Abstract

Essay ini mengulas konsep kedaulatan dalam perspektif filsafat, yang melibatkan perjalanan panjang pemikiran dari otoritas absolut penguasa hingga supremasi hukum dan kehendak rakyat. Dimulai dengan Jean Bodin yang memperkenalkan konsep kedaulatan absolut, diikuti oleh perkembangan pemikiran filsuf seperti Thomas Hobbes, John Locke, dan Jean-Jacques Rousseau melalui teori kontrak sosial yang menekankan pada legitimasi rakyat. Hans Kelsen kemudian menggeser fokus kedaulatan menuju sistem hukum, menyarankan bahwa negara seharusnya berlandaskan pada supremasi hukum dan bukan kekuasaan individu. Namun, dengan tantangan globalisasi, konsep kedaulatan tradisional menghadapi perubahan signifikan, di mana negara semakin tergantung pada kerjasama internasional. Kedaulatan kini lebih bersifat dinamis dan kontekstual, harus menyeimbangkan kewajiban internasional tanpa mengabaikan prinsip-prinsip dasar seperti legitimasi kekuasaan, ketertiban sosial, dan perlindungan hak-hak rakyat. Meskipun demikian, kedaulatan tetap berperan penting dalam menjaga stabilitas, keadilan, dan kesejahteraan dalam masyarakat modern yang semakin terhubung.

Abstract

Politik hukum satu negara berbeda dengan politik hukum negara yang lain. Perbedaan ini disebabkan karena adanya perbedaan latar belakang kesejarahan, pandangan dunia (world-view), sosio-kultural, dan political will dari masingmasing pemerintah. Dengan kata lain, politik hukum bersifat lokal dan partikular (hanya berlaku dari dan untuk negara tertentu saja), bukan universal. Namun bukan berarti bahwa politik hukum suatu negara mengabaikan realitas dan politik hukum internasional.

Abstract

Esai berjudul Dilema Kedaulatan Rakyat Pada Suatu Negara dalam Dimensi Filsafat membahas secara mendalam permasalahan filosofis dalam penerapan kedaulatan rakyat sebagai prinsip fundamental dalam negara demokratis. Esai ini menguraikan bagaimana konsep kedaulatan rakyat yang ideal sering kali berbenturan dengan realitas politik, sosial, dan budaya yang kompleks.Bagian pertama, Paradoks Kedaulatan Rakyat: Antara Kebebasan Individu dan Kehendak Umum, menyoroti dilema filosofis tentang cara menyeimbangkan kebebasan individu dengan kehendak umum dalam sistem demokrasi. Teori kontrak sosial dari Jean-Jacques Rousseau dan kritik dari para filsuf seperti John Stuart Mill dan Isaiah Berlin dijadikan landasan analisis.Bagian kedua, Kritik terhadap Demokrasi dan Kedaulatan Rakyat dalam Filsafat Politik, mengupas pandangan kritis dari Plato, Friedrich Nietzsche, dan Joseph Schumpeter mengenai kelemahan demokrasi dalam menghasilkan keputusan yang bijak dan adil.Bagian ketiga, Dilema Praktis dalam Implementasi Kedaulatan Rakyat, menjelaskan tantangan nyata dalam menjalankan kedaulatan rakyat, termasuk korupsi, politik oligarki, dan rendahnya literasi politik.Bagian keempat, Kedaulatan Rakyat dalam Era Globalisasi dan Teknologi Digital, mengkaji dampak digitalisasi terhadap demokrasi, baik sebagai ancaman maupun peluang.Bagian terakhir, Pergeseran Kedaulatan: Dari Kedaulatan Rakyat Menjadi Kedaulatan Negara, menyimpulkan bahwa tanpa pengawasan efektif dari rakyat, kedaulatan rakyat rentan direduksi menjadi alat legitimasi negara otoritarian.Esai ini memberikan perspektif kritis tentang tantangan dan potensi kedaulatan rakyat dalam menciptakan negara yang adil dan demokratis.

Abstract

Abstract:The obligation of every human being is to keep the environment green. Healthy humans are people who value their environment. The Constitution of the Republic of Indonesia has stipulated in Article 28h paragraph (1) that "Every person has the right to live in an inner and outer prosperity, to live and get a good and healthy environment and the right to receive health services."This means that there is a legal guarantee for everyone who lives in the territory of Indonesia to get a healthy and green environment. Therefore this paper analyzes the extent of the role and contribution of various groups in the creation of the green environment.Keywords: Green Environment, Green Constitution, Healthy Environment Abstrak:Menjaga lingkungan hidup tetap hijau merupakan kewajiban dari setiap manusia. Manusia yang sehat adalah manusia yang menghargai lingkungannya. Konstitusi Republik Indonesia telah mengatur dalam pasal 28h ayat (1) bahwa “Setiap orang berhak hidup sejahtera lahir batin, bertempat tinggal dan mendapatkan lingkungan hidup yang baik dan sehat serta berhak memperoleh pelayanan kesehatan.” Artinya ada jaminan hukum bagi setiap orang yang hidup di wilayah Indonesia untuk mendapatkan lingkungan yang sehat dan hijau. Oleh karenanya tulisan ini mengalisis sejauh mana peran dan kontribusi berbagai kalangan dalam penciptaan lingkungan hijau tersebut.Kata Kunci: Lingkungan Hijau, Green Konstitusi, Lingkungan Sehat

Abstract

This essay discusses the significance of sovereignty in the context of the modern state, highlighting the transformation of the concept of sovereignty and the development of globalisation, technology, and international interdependence. Initially, sovereignty was understood as the absolute power of a state to regulate its domestic affairs. However, sovereignty must be adjusted to international norms and human rights in the global era. Globalisation and digital threats require states to balance domestic interests and global obligations. This essay also raises the dilemma of international intervention and the role of sovereignty in facing these challenges. Therefore, a more flexible, inclusive, and participatory sovereignty reinterpretation is needed, considering the state's responsibilities to its citizens and international cooperation. With this approach, state sovereignty can remain relevant and effective in responding to the challenges of the times, such as globalisation and climate change, while maintaining identity, security, and social welfare.

Abstract

Esai ini mengupas konsep kedaulatan Tuhan dalam konteks filsafat politik, menguraikan bagaimana gagasan ini membentuk teori pemerintahan dan memengaruhi kehidupan bernegara. Dalam pendahuluan, dibahas pandangan teokratis yang menempatkan Tuhan sebagai sumber utama legitimasi kekuasaan, di mana hukum dan kebijakan negara didasarkan pada ajaran agama. Esai ini mengeksplorasi bagaimana pemerintahan teokratis seperti Iran menjadikan hukum Tuhan sebagai landasan tertinggi, namun memunculkan dilema terkait kebebasan individu dan pluralisme agama. Melalui perspektif agama-agama samawi dan filsafat ketuhanan, kedaulatan Tuhan dipandang sebagai kekuasaan absolut yang mengatur hubungan manusia dengan Tuhan dan sesamanya. Namun, konflik antara kedaulatan Tuhan dan kebebasan individu muncul ketika hukum agama diterapkan secara ketat dalam negara modern yang heterogen. Hal ini memicu pertanyaan tentang sejauh mana negara dapat memaksakan hukum agama dalam masyarakat yang beragam keyakinan. Esai ini juga membahas peran kedaulatan Tuhan dalam pembentukan moralitas dan hukum negara serta relevansinya dalam negara sekuler dan religius. Dengan pendekatan filosofis dan pemikiran para ahli, esai ini mengajak pembaca merenungkan keseimbangan antara kedaulatan Tuhan, hak individu, dan prinsip negara modern dalam menghadapi dinamika global.

Abstract

This essay discusses the inherent relationship between sovereignty and the state and the state's role in realising and implementing sovereignty. Sovereignty, which refers to the highest power in a territory, cannot exist without the state as a legitimate political entity. The state is the foundation of sovereignty, acting as an institution that enforces the law, protects the rights of citizens, and maintains order and security. Through the social contract theory, the state emerges from social agreement to ensure security and justice. The state has the power to make laws, enforce rules, and resolve disputes, which reflects the operationalisation of sovereignty in the life of society. In the international context, sovereignty is recognised as the main attribute of a legitimate state, but it is not absolute because the state must comply with international norms. International recognition of the state is essential for the legitimacy of sovereignty, allowing states to interact at the global level. In conclusion, sovereignty can only exist effectively if a state exercises it, so the state acts as a pillar supporting sovereignty in the legal structure and international system.

AbstractInformation and communication technology is developing very rapidly. The community is directed to use communication channels that are personal, effective and efficient. This condition leads to the allure of communication via the internet. The allure of internet communication is because the internet frees information and users to move without restrictions. Ignorance of internet users to access news from healthy sources, and spontaneity to share news without checking and rechecking, resulting in hoaks easily spread in the community.Keyword: Hoaks, Internet, Social Media AbstrakTeknologi informasi dan komunikasi berkembang sangat pesat. Masyarakat terarah untuk menggunakan saluran komunikasi yang bersifat pribadi, efektif dan efisien. Kondisi ini mengarah kepada daya pikat komunikasi melalui internet. Daya pikat komunikasi internet disebabkan karena internet membebaskan informasi dan penggunanya untuk bergerak tanpa batasan. Abstract

This essay discusses how the constitution manifests the values of political philosophy that underlie a country. The constitution functions as the highest legal document and reflects the ideals of politics, justice, and ideal governance. However, in its implementation, the country often faces a dilemma between the perfect norms of the constitution and the existing social, political, and economic realities. This essay examines various foundations—philosophical, sociological, and legal—that strengthen the constitution as a reflection of the values of political philosophy. In addition, it also discusses the debate on the flexibility of the constitution and the challenges in balancing local and universal values. Finally, this essay offers ideal recommendations so that the constitution remains relevant, can accommodate the dynamics of society, and functions as the central pillar of a democratic state.
