Abstract

Republik Krimea kembali didirikan sebagai entitas otonom dan sebagai subjek federal Rusia pasca referendum 2014. Dahulu Krimea merupakan sebuah Dinasti Islam Terkuat di Eropa Timur, yang bernama Khanate Crimea. Namun akhirnya seiring waktu menjadi bagian dari Uni Soviet yang kemudian diserahkan kepada Ukraina oleh Nikita Khrushchev sebagai hadiah. Krimea dalam statusnya saat ini masih simpang siur. Sebagian besar masyarakat internasional kecuali Zimbabwe, Venezuela, Suriah, Nikaragua, Sudan, Belarus, Armenia, Korea Utara dan Bolivia tidak mengakui aneksasi dan mempertimbangkan Krimea menjadi wilayah Rusia. Di semenanjung Krimea terdapat dua subyek federal yaitu Republik Krimea dan kota federal Sevastopol.

Abstract

Territory is an important attribute for a country, because it relates directly to aspects of sovereignty. In Indonesia, territory is regulated in Article 25A of the 1945 Constitution of the Republic of Indonesia and Article 33 paragraph (3) of the 1945 Constitution of the Republic of Indonesia which regulates state control over natural resources in the form of earth, water and the wealth contained therein. However, both of them do not reflect the concept of a complete territory or a 3-dimensional area, namely land, sea and air. Even though it is so important to regulate the territory and complete spatial planning, this is to provide certainty for the state in applying the boundaries of its territorial territory to maintain state sovereignty and protect all the potential of its natural resources.

Abstract

Since the discovery of the fraudulent investment case carried out by Doni Salmanan, law enforcement officers then confiscated the financial assets involved in the case. In addition to the ownership of luxury homes, financial assets in banks, to gifts that were given to a number of public figures. There were also several public figures who then voluntarily returned the gifts to police investigators, but the question arose as to whether returning the items could abolish the ongoing legal process. This paper tries to examine these events from the perspective of criminal law theory, law enforcement, and jurisprudence. Then it was found that returning the goods/gifts resulting from a crime does not necessarily negate or abolish the ongoing legal process, but it can be considered by the judge in deciding the case. In addition, for gifts that are still in the possession of the recipient of the gift, it is possible that the gift will be confiscated by investigators for the sake of investigation.

Abstract

One of the goals of Job Creation is to achieve economic equity through ease of doing business. However, the existence of the Job Creation Law has actually added new problems, especially regarding legal protection for workers who are not included in the pension program. This is due to the imposition of sanctions, both imprisonment and fines to corporations that do not provide severance pay. For workers who are not included in the pension program, it is abolished by the Copyright Law. Therefore, the State must be present to provide legal protection and guarantee the fulfillment of rights for workers/laborers through the establishment of laws and regulations that favor the lower classes of society.

Abstract

Having a large territory with ethnic diversity and nationalism makes the Russian Federation state must provide strategic policies, in order to regulate relations between the center and the regions. The existence of 83 Federal or State Subjects in the Russian Federation made President Vladimir Putin issued a policy in 2000 to establish 9 Federal Districts dividing federal subjects into federal districts headed by an official directly appointed by the president. This makes Russia a unique and interesting country in the analysis of constitutional law studies.

Abstract

The Pesantren Law is an affirmation of the importance of Islamic boarding school which is currently known as the propagator of the Islamic concept of Washatiyah. The enactment of the Law on Islamic Boarding Schools will further expand and strengthen the solemnity of participants in various fields, especially in the aspect of tafaqquh fiddin, da'wah, community empowerment, and economic empowerment of the people, and many aspects others who often become the work of Islamic boarding schools. This article explores the process formulation of the Law on Islamic Boarding Schools, debates in articles and verses in the Law on Islamic Boarding Schools, and the role of Islamic social organizations, and political parties in the process formulation of the Law on Islamic Boarding Schools.

Abstract

The naming of states or regions in the Russian Federation is different from other federated states, such as the United States, which uses the word State, or Province in India, Pakistan, and others. Russia has asymmetric subject nomenclature. No homogeneity. The Russian Federation has the Republic, Federally Important Cities, Krais, Oblasts, Autonomous Oblasts, and Autonomous Okrugs. Each Federal Subject has a head, legislature, and constitutional court backed by the constitution and federal law.

Abstract

Republik ini dibentuk setelah Revolusi Oktober 1918. Dekrit pemerintah Soviet, Komune Pekerja Jerman Volga, memberikan status khusus kepada Jerman Soviet di antara orang-orang non-Rusia di Uni Soviet. Kemudian statusnya ditingkatkan ke status Republik Sosialis Soviet Otonom tahun 1924 oleh Deklarasi Komite Eksekutif Pusat seluruh Rusia dan Dewan Rakyat Komisaris SFSR Rusia. Namun, karena adanya invasi Jerman ke Uni Soviet pada tahun 1941 maka menandai berakhirnya ASSR Jerman Volga. Pada tanggal 28 Agustus 1941, republik secara resmi dihapuskan dan, karena takut mereka dapat bertindak sebagai kolaborator Jerman. Ironisnya, semua orang Jerman Volga diasingkan ke RSS Kazakh, Altai, dan Siberia. Bahkan sebagian ahli sejarah mengatakan ini sebagai bentuk genosida bangsa Jerman Rusia. Pasca perang dunia kedua, dan terbentuknya Jerman sosialis di Jerman Timur, Republik Sosialis Soviet Otonom Jerman Volga tidak pernah dibangun kembali. Bahkan pada masa pemerintahan Presiden Nikita Republik-Republik lain seperti Kabardino Balkaria, Republik Krimea dikembalikan statusnya, namun tidak untuk Republik Volga Jerman ini.

Trafficking in Persons is "the act of recruiting, transporting, harboring, transmitting, transferring, harboring or receiving persons using the threat of force, use of force, of abduction, of abduction, of fraud, of deception, of the abuse of power or a position of vulnerability, or of providing for the payment of debts or benefits to achieve consent. from people who have control over other people, whether carried out within the country or between countries, for exploitation or leading to exploitation.” Considering that Human Trafficking is a crime against humanity that cannot be tolerated.

Abstract

The sensitivity of harmonization to the regulation of the Manpower Law into Law No. 11 of 2020 concerning Job Creation (Omnibus law) gave birth to various debates among legal experts in Indonesia. The establishment of the Job Creation Law in Indonesia is considered not based on the methods specified in the 1945 Constitution and Human Rights. This is based on legal considerations that have been read by Constitutional Judge Soehartoyo. Following the joint agreement of the Dpr and the President, many components of the text of the Job Creation Law were changed. This article agrees with the opinion of Edi Kastro (2020), Chamdani (2022) that the role of the government is very much needed in the welfare of human rights as long as it does not conflict with other laws and regulations.
