Abstract

The national sharia arbitration body (Basyarnas) is a non-litigation sharia economic dispute resolution institution that is considered capable of resolving disputes quickly, fairly and providing a win-win solution for the disputing parties. In addition, the decision is final and binding, meaning that the decision is a final decision that must be obeyed, the decision is binding on the parties to the dispute and there are no legal remedies for appeal, cassation or review as contained in litigation dispute resolution in court. However, at the practical level, the Basyarnas decision can be pursued by legal remedies to cancel the decision by submitting it to the court as also stated in Law Number 30 of 1999 concerning arbitration and alternative dispute resolution in article 70. This raises an indication of legal uncertainty or unclear nature of the final and binding contained in the Basyarnas decision. This study uses a normative juridical approach with a juridical descriptive analysis. This means that the approach taken is by examining the approaches to theories, concepts, studying the laws and regulations concerned with this research or the statutory approach. The results of this study conclude that the decision of the National Sharia Arbitration Board cannot be said to be final and binding because legal remedies can still be made through cancellation of the decision to the Court. The existence of the elements contained in Article 70 of Law Number 30 of 1999 the request for annulment causes uncertainty or unclear meaning of the final and binding nature and is contrary to the basic purpose of law, namely to provide justice, benefit and legal certainty.

Abstract

The paper assessed the extent to which the training and learning process of civil artisans under vocational education and training meets civil construction employers’ demanded competencies. Data were collected from trainers, learners, employees and employers through semi-structured interviews and structured questions. A qualitative exploratory approach was deployed with the help of MAXQDA2020 software. Content analysis was used to analyze documents and interview transcripts. It was found that to some extent the learning process captured employers to some extend despite several challenges on soft competencies which were seen demanded by employers. The article concludes that at least the hard competencies required for carpenters and masons were well covered by the curriculum and appreciated by employers although, outdated curriculum, inadequate teaching and learning resources, and exposure to practical work have a significant role to play and affect the employability of graduates. Despite, soft competencies including honesty, hard work, professionalism, and discipline were seen to be very important although there was no evidence that they were well imparted. Therefore it was suggested to collaborate with employers in imparting soft competencies.

Abstract

Humans as objects as well as subjects in psychological research. In a literary work, there is a character as an imaginary picture of humans in general. The psychological condition of the characters dramatically influences the storyline and point of view in the story. This study discusses the psychological condition of several characters based on age contained in the classic Javanese story in the NB 1801 manuscript entitled Cariyos Kidang Telangkas, collection of the National Library of Indonesia (PNRI). The manuscript is in the Javanese language and script, which raises the first problem: not everyone can understand Javanese script. The second problem is how age can affect the psychological condition of the characters in Cariyos Kidang Telangkas. The purpose of this research is to find out the contents of the NB 1801 manuscript, and the effect of age on the psychological condition of the characters in the story. The psychology of the characters is an important thing to study because the psychological conditions of the characters can affect the storyline through their actions and behavior of the characters. This study uses philology's methods and work steps, namely inventory to transliteration, then data and research objects use theory. Through this process, it was found that a person's age level can affect his actions, behavior, mindset, and psychological condition.
