Abstract

Abstract. This paper discusses efforts to increase the efficiency of utilization of professional teachers for the achievement of quality education. Teachers are professionals who have the duty and responsibility of educating, teaching, guiding, training, directing, and make an assessment and evaluation of students in early childhood education, formal education, elementary education, and secondary education. Education today is in dire need of professional teachers. It is intended for educational interaction between teachers and learners. Abstract

Abstract. Popular expectations of quality education in line with the demands of the business world to obtain quality workers. Thus education providers, must be able to respond to and accommodate the expectations and demands of the decision-making process to improve the quality of education. This gives confidence that the decision-making process can be used a variety of theories, perspectives and frames of reference (framework)-based school. This assumption gives the consequence that a school should be a major part in the decision-making process in improving the quality of education. Abstract

Abstract. This paper deals with the role of muṣālaḥah in conflic resolution among Muslim societies using a historical approach. From a historical analysis it is concluded that the concept of ṣulḥ and muṣālaḥah have predated Islam, and played a vital role in resolving disputes and conflicts among clans in pre-Islam Arab societies. In the period of Islam, as in the case of Fatḥ Makkah (winning over Mecca) and Ṣulḥ al-Ḥudaybiyyah (peace treaty at Ḥudaybiyyah). In resolving conflicts, there are principles employed by the Prophet Muḥammad, such as tolerance, non-violence, patience, forgiveness, peace, harmony and mercy.Kata Kunci:        resolusi konflik, muṣālaḥah, ṣulḥ, toleransi, nir-kekerasan, pemaafan

Abstract

Abstract. This article discusses the political thought of Rida Muhammad Rashid Rida in his work in the field of Fiqh Muhakahat. There are several themes that will be discussion, among them: Nationalism in Rida view, the state system, Islamic and Western modernity, and political thought of Rida in fiqh munakahat. In the fiqh munākahāt, Ridha still confined by the influence of classical scholars, such as not being allowed to marry a Muslim woman with a non-Muslim (Ahl al-Kitāb). Though the social context between the communities in the past different with the social context in the Ridha lifetime. Abstract

Abstract. Studies on polygamy is never finished, there's always pro and contra, in this study, the study of polygamy is focused on the study of law, fiqh study, and the study of hadith, and the view of some contemporary scholars on the issue of polygamy. Although just a description of the polygamy of the various rules, at the point of importance is the author's attitude towards the phenomenon of polygamy in Indonesia. Normative law that gives firmness in social life becomes important in this study. Normative approach is very thick in this paper, because the data used is based on a normative study. Regardless of the normative approach in this study to be one consideration in completing pro and contra on polygamy issues.Kata Kunci: Poligami, Hukum Islam, sarjana hukum Islam.

Abstract

Abstract.  Religion as an ideology in society is believed to allow it to become a paradigm as a solution to conflicts. Islam is a rahmat  li al-ālamīn religion in the life of mankind with conflicts settlement construction in the community as connectivity with customary law (ethics, moral values, character, and culture) and state laws that in fact emerged from the discourse of Islamic law. Religion becomes a balancing of social conflicts that arise from a variety of indicators, because Islam is a legal consensus that includes a variety of conditions and situations of society. Abstract

Abstract. Generally, abortion done in case of unwanted pregnancy and was usually motivated by a variety of factors, including economic, social, contraceptive failure in married couples, as well as sex of unmarriad couples. Islam strictly prohibits the act of abortion with social and economic motives. Abortion has absolutely forbidden unless it’s motivation based on justifiable reason in Islam. Perpetrators of abortion may be punished by heavy penalty, which is to pay al-ghurrah or freeing slave. If the penalty of al-ghurrah is applied in contemporary life, the content of the sentence is determined by a court verdict.  Islam greatly appreciates human existence since the early stages of events. Every effort to obstruct the growth of the fetus or to remove it from the womb before the arrival time of the birth naturally can not be tolerated.Kata kunci: aborsi, al-ghurrah, janin, ruh, hukum Islam.

Abstract

Abstract: Bank Syariah Mandiri is a state bank who first introduced a system of sharia. In a way, this bank was applying one system of cooperation with customers called muḍārabah. The systems of muḍārabah are also applicated in the Bank Syariah Mandiri Branch Palu, which was established in 2003. This study discusses the theory and application of muḍārabah system in Bank Syariah Mandiri Branch Palu. The results showed that the application of muḍārabah system in Bank Syariah Mandiri Branch Palu has not been fully realized purely in accordance with the theoretical foundation of muḍārabah system suggested by experts, despite the commitment of Bank Syariah Mandiri Branch Palu to customers has increased significantly.Kata Kunci: aplikasi, sistem muḍārabah, Bank Syarih Mandiri.

Abstract. This paper describes the development of modernism and reformism in Islamic law and social institutions. This study is directed to the existence of Islamic law in the midst of social change. Islamic law is eternal is faced with an ever-changing social reality, has attracted serious attention in many scientific experts. It is a debate among scholars orientalis is about environmental adaptability of Islamic law with the social development of society. Society always change with the change of time and place, while sharia law final and eternal nature. In connection with the issue, it is questionable whether Islamic law can be developed and can accommodate the interests of humanity that is always moving forward.
