Abstract

Everyone should undesrtand the knowledge or science, for getting the perfection of himself and goodwill, straightening his behavior, and because God honor and prise him, and promise a great reward, and if science requirement of every human being, especially intellectuals and scholars, do not mean to learning whatever would or ever, but they should priority conviction science, it means conviction in science should be the porpouse of scholar looking for the right, and take the path or approach that give him a ride to achieve this porpouse. This article talks about the concept of understand and knowledge of al-Qushayri who is the big scholar of Islam.

Abstract

This research discusses about Sharia (Islamic Law) in case of consequences ofthe cancellation of lease contract. TI1e conclusion of this study is that the leasetransaction null and void for several reasons: al-iqalah (cancellation from eitherparty), khiyarat (the bidding), al-'udzr (things that prevent one party caimotcontinue ilie aqd), istihalah tanldz (some reason that caused all the parties caimotcontinue the aqd), istihqaq al- ain al-mustajirah (the leased goods has become theproperty of tenants), one of the parties dies. The ability of the writer how toaescribe the views of senior muslim scholars and t:hier followers such asHanafitic, Malikite, Shafiite, Hanbalite, as well as contemporary scholarsbecome feature of this research. TI1e research refers to the classic and modernbooks, by critical a11alysis reading.

Abstract

This study examines the resolution of conflicts between states based on the peacefulconcept, while the ways that based on violence and military force has been consideredby the international community as an illegal concept. The method of study is to compareand analyze the basic principles of resolution conflict based on peaceful that contained inthe international law and Islamic law. The result of research, it is known that resolutionof conflict which based on peaceful refer to how effectiveness of governance or goodgovernance, mediation, investigation, conciliation and other means.

Abstract

This paper endeavors to separate between fundamental sides of Islam and its branches, to explain approaches of law schools leaders (aimmatu al-madhaahib) over debatables thinks. Every school was not established following appetite of its founder, indeed every school and whole opinions herein were connected methodologically by golden transmissions (salaasil dzahabiyyah) unto Prophet PBUH, showing urgency of unfanatic character to such opinion, denying who just group of people with sinners, apostators, or performing evil-doings only base on such opinion that they have betrayed their school. In fact, this matter is fluid, and one duties of scholars who issuing legal opinion (fatwa) is twinning all-oriented, not separating peoples. Next, verdict of the judge in such case and its application over public with particular opinion or school has ultimately finished different opinions herein. No one who is uncovered this verdict, then they must follow it denying social conflict performs, showing that the verdict is reliable opinion over other differences by reffering toward Dar al-Ifta al-Mishriyyah. The approaches of research on Dar al-Ifta and their roles are by their publications, interviewing some trustees who answer religious questions from the public and its impacts to protect islamic culture and stability in Egypt. The research concluded that Dar al-Ifta model of issuing fatwa is the most appropriate.

Abstract

This study consists of three topics: the unity of knowledge in Islamiccivilization, Islamic rationality as a mechanism of Ijtihad, tolerance andopenness for the new culture. The study confirms that Islam is a God devinethat makes Muslims that passes specific position, guidance, and control uponthe world, and commitment with the principles that direct them to be a leaderin this world. Muslim’s position will be right if it is based on respectablefreedom, high spirit, and free thinking, adopted from the suitable environmentsurrounded with the west. Islam has reliable standard and flexibility ininteraction with the West, Islam can accept or reject, depending on its benefitand its danger, and its suitability with the concept of Islamic Tauhid as theimportant basis of Islamic view. The Study refers to the Quranic texts andHadis texts, as well as it refers to both classical and contemporary books.

Abstract

This article aims to analyze reading in consumer law that is the duties and responsibilities of product owners that consumers should know. It also aims at presenting objective perceptions of this law. This article is based on critical analytical approaches. The main source of this article is the text of the Republic of Indonesia Act number 8 of 1999 on consumer protection. Secondary sources are research and studies dealing with this issue. One of the highlights of this article is to review and reflect on the concern about consumer protection and regulation to achieve the interests of consumers in the first place, by activating all existing elements: from the community and civil institutions to the government through the minister concerned. The Consumer Protection Act must be based on several principles and principles called liability principles that eventually lead to consumer rights.

Abstract

The writing of research results or scientific papers in the field of siyasah syar 'iyyah must be in line with the mastery of steps, forms and methods. In this article, the author manages to explain these three aspects, which includes the title selection technique, the procedures of expressing the essence of research consisting of introduction, chapters of discussion and closing along with attachments.  In addition, the writer also describes in detail some of the important points that must be included after expressing the essence of research, such as interpreting the result obtained from the research, providing suggestion and recommendation regarding the results obtained, proposing a research or further studies related with the discussed theme.

Abstract

As an agreement of Muslim’s ummah that Islamic politic is a necessity, because of it is flexibility and comprehensive and can accommodate a development in contemporary life. The goal is to manage the affairs of the Muslims, both internally and externally in accordance with the teachings of the Qur’an. As well as it aims to prove that the teachings of Islam is compatible to perform a justice in regulating a good citizens, and set up an organization and public institutions to serve peoples in the community securely and peaceful. It happened because of political Islam consistently seeks to go hand in hand with social development at any time as well as the general principles of Islam.
