Abstract

Human rights issues are often a driving factor for foreign intervention in a country's domestic affairs. However, this creates an ethical dilemma between state sovereignty and the protection of human rights. Countries accused of violating human rights often face international pressure and threats of intervention that could disrupt domestic stability.

Abstract

This essay examines the concept of sovereignty as the highest power in a state, focusing on the absolutist view that views sovereignty as the absolute power of the ruler. In a historical perspective, especially in medieval Europe, to the era of absolute monarchy, the highest power was considered to belong to the king, who was not limited by law or other institutions. Jean Bodin became an important figure who formulated sovereignty as the power that cannot be divided and comes from divine legitimacy. However, this view was challenged by liberal thinkers such as John Locke, who rejected absolute power and emphasised that true sovereignty lies in the hands of the people. He introduced the idea of limiting power through law and protecting fundamental individual rights, becoming the foundation of the modern legal state theory. In the current democratic system, sovereignty is manifested in the form of the supremacy of law, separation of powers, and popular participation. In the era of globalisation, the concept of absolute sovereignty is increasingly eroded. The state must submit to international law and agreements, showing that sovereignty is now limited and interrelated. This essay closes with a reflection on the fact that absolutism of power as sovereignty has evolved in the dynamics of the times.

Abstract

The essay entitled The Emergence of State Sovereignty in a Philosophical Dimension examines in depth the concept of sovereignty in a philosophical context, starting from the basic understanding to its role in the formation of the state. This essay discusses how sovereignty becomes a fundamental principle that affirms the highest authority of a state in regulating its territory and people without external intervention. By examining classical to modern views, such as the social contract theory of Hobbes and Rousseau and the concept of absolute power according to Bodin, this essay explains that sovereignty can only exist through the existence of the state as a legitimate political entity. In addition, this essay outlines the reciprocal relationship between the state and sovereignty, and highlights the evolutionary view that encourages the adaptation of sovereignty to social developments. In closing, this essay emphasizes that sovereignty reflects the superiority of the state in determining its own destiny, while also being the main foundation in maintaining stability and order in the international system.

Abstract

Esai ini membahas secara mendalam dilema kedaulatan hukum dalam negara modern dari perspektif filosofis, menyoroti ketegangan antara penegakan hukum, hak asasi manusia, dan kekuasaan negara. Dalam konteks negara modern, kedaulatan hukum seharusnya menjamin supremasi hukum yang adil dan mengatur kekuasaan negara agar tidak bertindak sewenang-wenang (Locke, 1689). Namun, dalam praktiknya, sering kali terjadi penyalahgunaan hukum sebagai alat legitimasi kekuasaan, terutama dalam situasi darurat yang mengancam keberlangsungan negara (Schmitt, 1922; Agamben, 2005).Esai ini mengupas paradoks antara kedaulatan hukum dan hak asasi manusia dalam negara demokratis, di mana negara berhak membatasi hak individu demi keamanan nasional, namun berisiko melanggar prinsip-prinsip keadilan (Schmitt, 1922). Dari sudut pandang postmodernisme, kedaulatan hukum dikritik sebagai instrumen dominasi negara terhadap masyarakat, dengan hukum digunakan untuk mengontrol dan menormalisasi perilaku individu (Foucault, 1977).Selain itu, globalisasi dan kemajuan teknologi turut mempersulit penerapan kedaulatan hukum karena pengaruh kuat dari hukum internasional dan tantangan yurisdiksi lintas negara (Habermas, 1998). Esai ini menawarkan solusi filosofis dengan mengintegrasikan prinsip demokrasi konstitusional yang mengedepankan checks and balances serta kesadaran akan kedaulatan Tuhan yang menuntut hukum ditegakkan berdasarkan prinsip moral dan keadilan universal (Rawls, 1971; Al-Attas, 1993).Dengan pendekatan filosofis ini, esai ini mengusulkan transformasi kedaulatan hukum dari sekadar instrumen negara menjadi kesadaran etis yang menghormati nilai-nilai keadilan hakiki.

Abstract

Abstract:Conditional release of prisoners can be given when the convict has fulfilled the terms and conditions that apply in article 82 of Permenkumham Number 3 Year 2018. However, problems arise when the president takes the initiative to provide parole to prisoners, especially terrorism prisoners. Even though there are no provisions in the president's prerogative provisions that directly give authority to the president to be able to release prisoners, except the provisions that require prisoners to file clemency, amnesty, abolition and rehabilitation. Because of this, in this simple article the author conducted a discussion.Keywords: Conditional Release, President's Authority, Terrorism Abstrak:Pembebasan bersyarat terhadap narapidana dapat diberikan pada saat terpidana telah memenuhi syarat dan ketentuan yang berlaku pada pasal 82 Permenkumham Nomor 3 Tahun 2018. Namun, permasalahan muncul pada saat presiden berinisiatif untuk memberikan pembebasan bersyarat terhadap narapidana khususnya narapidana terorisme. Padahal dalam ketentuan mengenai hak prerogatif presiden tidak ada ketentuan yang secara langsung memberikan kewenangan kepada presiden untuk dapat membebaskan narapidana. Kecuali ketentuan yang mensyaratkan narapidana mengajukan grasi, amnesti, abolisi dan rehabilitasi. Karena hal inilah, dalam artikel sederhana ini penulis melakukan pembahasan. Kata Kunci: Pembebasan Bersyarat, Kewenangan Presiden, Terorisme

Abstract

Esai ini membahas konsep kedaulatan rakyat dalam perspektif filsafat politik dan perannya dalam kehidupan bernegara. Pada bagian pendahuluan, dijelaskan bahwa kedaulatan rakyat menempatkan kekuasaan tertinggi pada rakyat sebagai sumber legitimasi pemerintahan. Gagasan ini muncul sebagai kritik terhadap kedaulatan absolut raja dalam monarki, yang sering kali mengabaikan hak-hak dasar rakyat. Pemikiran John Locke dalam Two Treatises of Government (1689) dan Jean-Jacques Rousseau dalam The Social Contract (1762) menegaskan bahwa kekuasaan negara berasal dari kontrak sosial antara rakyat dan penguasa, dengan tujuan melindungi hak-hak warga negara.Esai ini kemudian mengeksplorasi perbandingan konsep kedaulatan rakyat dan kedaulatan raja dalam sejarah pemikiran filsafat. Ditekankan bahwa pergeseran paradigma dari monarki absolut menuju demokrasi modern menunjukkan pentingnya pembatasan kekuasaan untuk menghindari tirani, sebagaimana dijelaskan Montesquieu dalam The Spirit of the Laws (1748). Dalam demokrasi modern, kedaulatan rakyat diwujudkan melalui mekanisme pemilihan umum yang bebas dan adil serta supremasi hukum.Namun, esai ini juga mengakui bahwa konsep kedaulatan rakyat menghadapi tantangan dalam praktik, termasuk korupsi, oligarki politik, dan manipulasi media. Dalam dunia kontemporer, penguatan literasi politik dan demokrasi digital dipandang penting untuk memastikan rakyat tetap berdaulat dan berperan aktif dalam pengambilan keputusan negara. Esai ini menutup dengan refleksi tentang relevansi kedaulatan rakyat dalam menghadapi dinamika politik dan sosial abad ke-21 serta pentingnya masyarakat yang kritis dan sadar politik untuk menjaga prinsip-prinsip demokrasi yang sehat.

International law recognizes sovereignty as the right of a state to regulate its own internal affairs. However, this recognition is accompanied by limitations aimed at maintaining world order and respecting human rights. Principles such as non-intervention and respect for territorial boundaries are the foundations of international law that support state sovereignty.

Abstract

Abstract:The Ministry of Home Affairs Through the Director General of Politics and Public Administration conducts a series of activities to counteract any potential threats, obstacles, and disruptions to the implementation of General Elections in Indonesia. The expert team identified three electoral vulnerabilities in an area, namely: vulnerability to suffrage, the existence of disputes in the form of election objections adjudication, minority representation, public participation, candidate participation, election supervision, gender rights, campaigns, voter participation and voting. Therefore, Kominda is a form of prevention of the indication of vulnerability.Keywords: Kominda, Election, Ministry of Home Affairs Abstrak:Kementerian Dalam Negeri Melalui Dirjen Politik dan Pemerintahan Umum melakukan serangkaian kegiatan guna menangkal segala potensi ancaman, hambatan, dan gangguan terhadap terselenggaranya Pemilihan Umum di Indonesia. Tim ahli mengidentifikasi ada tiga kerawanan pemilu pada suatu daerah, yaitu: kerawanan hak pilih, adanya sengketa berupa ajudikasi keberatan pemilu, representasi minoritas, partisipasi publik, partisipasi kandidat, pengawasan pemilu, hak gender, kampanye, partisipasi pemilih dan pelaksanaan pemungutan suara. Oleh karena itu dilakukan Kominda sebagai bentuk pencegahan indikasi kerawanan tersebut.Kata Kunci: Kominda, Pemilu, Kemendagri

Abstract

This essay discusses the concept of sovereignty as the central pillar of a state's identity and superiority in the international order. Sovereignty is not just the highest power, but also the basis for a state's independence, integrity, and authority to determine its fate without external intervention. Through the perspective of thinkers such as Jean Bodin and Hans Kelsen, sovereignty is understood as the right of a state to regulate domestic affairs and maintain its integrity amidst global dynamics. Although globalisation challenges state authority, sovereignty remains a flexible and adaptive principle, allowing states to interact within equal international relations. Sovereignty also affirms the principle of non-intervention respected in international law. In the era of globalisation, despite interdependence, states must be able to maintain autonomy to protect national interests. Sovereignty symbolises the greatness and dignity of a nation that cannot be mortgaged or compromised, reflecting the right of a state to freely determine the direction of policy and maintain domestic and international stability. This essay emphasises that sovereignty must continue to be preserved, respected, and upheld to maintain the independence and identity of the nation.

Abstract

Esai Dilema Kedaulatan Pada Suatu Negara membahas dinamika kompleks yang dihadapi negara dalam mempertahankan kedaulatannya di era modern. Kedaulatan, yang secara tradisional dipahami sebagai kekuasaan tertinggi dalam suatu wilayah, kini menghadapi berbagai tantangan akibat globalisasi, intervensi asing, hak asasi manusia, hukum internasional, serta ancaman digital. Esai ini menguraikan bagaimana globalisasi mengikis kendali negara atas kebijakan domestik, sementara intervensi asing yang sering dibenarkan atas dasar kemanusiaan menimbulkan perdebatan tentang batas kedaulatan. Selain itu, dilema antara penegakan hak asasi manusia dan prinsip non-intervensi semakin memperumit posisi negara dalam hukum internasional. Di era digital, ancaman siber dan regulasi internet menambah tantangan baru bagi kedaulatan negara. Melalui analisis multidimensional, esai ini menekankan pentingnya redefinisi kedaulatan agar tetap relevan dalam tatanan dunia yang terus berubah. Pendekatan yang adaptif dan kolaboratif menjadi solusi bagi negara dalam mempertahankan kedaulatan sekaligus berkontribusi dalam stabilitas global.
