Abstract

On the development of the legal system is of course inseparable from the development of other fields, because the development of the legal system is part of the country's development. Legal development must be integrated and coordinated with the development agenda in other fields such as commercial law, which requires a continuous process. Currently, legal developments also need to pay attention to world developments. Here a clear strategy is needed so that legal developments can be harmonized with global developments without abandoning the values of the Indonesian nation. The purpose of this article is to examine the needs for the development of Indonesian commercial law and find a model of trade law reform that we want so that it can meet the needs and support the country's development. The approach taken in this paper is to standardize justice and collect secondary data sources through library research. Qualitative analysis of the collected data. Several provisions of the Criminal Code are outdated, and the related field of law is developing rapidly, which is no longer able to meet the current needs of trade law. Updating Indonesian trade law needs to be carried out immediately to meet developments, the needs of the national community and international demands. There are many modes to choose from for updating Indonesian trade law, including general codification mode, partial codification mode, statutory regulation preparation mode, open codification mode and partial regulation of Indonesian trade law. As trade law develops, it is believed that this will support Indonesia's vision of gold in the future.

Abstract

Refugees leave their places of origin for a variety of reasons, mainly because of things that could endanger their lives during their stay, such as war or persecution. Nor do they get protection from their own country, and their own government often threatens to persecute them. This research uses normative juridic methods. The forms of violations committed by foreign nationals as refugees in the RI Territory include illegal entry into the territory of Indonesia, fighting, rape, and destruction of refugee facilities. Then the cause of the violations of the law committed by foreign nationals as refugees in the RI Territory is the difference of national rules, culture, customs and customs in Indonesia and in the country of origin. Another reason why refugees and asylum-seekers roam to commit violations is the lack of immigration detention facilities in Indonesia. The Indonesian government has established special rules on the conduct of refugees and asylum-seekers in its territory, so as not to disregard the behaviour of the refugee and asylees.

Abstract

Threatening crimes are very easy to commit, moreover with modern means accessible, very common for someone to threaten someone by pressure, these threats can lead to death. Criminal sanctions against perpetrators of electronic media intimidation are based on Act No. 19 of 2016 on electronic information and transactions and criteria that determine the presence of threats through electronic media. This research uses normative jurisprudential methods, methods that point research to library data, or secondary data through legal foundations and legal comparisons. As regards the form of criminal sanctions for perpetrators of intimidation contained in Article 27 of the Act No. 19 of 2016 on Amendment of the Law No. 11 of 2008 on Electronic Information and Transactions, it is regulated in Article 29 jo. Article 45B of the law No. 11, 2008 on electronic information and transactions as amended by the Act no. 19 from 2016 on amendment to the Act of 11 of 2008.

Abstract

Islamic law does not recognize special marriage registration. In Islamic law, marriage registration is not referred to as one of the elements or conditions of marriage. In the days of the Prophet Muhammad SAW, there were no terms for recording marriages. An eligible marriage and a marriage ceremony are considered legitimate. This research uses a library method, which means that this research looks at the theories, concepts, and provisions of Islamic sharia'at related to the problem being studied. The istinbath qiyas method associates marriage recording with verse 282 of Surah al-Baqarah, which states that when a person makes a transaction, they must write it down. It's because with this record, people can avoid problems that may occur in the future if a denial occurs.

Abstract

Following Constitutional Court Decision No. 37/PUU-IX/2011, the Supreme Court, through its cassation decision No. 157 K/Pdt.Sus-PHI/2018, confirmed that procedural wages are limited to a maximum of six months, referring to Minister of Manpower Decree No. 150 of 2000. This provision imposes an additional burden on employers in cases of unlawful termination of employment. Although there were previously differences in judges' attitudes, the Constitutional Court's decision is now the main reference for ensuring that decisions related to procedural costs are more uniform and have permanent legal force.
