Abstract

Abstract

This article aims to analyze the mechanisms for resolving defaults in Islamic financing agreements within Islamic financial institutions, highlighting the alignment of these practices with Sharia principles, particularly justice and the avoidance of usury, and identifying challenges and solutions to enhance their effectiveness. A thorough theoretical review of the concept of default in Islamic law, the principles of Islamic finance, and resolution mechanisms forms the basis of the analysis. The findings of the discussion indicate that Islamic financial institutions generally prioritize deliberation, restructuring, and mediation before resorting to arbitration or litigation. Ensuring the alignment of practices with Sharia principles requires strict oversight and consistent interpretation. Challenges such as differing understandings of Sharia principles and customer financial literacy can be addressed through regulatory standardization, education, strengthening the Sharia Supervisory Board, and leveraging technology. This article concludes that the resolution of defaults in Islamic financing should be based on justice and deliberation, with sanctions aimed at maintaining a balance of rights and obligations without involving usury, for the sustainability of a sound and equitable Islamic financial industry.

Strategic management is a systematic and structured process that enables organizations to formulate, implement, and evaluate strategies to achieve long-term objectives in a dynamic business environment. This literature review examines the nature of strategic management, including its definition, key characteristics, implementation stages, and importance for organizational success. The study employs a qualitative approach through comprehensive literature analysis from academic sources, journals, and case studies. Findings indicate that strategic management comprises three main stages: strategy formulation, strategy implementation, and strategy evaluation and control. Key characteristics include long-term focus, holistic approach, dynamic adaptability, and competitive advantage orientation. The research demonstrates that strategic management is crucial for organizations to achieve competitive advantage, adapt to environmental changes, optimize resource allocation, enhance organizational coordination, improve financial performance, manage risks, and foster innovation and sustainable growth. Abstract

Operational risk is closely related to various issues arising from process weaknesses. This risk significantly impacts both the financial and non-financial aspects of Islamic banking profitability. This study employs a quantitative approach with multiple regression analysis to explore the effects of Capital Adequacy Ratio (CAR), Third-Party Funds (DPK), and Financing to Deposit Ratio (FDR) on Return on Assets (ROA) in Indonesian Islamic banks. The analysis reveals that CAR has a positive and significant impact on ROA, with a beta coefficient of 1.130 and a significance value of 0.007. Conversely, DPK and FDR exhibit no significant effects on ROA. These findings highlight the critical role of capital management in supporting the profitability of Islamic banks.

Abstract

Zakat is a religious fiscal instrument that plays a strategic role in wealth redistribution and poverty alleviation. Among the objects of zakat with massive economic potential yet often overlooked are mining products (ma'din) and found objects (rikaz). This article aims to analyze in-depth the sharia provisions related to zakat on mining and rikaz through a descriptive qualitative approach. The study results indicate that differences in acquisition characteristics result in different zakat levels, namely 2.5% for mining and 20% for rikaz. Professional management in this sector is expected to become a pillar supporting the economic independence of the community.

Abstract

The tabarru' contract is an important instrument in the Islamic economic system, which is based on the principles of mutual assistance and brotherhood. Unlike the tijari contract, which is oriented toward commercial profit, the tabarru' contract aims solely to seek the pleasure of Allah SWT and to help others. This article aims to describe the definition, classification, and urgency of various types of tabarru' contracts through a descriptive qualitative approach. The study results show that tabarru' contracts are divided into several main categories, such as loans, services, and grants, all of which function as social buffers in the Islamic financial system. A deep understanding of these contracts is essential for Islamic banking practitioners to create a humanistic economic ecosystem.
