Abstract

This study addresses legal protection for workers in relation to Work Accident Insurance (WAI), particularly when accidents occur outside regular commuting routes. WAI exists to mitigate the risks of work-related accidents, including those on the way to or from work, and illnesses caused by the work environment. However, concerns arise when companies violate occupational safety and health standards, potentially preventing workers from receiving rightful claims. The study aims to analyze the legal protection available for workers—especially BPJS Employment participants—who suffer accidents outside routine routes, and to identify the factors influencing eligibility for JKK (Work Accident Security) benefits. Using a normative legal research method with statutory and conceptual approaches, the study employs descriptive, evaluative, and argumentative analyses. The findings show that when accidents occur outside the usual commuting route, preventive legal protection is provided through case diagnosis, while repressive protection involves legal complaints when claims are denied. The eligibility for JKK benefits is based on specific criteria outlined in Ministerial Regulation No. 5 of 2021, including the time, location, and causal relationship of the accident to the employment. Thus, while protection exists, the recognition of claims outside standard routes depends on strict interpretations of regulations, requiring improved clarity and fairness in implementation.

Abstract

Buying and selling transaction activities have developed hand in hand with improving technology. The increase in E-Commerce media also gave birth to a Marketplace. One of the Marketplaces in Indonesia is Lazada. In the Civil Code, Article 1457 explains the definition of buying and selling. Even though the agreement was formed with the intention that all transactions go well, when one of the parties does not fulfill the agreement's contents, this is the default. The problem that arises from this is that many sellers commit defaults, such as sending goods that are not suitable. This research aims to find out the form of the seller's default responsibility in the online sale and purchase agreement on the Lazada Marketplace and to find out the buyer's legal protection due to default by the seller in the online sale and purchase agreement on the Lazada Marketplace. This study uses normative legal research. The study results show that sellers committed default cases in carrying out what was promised. However, it should not have been promised. The seller is responsible for exchanging goods in line with the two principles of accountability, namely, the principle of liability based on fault and the principle of breach of warranty. According to Article 1234 of the Civil Code, compensation for costs, losses, and interest due to non-fulfillment of the agreement is only obligatory if the party must fulfill the agreement after being declared negligent in fulfilling the agreement. The seller must carry out the form of responsibility as compensation.

Abstract

Law Number 11 of 2020 concerning Job Creation (hereinafter referred to as the Omnibus Law) was enacted and signed by the President on November 2, 2020. The Omnibus Law aims to reform regulations by simplifying the legal framework to address the lack of synchronization among various laws and regulations, as well as eliminating overlapping rules that are considered to hinder the government's objectives. Constitutional Court Decision Number: 91/PUU-XVIII/2020 on the Formal Review of the Job Creation Law, issued by the Constitutional Court on November 4, 2021, granted the petitioner's request for a formal review of the Omnibus Law. On December 30, 2022, the Government issued Government Regulation in Lieu of Law (Perppu) No. 2 of 2022 on Job Creation as a follow-up to Constitutional Court Decision Number: 91/PUU-XVIII/2020. The research conducted in this study is normative, analyzing the judges' considerations in Constitutional Court Decision Number: 91/PUU-XVIII/2020, with a focus on the ambiguity/difference in interpretation among the nine judges regarding Law No. 12 of 2011 and the fulfillment of the urgency element in Perppu No. 2 of 2022. The author adopts a legal and case-based approach and utilizes primary and secondary legal sources to analyze the issues. The author employs a prescriptive method of analysis. In the decision, the judges did not consider the substantive principles of legislation and found that the element of urgent necessity, which compelled the issuance of the Job Creation Perppu, was not fulfilled.

Abstract

Modification of motorized vehicles today is done by many people in Indonesia. One of them is modifying the exhaust by replacing it with a racing exhaust. Vehicle modifications are still allowed but must be in accordance with the corridors of the provisions of Law Number 22 of 2009 concerning Road Traffic and Transportation, namely meeting technical standards and roadworthiness. The use of racing exhausts that do not meet the rules can be subject to action by the police, especially in the Ponorogo Resort Police area. On this basis, this study reviews how law enforcement against racing exhaust users in the Ponorogo Resort Police Region and looks for obstacles to law enforcement against racing exhaust. This research is a Juridical-Empirical research by looking at legal phenomena obtained by field interviews combined with legal documents. The results obtained show that Law Enforcement in the Ponorogo Resort Police Area uses Law number 22 of 2009 concerning Road Traffic and Transportation with the main provisions using the sound level as stipulated in the National Police Telegram Letter ST/1045/V/HUK.6.2/2021 and noise level rules in accordance with the Minister of Forestry and Environment Regulation Number 7 of 2009 concerning the noise threshold of new type vehicles. Then for obstacle factors influenced by Law Enforcement Factors, Community Factors and Facilities and Infrastructure Factors.

Abstract

The implementation of specialized medical education involves two main aspects: academic training and healthcare services at Teaching Hospitals. While Postgraduate Medical Students (PPDS) fall under the authority of educational institutions, they also serve roles in hospitals, creating the need for clearer legal regulation. Unlike the well-defined relationship between educational institutions and teaching hospitals—governed by a Cooperation Agreement under the Medical Education Act—the legal status of PPDS within hospitals remains unregulated. This study aims to identify the legal basis for PPDS involvement in healthcare services and assess whether such involvement constitutes an employment relationship under labor law. Using a juridical-normative approach, the research finds that, due to the lack of specific legislation, each Teaching Hospital independently regulates the PPDS relationship through internal policies. Labor law defines employment relationships cumulatively, requiring elements such as work, orders, and remuneration. The study concludes that PPDS service in hospitals does not fulfill all these elements—particularly remuneration—since the incentives PPDS receive differ from the legal concept of wages. As a result, the relationship between PPDS and Teaching Hospitals cannot be categorized as an employment relationship under labor law.

Abstract

Waqf has significant potential to improve public welfare in Indonesia and continues to evolve in line with societal changes. As an ijtihadi concept, waqf is open to contemporary interpretations, one of which is profession waqf—introduced by the Indonesian Waqf Board (BWI). Profession waqf refers to the endowment of one’s physical or non-physical expertise for the benefit of the public, in accordance with Islamic law. This study aims to explore the concept and subject of profession waqf in Indonesia using normative legal research with statutory and conceptual approaches. Legal materials are analyzed prescriptively to address the core issues. The research concludes that profession waqf involves dedicating an individual’s skills or professional services for public good and must be carried out in line with sharia principles. The actors involved include: (1) the profession wakif, who endows their expertise; (2) the nazhir, who manages and develops the waqf; and (3) the mauquf alaih, the beneficiaries who may be specifically named or generally intended in the waqf pledge. This form of waqf allows professionals to contribute meaningfully to society, not just through material wealth, but through their knowledge and skills.

Abstract

Consumer protection in Indonesia is governed by Law No. 8 of 1999 (UUPK), which aims to ensure legal certainty and safeguard consumer rights. The law provides for criminal sanctions in Articles 61 to 63; however, these are often viewed as inadequate, as they emphasize punitive measures against business actors rather than restitution for consumers. A more effective approach would prioritize recovery and reparation of consumer losses, aligning better with the goals of criminal law reform. This research seeks to evaluate the accuracy and effectiveness of criminal law provisions within the UUPK in achieving justice and legal order. Employing normative juridical methods with statutory and conceptual approaches, the study analyzes both primary and secondary legal materials using prescriptive analysis. The findings reveal several shortcomings in the current formulation and implementation of criminal provisions in consumer protection. These include the lack of fulfillment of key criminal law principles: (1) the principle of reasonable loss, as not all violations result in criminal-worthy harm; (2) the principle of subsidiarity, since criminal law should be a last resort (ultimum remidium); (3) proportionality, where punishment should reflect the gravity of consumer loss; and (4) the principle of legality, particularly lex certa and lex stricta. On the other hand, the principle of tolerance in defining criminal acts is found to be fulfilled. Overall, a shift toward restorative justice and proportional sanctions is needed for more effective consumer protection.

Abstract

Law enforcement against advertising fraud in the digital space encounters several challenges, including regulatory gaps, ambiguous interpretation of the ITE Law, and the need for collaboration between the government, platform providers, and consumer awareness. This study aims to examine the criminal liability and legal consequences for users of electronic advertising services who place fraudulent ads through electronic system providers' advertising platforms. Using normative legal research with statutory and conceptual approaches, this study analyzes primary legal materials such as the ITE Law, Consumer Protection Law, and Broadcasting Law, supported by relevant legal literature. The analysis is conducted descriptively and prescriptively to address the core legal issues. The findings indicate that placing fraudulent advertisements through digital platforms may result in criminal sanctions, including prosecution, fines, or imprisonment. In addition to individual liability, corporations involved may face administrative penalties, such as license revocation, as well as civil lawsuits. These legal consequences can lead to substantial financial losses and reputational damage. Therefore, users of electronic advertising services—whether individuals or corporations—bear significant legal risk when engaging in fraudulent advertising practices.

Abstract

Permasalahan sengketa perpajakan di Indonesia antara lain beban perkara di Pengadilan Pajak yang belum diputus serta penyelesaian sengketa perpajakan di dua pengadilan yaitu PTUN dan Pengadilan Pajak. Hal tersebut menimbulkan inefisiensi dalam penyelesaian sengketa perpajakan. Penelitian ini bertujuan untuk merumuskan reformasi perpajakan dengan merekonstruksi sengketa dan penegakan hukum perpajakan yang berlandaskan pada nilai-nilai Pancasila sebagai cita hukum Indonesia. Penelitian ini merupakan penelitian hukum normatif dengan mengedepankan pendekatan konseptual, perundang-undangan dan perbandingan. Hasil penelitian menunjukkan bahwa urgensi penyelesaian sengketa dan penegakan hukum perpajakan yang mengacu pada nilai-nilai Pancasila sebagai cita hukum Indonesia diharapkan mampu menerapkan tiga nilai dalam Pancasila yaitu musyawarah mufakat, nilai efisiensi dan nilai keadilan yang diharapkan dapat diterapkan dalam sengketa dan penegakan hukum perpajakan yang lebih efisien. Rekonstruksi sengketa dan penegakan hukum perpajakan yang berlandaskan pada tiga nilai utama dalam Pancasila, yaitu nilai musyawarah untuk mufakat, nilai efisiensi dan nilai keadilan, memerlukan reformasi perpajakan melalui revisi peraturan perundang-undangan dengan metode omnibus law. Untuk itu diperlukan rumusan Undang-Undang Sengketa Pajak dengan metode omnibus law yang merevisi beberapa undang-undang terkait seperti Undang-Undang Pengadilan Pajak, Undang-Undang HPP, dan berbagai peraturan perundang-undangan terkait lainnya. Dalam praktiknya, gagasan rekonstruksi sengketa dan penegakan hukum perpajakan perlu dilakukan dengan mengedepankan mediasi perpajakan, penyelesaian sengketa perpajakan di Pengadilan Pajak dan mengoptimalkan pendekatan preventif seperti e-tax consulting.
