De Recht (Journal of Police and Law Enforcement) focuses on the publication of high-quality scholarly research in the fields of law, policing, and law enforcement. The journal provides a platform for the dissemination of original research, conceptual and theoretical studies, as well as critical reviews that contribute to the advancement of legal knowledge, legal practice, public policy, and the development of law enforcement institutions. Its scope encompasses a wide range of legal disciplines, including philosophy of law, legal theory, sociology of law, constitutional law, administrative law, public and private law, international law, human rights law, environmental law, business law, agrarian law, Islamic law, customary law, criminal law, criminal and civil procedural law, criminology, anti-corruption studies, cybercrime, criminal investigation, and crime prevention. Constitutional Court Decision Number 137/PUU-XIII/2015 and Constitutional Court Decision No. 56/PUU-XIV/2016 changed the supervision mechanism of local regulations in Indonesia. The verdict revoked the authority of the Minister of Home Affairs and the Governor. This is a legal research with conceptual and statute approach. The governor still has the authority to cancel local regulations, as determined from the results of the discussion. The governor can conduct preventive supervision and executive preview when the local regulation is still in the form of a draft. Executive preview can take the form of facilitation by the governor and/or harmonization of district/city regional regulations through the legal bureau in the province.

The judge's decision must be considered correct until there is a higher decision that annuls it. The judge's decision must be based on the principles of real justice not mere procedural justice. the judge's decision must be based on the applicable laws and regulations. Sentencing, legal remedies and execution of criminal decisions have been stipulated in the Criminal Code (KUHP). In the implementation of execution against the defendant, supervision is carried out by the judge. This is to ensure that the implementation is in accordance with the verdict and is carried out properly.

The research in this journal is entitled "The Problem of Constitutionalism of Village Head Tenure in the Dimension of the State of Law and Democracy". The request for an extension of the term of office of the village head is difficult because, although legally the problem is an open policy that can be used to make political laws, it is contrary to the ideals of Democracy which demands that power remain under control. The research conducted uses statutory (statute upproach) and conceptual (conceptual approach) approach techniques as part of normative Law research methodology. The findings of this study show that, in contrast to the tenure of regional heads and presidents and vice presidents, the 1945 NRI Constitution does not specifically limit the term of village heads. This is one of the factors that contribute to this variation of regulation inseparable. In the view of the State, Law and Democracy both allude to aspects of abuse of power when there is a longer period of power in the government structure.

Education is very important, especially as the first step in forming a person's character. Based on the 1945 Constitution Number 20 of 2003 concerning the National Education System, obtaining education is a right for all citizens, including prisoners. This research aims to find out and examine the implementation of the fulfillment of prisoners' rights in the field of education at the Class 1 Correctional Institution in Surabaya. The research method used is empirical legal research using a qualitative descriptive approach. This research method places the law as a guideline for behavior in life which is always interacting and connected in social aspects. This research concludes that according to the author, the implementation of fulfilling prisoners' rights in the field of education at the Surabaya Class 1 Correctional Institution has been well structured in accordance with statutory regulations, but in its implementation there are still many obstacles. Even though there are obstacles, based on the results of the author's interviews with several prisoner representatives, prisoner development activity programs such as the Sekar Mentari Elementary School Equivalency Course (KPSD) and Pursuing Equivalency Program Examination (UPK) Packages A, B and Package C must still be implemented to fulfill prisoners' rights in the field of education.

Population and economic growth have given rise to excesses in terms of ownership of land rights and obligations, whether social or individual. In this case, the government seeks to overcome various problems that arise by arranging this most strategic problem by affirming the legal certainty of land rights and obligations, a land registration process is needed. This research uses normative juridical methods, namely legal research conducted by examining library or secondary materials as basic materials which are then examined by conducting searches on regulations and legal materials related to the problems studied. The study concluded that PPAT has an important role in the transfer of rights, namely making authentic deeds regarding legal acts of transfer of rights which are then used as the basis for land registration. In the process of transferring rights, of course, it is related to BPHTB or Land Rights Acquisition Duty, which is the obligation to pay taxes for buyers due to the acquisition of land rights. PPAT in making a deed of sale and purchase of PPAT must ensure that all tax payment obligations must have been paid in full by the taxpayer, because before the tax wajin pays in full its tax obligations, PPAT must not make and sign the deed of transfer of rights. This is in accordance with the provisions of article 24 paragraph (1) of BPHTB Law No. 20 of 2000. If PPAT violates these provisions, PPAT will be subject to a penalty of Rp. 7,500,000.00 according to article 26 of BPHTB Law No. 20 of 2000.

Penelitian yang dilakukan dengan menggunakan metode hukum normatif melalui pendekatan undang-undang, pendekatan konsep, dan pendekatan kasus yang dilatarbelakangi atas perubahan kualifikasi tindak pidana dan pidana yang semula pidana mati menjadi seumur hidup pada pertimbangan putusan kasasi perkara pembunuhan yang dilakukan oleh Ferdy Sambo. Data yang digunakan dalam penelitian adalah berupa bahan-bahan primer, sekunder dan tersier, yang diperoleh melalui penelitian kepustakaan (library research) atau studi dokumen. Hasil dari penelitian ini menunjukkan terdapat kekurangcermatan penerapan asas obyektifitas, asas proporsionalitas serta analisa aspek filosofis, sosiologis, dan normatif atas kesalahan terdakwa dan penggunaan KUHP Nasional yang prematur dalam pertimbangan mayoritas hakim. Untuk mewujudkan putusan-putusan Mahkamah Agung yang mengutamakan rasa keadilan maka setiap hakim haruslah memiliki pedoman dan memahami dengan benar terkait segala nilai-nilai yang dipergunakan dalam pertimbangannya tanpa intervensi kepentingan kekuasaan manapun.

This study examines the responsibility of taxpayers who intentionally use the payable Value Added Tax (VAT) for the operational activities of a legal entity, within the context of the case Putusan Nomor 12/Pid.Sus/2022/PN Tte. The case focuses on Yan Quedarusman, the commissioner of CV. Samalita Perdana Mitra, who was charged with failing to report and remit collected taxes, resulting in a loss to state revenue amounting to Rp. 716,823,816.00. The defendant used his personal account for transactions, claiming that the company's account was inactive. This study analyzes whether the defendant's actions are in accordance with Indonesian tax regulations, particularly the Tax Law and the 1945 Constitution of the Republic of Indonesia. This research highlights the importance of the legal responsibility principle in relation to tax obligations, as well as the impact of non-compliance with timely and accurate tax reporting. The findings indicate that the defendant's actions were not in accordance with the applicable tax regulations, and emphasize the importance of compliance with tax obligations to prevent losses to the state.

In the study of inheritance law, we will study the question of who and what is being studied in this field, namely heirs, heirs and inheritance. In this article the author will examine the legal rules related to the position of substitute heirs who replace their parents to obtain inheritance. of an heir who has died, do not let his position and rights be eliminated, just because that party has the status of a substitute heir who replaced the position of his parents who died before the heir, therefore the writing of this article is focused on exploring what legal remedies should be taken. carried out by the successor heirs in order he gets his rights and how much part the replacement heir should get if he gets inheritance property. This research uses the library research method (Library Library), with a normative legal study approach, then the legal rule is obtained, namely that the replacement heir can file a lawsuit for the distribution of inheritance assets in the religious court where the testator dies, and receives the same share as the living heirs.

Penelitian dilakukan untuk mengetahui, menganalisis serta mengindetifikasi fenomena komunikasi melalui propaganda yang memiliki pengaruh signifikan terhadap dinamika demokrasi, khususnya dalam konteks Pemilu 2024 di Indonesia. Penelitian mengungkap bahwa propaganda politik memiliki peran ganda, yakni sebagai alat edukasi politik sekaligus instrumen manipulasi yang dapat menciptakan polarisasi sosial di era digital saat ini. Teknologi dan media sosial memfasilitasi penyebaran propaganda melalui mikrotargeting, hoaks, dan disinformasi yang memengaruhi opini publik secara masif. Penulis menggunakan metodologi normatif dengan pendekatan sosiolegis yang fokus pada analisis terhadap praktek propaganda politik yang terjadi melalui perang buzzer sosial media melalui aplikasi digital. Hasil kajian menunjukkan bahwa meskipun propaganda memiliki potensi positif dalam mengedukasi pemilih/ peserta pemilu, praktik propaganda negatif dapat mengancam integritas demokrasi. Oleh karena itu, regulasi yang ketat, peningkatan literasi media, dan pengawasan terhadap penyebaran informasi menjadi langkah penting untuk menjaga kualitas demokrasi.

Protection of children in conflict with the law has been regulated under Law No. 23 of 2002 on Child Protection and Law No. 3 of 1997 on Juvenile Justice. However, its implementation in practice still faces various obstacles, particularly in handling children in conflict with the law. Diversion and restorative justice have emerged as alternative approaches for resolving juvenile cases, with the police serving as the primary investigator through the exercise of discretionary authority. This study aims to analyze the factors underlying the implementation of diversion, the strategic role of investigators in its implementation, as well as the obstacles and impacts that arise during the diversion process. The research employs both normative and sociological juridical approaches to obtain an in-depth understanding of diversion practices. Primary data were obtained through in-depth interviews with police officers, correctional facility officers, NGO activists, and academics in the field of child protection, while secondary data were collected through a literature review of statutory regulations, books, journals, and various related literature. Data were analyzed qualitatively to provide a comprehensive overview of diversion practices within the juvenile criminal justice system in Indonesia. The research findings indicate that diversion can be implemented through the role of investigators, with the positive impact of restoring social relationships between victims and perpetrators. However, the implementation of diversion still faces structural and cultural barriers, including a lack of awareness among investigators and the public, as well as insufficient supporting facilities.
