Abstract

Indonesia is a developing country and thus requires a large amount of fund for its development. The mains source of funding of a country is from tax. However, a significant amount of Indonesians have not paid their tax duties despite of the law. The low quality and complicatedness of taxation bureaucracy are the two main factors that causes the disobedience. The Mister of Economy is well aware of this situation and he believes that there is a high tax potential in Indonesia. Indonesians however, fear the administration sanctions and punishments the might receive if they were to pay off the tax debts that they have put off for years. Hence, the Mister of Economy implements a reformation on taxation system policy, which is the Tax Amnesty. This report explores the procedures, requirements, scope, and mechanism of Tax Amnesty, observed from the internship done at tax consultant office called Absolution, as a junior service staff on reporting the to the Tax Amnesty. The office accepts tax services such as facilitating clients who are interested in joining tax amnesty program.

Abstract

In law there are events or events in human life that need to be registered officially so that there is certainty about the incident such as marriage, birth, confession of birth, divorce, and death. Marriage is the inner bond between a man and a woman as husband and wife, whereas the purpose of marriage is to form a happy, everlasting family / household based on the One Godhead. Marriage is the same as important events in the life of a person, so it needs to be listed to give legitimacy to both parties both husband and wife. In addition to forming a happy family / household, marriage also has another purpose to get offspring or children. The status of the child has been known to be a legitimate child, an outsider and an adopted child. Subjects concerning the status of children outside marriage or children born to unmarried fathers and mothers in a marriage are called illegitimate children or married children having a civil relationship with their mother and mother's family, as mentioned in Article 43 paragraph (1) of Law no. 1 Year 1974 About Marriage. Inheritance is a law that regulates the transfer of ownership rights to the heirs to the heirs, determines who has the right to become an heir and what part thereof. This means that inheritance occurs due to the death of Article 830 of the Civil Code, which determines that inheritance only occurs due to death.

Abstract

The purpose of this thesis journal is to meet the graduation requirementfor the Bachelor of Law from the Law Faculty of Universitas Surabaya. Thepractical aim of this paper is to determine whether a third-party whom is not tiedto an arbitration clause could be treated as parties to an arbitration agreement, andthus be bound by the arbitration decision. In general, the settlement of arbitrationis based on the arbitration agreement written by the parties in a dispute. In thecase of quarrel between PT RII against PT PT ISI and PT BKDI, there is a third-party involved — PT BKDI — which was not bound by the arbitration clauses. Theinvolvement of the third-party was approved by Badan Arbitrase PerdaganganBerjangka Komoditi (BAKTI), but struck down by the Supreme Court due to thenon-binding nature of a written agreement of arbitration to said third party. Therefore, the decision of BAKTI was overturned. However, according to Article30 of Arbitration and Alternative Dispute Resolution Law, there is a possibility ofinvolvement from third-party in the arbitration case with some limitations. If theterms and conditions are met, the involvement of the third-party can be consideredlegally valid in the arbitration process.
