using a normative juridical method and a comparative approach. BPOM regulates labeling in detail through BPOM Regulation No. 18 of 2024, while the FDA refers to the Federal Food, Drug, and Cosmetic Act (1938) and the Fair Packaging and Labeling Act (1967). The differences lie in the substance of regulations, institutional structure, and notification systems, although both aim to provide accurate and non-misleading information to consumers. In conclusion, the labeling systems of both countries are complementary, and FDA practices may serve as a reference for Indonesia in enhancing digitalization and transparency in cosmetic labeling oversight.

Abstract

This research aims to analyze the dualism of cryptocurrency status in Indonesian regulations and its implications for metaverse transactions. Using normative legal research methods with statutory and conceptual approaches, the study finds that cryptocurrency is recognized as a legal commodity (Bappebti Regulation No. 8/2021) but prohibited as a payment instrument (BI Regulation No. 18/40/PBI/2016 jo. Law No. 7/2011). This dualism creates legal uncertainty in metaverse transactions that are virtual and cross-border. The research recommends a three-zone approach: red zone (physical transactions prohibited), yellow zone (virtual transactions permitted with strict supervision), and green zone (trading as investment commodity). This approach balances protection of Rupiah's monetary sovereignty with national digital economy development, creating legal certainty for metaverse business actors without sacrificing Indonesia's payment system stability.
