Abstract

In general, Future Package Financing (PMD) is a product from BTPN Syariah which is given to underprivileged women in rural areas who can be used for business development. PMD uses a wakalah wal murabahah contract. This research aims to find out about the implementation of the wakalah wal murabahah agreement in PT Future Package (PMD) financing products. BTPN Syariah KCP Panyabungan. The research approach used in this research is descriptive qualitative with data collection methods, namely using observation, interviews and documentation studies. The results of the research concluded that the implementation of the wakalah wal murabahah agreement in PT Future Package (PMD) financing. BTPN Syariah KCP Panyabungan uses DSN-MUI Fatwa No. 4 of 2000 concerning Murabahah, as a legal basis, there is a discrepancy, because the murabahah contract is executed before the wakalah contract. And the object of the contract is only in the form of money, the bank only offers a limit for money loans, not buying and selling (murabahah), the profit sharing margin is 30% which is taken not from profits from buying and selling goods (murabahah) so it is the same as borrowing money at conventional banks.

Abstract

The principle adopted in buying and selling online is an attitude of trust. After mutual trust, there will be an agreement between the seller and the buyer, then both parties exchange information to follow up on the sale and purchase transaction. Islam has clear rules regarding buying and selling transactions as a basis for business transactions for Muslims The existence of a pre-order trading system or ordering goods before the goods are available has become a significant trend in online commerce today. In the context of pre-orders, business actors risk unilateral cancellation from consumers after they order goods. This can be detrimental to business actors, especially if they have ordered or produced goods based on the number of orders. Islamic law emphasizes the concept of justice in all aspects of life, including in business transactions. Therefore, protection for business actors must also reflect fairness for both parties. From the background above, the author takes the formulation of the problem of how to protect business actors due to unilateral cancellation from consumers in the pre-order method of buying and selling online (a study in Islamic law).

Abstract

This research aims to explore the application of Maqasid Shariah principles in modern business, which includes the protection of religion, life, intellect, progeny, and wealth, as an ethical framework to align economic goals with social responsibility. This research uses a qualitative method with a literature study approach, analysing related literature to gain in-depth insights. The research steps include data reduction, data presentation, and conclusion drawing. Data reduction was conducted by selecting relevant literature based on quality and relevance, while data presentation was carried out through matrices and diagrams to identify the relationship between Maqasid Shariah principles and modern business elements, such as ethical decision-making and sustainability. The results show that the implementation of Maqasid Shariah principles can increase consumer trust, promote business sustainability, and attract investors through an ethical approach. Businesses that integrate these values tend to be more inclusive and socially responsible. However, the research also found significant challenges, including limited understanding of Maqasid Shariah, commercial pressures, and regulatory barriers. Proposed solutions include education, cross-sector collaboration, and policy harmonisation. Academically, this study contributes to the growing discourse on Islamic business ethics by developing a conceptual linkage between Maqasid Shariah and contemporary sustainability paradigms, particularly Environmental, Social, and Governance (ESG) principles and stakeholder-oriented business models. It also extends the application of Maqasid Shariah beyond its traditional legal and theological domains into the field of modern business management, providing a comprehensive framework for integrating ethical, social, and economic objectives. With these findings, this research contributes to the advancement of both theory and practice in modern business by offering an ethically grounded and sustainability-oriented business framework.
